Rabbeinu Yerucham: Forcing husband to give get

 Rabbi Adlerstein cited Rabbeinu Yerucham as permitting forcing a husband to divorce his wife in a case of ma'us alei. 
[YA Because once both parties have had their days in court/beis din, rulings have to be upheld. Once a marriage is terminated, a husband has no right in halacha to withhold a get. (When he truly wants to continue the marriage, and his wife is the one who walks out, he is not obligated to immediately grant a get, but can leverage it to try to repair the relationship. Once it is clear that both parties have given up on the marriage relationship - regardless of who requested the get, or who was at fault! - withholding the get is seen in halacha going back to Rabbenu Yerucham as extortion. The latter held that beis din could even use physical force to coerce a get at that point. Batei Din in Israel routinely accept this Rabbenu Yerucham. Certainly lesser forms of persuasion, as guided by responsible morei hora'ah, are permitted.] [YA - I can give you the cite.  I showed this Rabbeinu Yerucham to my brother and he  wrote the following rebuttal.


רבינו ירוחם מתיר לכוף במאוס עלי בספר מישרים נתיב כג' חלק ח' וז"ל וכתב מורי ה"ר אברהם בן אשמעאל כי נראה לו שאשה שאמרה לא בעינא ליה ליתן לי גט וכתובה והוא אומר אנא נמי לא בעינא לך אבל איני רוצה ליתן גט מסתברא דאין דנין אותה במורדת להפסידה כלום מעיקר כתובה ונדוינא אלא מיהו משהינן לה תריסר ירחי אגיטא דילמא הדרי בהו לאחר שנה כופין אותון לגרש והפסידה תוספת וכל מאי דיהיב לה מדיליה כו' עכ"ל
ובא אחד ומדייק מזה שהלכה למעשה אם הבעל לא רוצה ליתן לאשתו גט במאוס עלי שאחרי שנה כופין אותו. ומשמע כופין בשוטים לכאורה.
והנה הדבר פשוט שאפילו אם היה זה הפירוש פה שאחרי שנה כופין לגרש היות שלא נזכר דבר זה בש"ע ובגדולי הפוסקים וכדבר פשוט הוא בראשונים והפוסקים שלא כופין במאוס עלי אפילו אחרי כמה שנים שלכן אין לסמוך על זה לקולא. שזה שאמרו כמה ראשונים שבמאוס עלי לא כופין כלל ולא חילקו בין שנה לכמה שנים משמע שהם חולקים על שיטה זו.
וכל הכופה לבעל לגרש בשיטה יחידאה נגד רוב הפוסקים הוא מרבה מזמרים בישראל. ואפילו אם היה שקול אחד נגד אחד היה ספק אם מותר לכוף. והיה האשה בחזקת אשת איש שזה מכריע הספק לעשותו קרוב או ודאי לממזר ודאי.
שלכן מאחר שהרשב"א אמר בפירוש שאין כופין כלל במאוס עלי וכן משמע שבש"ע א"ה סימן עז' לא הובא שום צד לכוף במאוס עלי שאין לכוף במעשה עלי אפילו אחרי כמה שנים.
וז"ל הרשב"א שו"ת הרשב"א חלק ז' סימן תי"ד בענין מאוס עלי – ולעולם אין כופין את הבעל לגרש אלא רצה לגרש יגרש ואם לא רצה לא יגרש ואע"פ שלא כתב כן הרמב"ם ז"ל זהו דין האומרת מאיס עלי עכ"ל הרי בפירוש ברשב"א שהוא גדול הפוסקים שאין לכוף כלל לבעל במאוס עלי דלא כרבי אברם בן ישמעאל רבו של רבנו ירוחם. ואפילו היה הדבר ספק כאילו רבו של רבינו ירוחם גדול כמו הרשב"א היה הדבר ספק ואין כופין מספק בפרט שיש לה חזקת אשת איש והבנים או ספק ממזרים או ודאי ממזרים והאשה ודאי אסורה להנשא.
והנה המתיר על פי השיטה של רבו של רבינו ירוחם רוצה להתיר לבזותו שכן הוא המעשה שעליו אנו דנים. ואפשר שרוצה לכופו בשוטים שכן יש רע-בנים שסוברים שצריכים לעשות לו בשוטים. והלא הרשב"א שם כתב בפירוש שאפילו בזמן שהאשה אומרת שאין בעלה יכול להוליד ילד שכה"ג כתב הרשב"א שאומרים לו בפירוש שחייב לגרש. עדיין אין לבזותו. וכ"ש במאוס עלי.
וע' בבית אפרים אבן העזר סוף חלק ג' שבמאיס עלי אין כופין. ומביא הרשב"א חלק א' סימן קצב'. וז"ל ומצאתי און לי בש"מ הביא בשם ר"י דבמאיס עלי אומרים לו חכמים חייבוך להוציא כו' ור"ת אומר שאף זה אין אומרים לו אלא שאם בא לימלך בב"ד משיאים לו עצה שיגרשנה לאלתר ויפטור מכתובה עכ"ל הרי מחלוקת הראשונים אם מותר לומר להבעל במאיס עלי שחכמים אמרו שחייב לגרש שהוא כפיה בדבריםי בעלמא ועל זה בא ר"ת לאסור גם זה ולא הובא שום חילוק בין שנה אחד או כמה שנים דלא כרבינו ירוחם. הרי שרוב הראשונים לא הביא חידוש זה לכופו אחרי שנה ואם עושים כפיה הרי ספק גט ויש לאשה חזקת אשת איש.
ועוד שכה"ג הפשטות שודאי לכ"ע אינו גט כלל. שהיות שהבעל יודע שרוב הראשונים אוסיםר לכופו לא שייך לומר שהוא סומך על היחיד ליתן גט בלב שלם אלא ודאי שהוא נותן רק מחמת מכות או כפיה ולא סובר שמצוה לשמוע דברי חכמים באופן שאינו גט כלל.
ובכלל איני יודע למה הביא החכם בעיניו שיטת היחיד בזה להתיר כפיה במאוס עלי הלא יש שיטת הרמב"ם ועוד כמה ראשונים שעומדים בשיטת הגאגונים ג' מאות שנים לכוף להבעל בשוטים לגרש במאוס עלי אלא שלא עושים כן מחמת שהרבנים שבאו אחרי כן פסלו דרך זה עוד שלא יעשה עוד. וא"כ מה תועלת להביא שיטה אחרת שאינו נזכר בפוסקים נגד מה שהוא כן נזכר בפוסקים.
ועוד יש לדייק בלשון הרבינו ירוחם שההיתר זו לכוף במאוס עלי רק באופן שבין האיש ובין האשה אמרו בפירוש שלא רוצים זה את זה. כה"ג יש צד שאחרי יב' חודש שרואים שלא ישנו דעתם שכופים. אבל אם הבעל רוצה האשה ואינו מואס בה אלא שהיא מואסת בו לא מיירי ואין כופין כה"ג.

