the home of Tamar and Adam, it seems pretty absurd to pretend that the Philadelphia rabbonim, especially Rabbi Shmuel Kamenetsky, oppose the annulment and remarriage.

    Surely, the Philadelphia rabbonim, especially Rabbi Shmuel Kamenetsky, support the annulment and remarriage. Passions, apparently, haven’t changed from (internet 2012):

    Didn’t Tamar (supporters) pay Mendel Epstein $60,000 to “kneecap” Aaron in the court records? Yet Philadelphia rabbonim, especially Rabbi Shmuel Kamenetsky, support the annulment and remarriage? Wasn’t the annulment based on a fake/phony document like the Steele document? When I made aliya July 1991 I seriously felt in danger of getting kneecapped.     Good, Ehud. But the real question is, can anyone comment on why the Philadelphia rabbonim, especially Rabbi Shmuel Kamenetsky give Tamar a pass?
    I say that she doesn’t want children. That’s what my ex-wife once told me before I married her. I told her then I’ll do everything just you have the children.... Back to the parsha וישלח:

    See, the world accepted the 7 Noahide laws as vile crimes, not to be done and worthy of punishment. No pass for violating one of the 7 Noahide laws. Stealing, particularly kidnapping, is such a crime even non-Jews one recognizes as vile and evil. Arabs kidnapped blacks in Africa and sold them to buyers in America, hundreds of years ago. Very bad.
    Simeon and Levi, took each his sword, came upon the city unmolested, and slew all the males. Why all the city? Because the males in the city protected their evil rulers Hamor and his son Shechem. How exactly Simeon and Levi killed the two perpetrators of the kidnapping, the Torah is clear: They put Hamor and his son Shechem to the sword. The gamara says this is the basis for the law how to treat a ben Noah for violating....
    To Simeon and Levi the real crime was not the kidnapping but was the forced rape of Dinah: “Meanwhile Jacob’s sons, having heard the news, came in from the field. The men were distressed and very angry, because he had committed an outrage in Israel by lying with Jacob’s daughter—a thing not to be done.” (Genesis 34:7).
    Interesting that Mendel Epstein is jailed for 10 years for kidnapping a fake recalcitrant husband and not for bad things he was accused for decades, which included the assault on Aaron when Aaron went to visit his daughter.

    The Philadelphia rabbonim, especially Rabbi Shmuel Kamenetsky give Tamar and Adam Fleischer a pass. I’d like to know the reasons. Can anyone comment? I don’t know. This is a mystery to me. I really don’t know why Tamar always had such passionate and strong support. Could anyone enlighten me? It’s not just radical feminism, is it?

    To marry a woman who cannot have children, eg due to age or other problem?
    to marry a non jewish woman, and at least try to convert her either before or after?




    seems to me the first 2 are assur
    the third, whilst assur may also be reversed after the fact. the first 2 cannot, even if the woman gets a proper get

  7. Shtey tshuvos badovor! Hakessef ya'aneh es hakol. The K's feel endebted to the Epstein family, since Dr. Epstein was a big contributor to their Yeshiva. Secondly, Kessef metaher mamz.... this should have been enough of a heter for matir assurim in producing an offspring. They are not brazen enough to do so because of the backlash of a barrage of kole delo posik as a poseach al shnei haseifim.

    My theory. The idea that Joseph would rule over his brothers came from his mother Rachel. Rachel so badly wanted a baby. When Joseph was finally born Rachel and Jacob doted over Joseph much telling Joseph what greatness is in store for Joseph. This is what I told all my 9 babies holding them upon their birth

    Those six years Jacob pasturing the rest of Laban’s flock, where were Rachel and Joseph? Surely, Jacob was living like a man rejoicing that he fathered a baby late in life. I had a special joy fathering at age 50.
    Sarah and Abraham doted much over Isaac. They sent Ishmael into the desert with Hagar. Isaac knew he would rule. Jacob wrestled with Esau in the womb and in life. Esau pretended to be religious. Jacob got the birthright and Isaac’s blessings; “[Esau] said, Was he, then, named Jacob that he might supplant me these two times? First he took away my birthright and now he has taken away my blessing! And he added, Have you not reserved a blessing for me?” (Genesis 27:36)
    Who would be worthy to rule after Jacob if not Joseph?

    The Ohr Chaim says that marriage with a maid is not really a marriage. Non-Jews know very well maids that have babies fathered by noble in the castle have no rights.     While discussing today's wonders, I am wondering, e.g. if a Doc would compose an embryo from bank donors of einom yehudim, implant it to a yehudi couple that could not conceive, then bore a child, ma tehe oleho? Does the Peter rechem and ubar yerech imo have any bearing? What would R' Note G/ the K's, say about it? Should Klall Yisrael accept such a child from this couple as Kosher, are we guilty of machzik yedei ovrei aveira? Some thoughts to ponder.