  1. I'm struggling with the Rov Poskim part of this statement. It is only Rov Poskim if you discount the Sephardi Sages, and a good number of Ashkenazi ones as well(Rav Shternbuch who has been brought here and Rav Moshe Feinstein who has also been brought there as examples).

    Quite simply the further we go into this and the more Teshuvot we examine the more the idea of not being able to pressure a husband at all under any circumstances seems to be a distinctly minority opinion on which some machmirim wish to hang their hat.

    That is not to say that the opposite overly makil opinion is any closer to the truth. However, there seems that Rov Poskim actually say that there are ways to pressure a husband to divorce his wife in which it will not be considered a Get Meousa(such as those brought by Rav Moshe Feinstein, the Yaskil Avdei, Rav Ovadia Yosef, and Rav Shternbuch).

    It would also appear that Rov Poskim hold that such pressure should not be immediate, but only after sufficient time has passed to be certain that there is no hope of saving the marriage.

    To be completely blunt, the Rashba and the Hazon Ish do not constitute a Rov Poskim, even though their opinions do need to be dealt with.

      You can be blunt today and blunt tomorrow. To coerce a husband to divorce with public humiliation is forbidden by the Rashbo VII:414, who is quoted by the major poskim BEIS YOSEF author of the Shulchan Aruch in EH 154, the Radvaz, Chazon ISh and see Shach at the end of Gevuas Anoshim who forbids any coercion even with passive ostracizing as does the Chazon Ish. And along comes Mr. Blunt who says "too bad."
      Why are you Mr. Blunt? Because you find any word somewhere and invent on top of it that the Rashbo Shach and Chazon Ish are wrong. This is not normative halacha, it is invention and it is completely treifeh. You twist the words of someone who discusses that maybe we could or should do something and that becomes "ROV POSKIM". If you have ROV POSKIM that permit coercing a husband with public humiliation, quote them exactly, don't throw around bubbles.

      Nu Rav, do you respond to every inquiry like a Behema, because you certainly did this one. Actually read my words, please, what did I say? However, there seems that Rov Poskim actually say that there are ways to pressure a husband to divorce his wife in which it will not be considered a Get Meousa Yes the Ben Ish Hai said it, Rav Ovadia said it, Rav Moshe Feinstein said it, Rav Shternbuch said it. Are you really in a position to classify all of these Rabbanim as treif? You know better than them?

      The problem is that you make a leap of logic. Yes Rov Poskim ARE AGAINST public humiliation, yet you extrapolate from that this also means any sort of pressure and still claim Rov Poskim which is false. Do I believe that the Chida, the Ben Ish Hai and most especially Rav Ovadia(who is known for his strict adherence to the B"Y) know what the B"Y meant better than you? ABSOLUTELY.

      However, you cloud the water by screaming public humilation, when we are not necessarily speaking of public humiliation. The piece you are supposedly rebutting definitely doesn't speak of public humiliation, so why do you feel the need to make that the issue?

    3. The main reason I came to this blog was because of ORA and RS who make and permit public humiliations. Do I infer from your words that you agree that ORA is wrong to publicly humiliate husbands, and that such a GET might well be invalid?

      What do you say about the tactic some use to try to get the husband fired which is ONES MOMONE?

      Yes I believe their tactics are wrong and such a Get would be possul m'd'rabbanan, according to the Beit Yosef.

      Now as far as Poskim that allow some form of pressure:

      מע' הרבנים הב"ד יכב"ץ. ראיתי את השאלה בענין הגט ואני היום +זה היה קודם סילוקו של צדיק בכ"ו יום+ איני בקו הבריאות לעיין בה כראוי. אמנם בהשקפה הראשונה נזכרתי שיש חלוק בדין גט מעושה דכל שאנו מחייבין אותו בדין על דבר אחד וכדי לפטור עצמו ממנו הוא מגרש אין זה נקרא גט מעושה. ונזכרתי החלוק זה הסכים בו וסמך עליו הרה"ג מהר"א אשכנזי ז"ל בספר בני בנימין ח"א סי' ל"ה. וכתב שם המקור חלוק זה הוא בתשובת הרב המבי"ט ז"ל והדברים יצאו מפה קדוש התשב"ץ ז"ל בח"א סי' א' וכאשר תמצא מסקנת דברי הרב מהר"א הנז' שם בדף ס"ג ע"א בד"ה איך שיהיה וכו' ע"ש ומפורש בדברי המבי"ט אף על גב דאונס האחר אינו בדין מ"מ אם הוא ברשות ב"ד ומגדר מילתא כדין קרינן ביה. ועי' למהר"ם גלאנטי ז"ל בס' גדולת מרדכי סי' ט"ז דף קמ"ד ע"ד ודף קמ"ה ע"א שהביא דברי הרב המבי"ט ז"ל הנז' ולא הביא חולק עליו בזה ע"ש.

      הנה כי כן בנידון השאלה אשר מעלתכם מטילין עליו חיוב מזונות לארוסתו ע"י הממשלה חשיב זה בדין יען שאתם עושים זאת בעבור תקנת בנות ישראל וכבר נוהגים אתם בדבר זה לעשותו מהאי טעמא ולכן נראה אם אחר שראה זה שהוא מתחייב ליתן מזונות לארוסתו נתרצה מאליו לגרש כדי לפטור עצמו ממזונות אין זה נקרא גט מעושה דהא אין אתם אומרים לו או תן מזונות או תגרש אלא אתם נותנים לארוסה אעלא"ן לחייבו במזונות בעבור תקנת בנות ישראל שאתם נוהגים בה והוא מאליו יהיה מוכרח לגרש להציל עצמו מן חיוב המזונות. כ"ז אני כותב בנחיצה רב'א /רבה/ כחותה על הגחלים ואין לי שעת הכושר לעיין בספרי הפוסקים ולראות אם יש חולקים על חלוק הנז'. ואיך שיהיה מעלתכם תכתבו להממשלה חיוב מזונות עליו להשקיט צעקת הארוסה ותראו איך יפול דבר אח"ז ומה דביני וביני תעיינו בזה הענין. והשי"ת יאיר עינינו באור תורתו אכי"ר.