    “IF A GIRL HAS GROWN etc. R. Abbahu citing R. Eleazar stated, The halachah is in agreement with R. JUDAH. R. Judah, however, agrees that if she was subjected to cohabitation after she had grown two hairs [So that there was a valid marriage kinyan (cf. Kid, 2a) after she had attained her majority], she may no longer exercise the right of mi'un. The colleagues of R. Kahana desired to give a practical decision [lit., to do a deed]21 in agreement with the ruling of R. Judah, although intercourse had taken place, but R. Kahana addressed them as follows: Did not such an incident happen with the daughter of R. Ishmael [who, after her father's death [I say the Romans killed him], while she was in her minority was given in marriage by her mother.]? She, namely, came to the schoolhouse to exercise the right of mi'un while her son was riding on her shoulder; and on that day were the views of R. Ishmael mentioned at the schoolhouse; and the Rabbis wept bitterly saying, Over a ruling which that righteous man [R. Ishmael] had laid down should his offspring stumble! For Rab Judah citing Samuel who had it from R. Ishmael stated: And she be not seized [Num, V, 13. E. V. neither she be taken in the act], [then only] [Sc. if she did not act under compulsion but willingly] is she forbidden [to her husband.], but if she was seized she is permitted. There is, however, another class of woman who is permitted [to her husband] even if she was not seized. And who is that? In such a case the woman may leave her husband without a letter of divorce and she has the status of a feme sole who had never before been married.], and who, even if her son sits riding on her shoulder, may exercise the right of mi'un and go away [since the marriage had no validity]. Thereupon they took a vote and decided: Up to what age may a girl [lit., the daughter] exercise the right of mi'un? Until that at which she grows two hairs. [On hearing this incident] they [R. Kahana's colleagues] abstained and did not act as they first intended. R. Isaac and the disciples of R. Hanina gave a practical decision in agreement with R. Judah, though the girl had been subjected to intercourse. R. Shamin b. Abba proceeded to tell it in the presence of R. Johanan; R. Johanan proceeded to tell it in the presence of R. Judah Nesi'ah [The Prince, Judah II] and the latter sent a constable [or a detachment of police, lit., searcher] who took her away [from her second husband who had married her in reliance on her mi'un].”
    Wow, R. Judah Nesi’ah took her away from her husband (her second marriage). She relied on the mi’un to annul her first marriage. R. Ishmael’s view is that marriage with an underage girl is a Rabbinic ordinance and the girl could always do mu’un as long as she is underage---even if she had a baby. R. Judah Nesi’ah disagrees with R. Ishmael.
    What would R. Judah Nesi’ah and R. Ishmael do if he were here today and the case of the K-G garbage heter came before Him? Surely they would take Tamar away from her second husband. Hello, Philadelphia rabbonim, especially Rabbi Shmuel Kamenetsky, are you listening?

  16. As noted in my previous comment, there is a debate among the Poskim, regarding surrogate motherhood, who is considered the Halachic mother. Do we look at the source of the original egg, or do we look at the host mother?

    Beyond that, we come back to the old debate between R' Moshe Feinstein z"l, and the Satmar Rebbe, regarding the permissibility of artificial insemination in the case of a Yehudi eishes ish. It can be argued, that their debate might also extend to the permissibility of implanting a fertilized embryo. וצ"ע.

  17. My theory/analysis of Midrash Rabbah - Genesis LXXXIV:7
    The basic disagreement between Joseph and the brothers was that Joseph felt that they were under the 7 Noahide laws while the brothers argued, correctly that they were under the whole Torah, written and oral as given later in Sinai. Yes, all 12 brothers were deeply involved with the surrounding people fighting evil. They learned the importance of fighting evil from statements of their uncle Esau. Esau always put a front of righteousness. Esau claimed that fighting evil in this world is more important than studying Torah in tents of Shem and Eber. Esau killed Nimrod and stole from him. Esau did terrible acts. Probably took the princess, raped her, though she was married etc.
    To the brothers a calf found in the womb of a slaughtered cow --- one may eat without slaughtering. To the brothers Bilhah and Zilpah were on a slightly lower plane than Leah and Rachel. To the brothers the daughters of the country were fit to marry.
    Joseph and all the brothers behaved as Job:
    “For I saved the poor man who cried out, The orphan who had none to help him. I received the blessing of the lost; I gladdened the heart of the widow. I clothed myself in righteousness and it robed me; Justice was my cloak and turban. I was eyes to the blind And feet to the lame. I was a father to the needy, And I looked into the case of the stranger. I broke the jaws of the wrongdoer, And I wrested prey from his teeth.” (Job 29:12-).

    The Malbim says that Job would break the jaws of the thief to get what the thief stole to return stolen items to their owners. If the thief swallowed the items, Job would punish him for his pillage and rapacity.
    pillage definition: 1. to steal something from a place or a person by using violence, especially during war:
    rapacity definition: the quality of having or showing a strong wish to take things for yourself, usually using unfair
    This is how Joseph ruled ancient Egypt for 80 years.

    No. A woman whose betrothal was a mistaken one קדושי טעות in the Gamara has a definite/narrow meaning. In the K-G garbage heter there is no mistaken betrothal/marriage just garbage. Don’t bring in Rav Rackman. We should strike out from our conversations all mentions of mistaken betrothal/marriage, of cases as Tamar v Aaron after years with a child born of the marriage. Why? Invites fake/phony documents and beatings---all what we see in the K-G garbage heter.     Right, MiMedinat HaYam. Nowhere says that Esau raped or had consensual sex with a married woman.