      All of the above seem to allow the husband to be pressured in such a way that while giving the Get will potur him from the pressure, the pressure is not a direct result of his refusal. For instance they all require the husband(while Rav Ovadia and the Ben Ish Hai are fuzzy on the time, the Yaskil Avdei says after 12mos) to support the wife, until he decides to give a Get.
      So if keeping his wife an Agunah is more important to him than the support, that is his decision.

      Also Rav Ovadia Yosef in Yabia Omer 8:25 brings that the Harchakas of Rabbeinu Tam is permissable.

    Briefly I said two things. One, that the case of Rabbeinu Yeruchom is talking when both husband and wife say they don't want the marriage, not if the husband wants the marriage, and that may be a difference. Two, and this is the main thing, we know that many rishonim permit coercion with MOUS OLEI such as the Geonim and the Rambam. But the halacha is definitely not like their opinion, as we find in the Shulchan Aruch EH 77 that nobody permits this today and for hundreds of years. Therefore, to produce some rishon who feels that we force in MOUS OLEI does not change the accepted halacha from the Shulchan Aruch and others that we do not coerce in MOUS OLEI. And even if it would be a machlokess how can we be lenient. Especially as we have a rule that if there is s doubt in a GET the woman is forbidden because she has a previous status or chazoko of AISHIS ISH. See Rashbo I:1192 who forbids any coercion with MOUS OLEI. Beis Ephraim EH III:129 that RI permits telling the husband he must divorce but Rabbeinu forbids even this, surely humiliating him is forbidden. The process evident in some modern opinions that we can invent heterim to coerce in MOUS OLEI are far fetched.

  4. It is clear in Rov Rishonim that forcing a get through pressure is not a forced get. If its allowed by mais alei is the machlokes.

    Some Achronim are MISUPIK if pressure could cause a forced get so therefore they were machmir.
    The Halacha is clearly like the Rishonim who are paskening a vadei, and not like the Achronim who were misupik.
    (The Achronim didn't have access to most of the rishonim)

      I have called his house many time and left messages. Furthermore, other rabbonim involved will not talk to me either. I have really tried. I even had a talmid of RS call him while I was on the line, and RS replied that his source to dispute me was that the rabbis of Wash etc permitted public humiliation of the husband. But where did they get the heter?

      I want to make it clear that the RA BONIM is not one rabbi, but unfortunately, a major problem. Reb Elyashev fights them tooth and nail, but the reality is that things are getting worse all the time. Few people understand the issues, and one fine day we will find ourselves faced with a community of problem children. The people who produced this mess will still have their sevoroce, but since many or most people find them lacking, because they are usually different than what is says in Shulchan Aruch and major poskim, and are inventions nobody heard of until they were invented, woe to the children. The rabbis may mean well, or they may be enjoying the large sums paid to them for these inventions, but it won't make a difference to the coming community of doubtful children.

    First you bring the Rashba. So what. He is one opinion amongst the Rishonim. Then you claim that the Beit Yosef brings him in Eh"E 154. He does. But did you stop reading there? If you would have read on you would have found that he does not agree with the Rashba, so the Rashba is again a moot point. To this end so is your argument over the Beit Yosef.
    First if you had read all that proceeded before and done the proper pilpul there, you would have found that a Ones lo kdin is only possul M'D'Rabbanan, assuming that he was batel modaah ect. So your talk about increasing mamzerim in the world is just that, talk. Unless the principle of sofek m'd'rabbanan l'kula is taken off the table.
    Going on the Beit Yosef asctually permits force so long as we don't beat him. Though we can beat his father apparently until his father tells him to give a Get and then beat him to do what his father told him to do...
    The Shach. Well the Shach doesn't comment on Even HaEzer at all, so unless you have an actual source... I can't comment on the Shach.
    Eh"E 77. The Shulchan Arukh says nothing there about coercion. Perhaps the Rema does, I skipped the Rema, but the Shulhan Arukh does not.
    That leaves you with the the Chazon Ish I believe. Well for that I will quote Rav Ovadia Yosef, "The Chazon Ish was a private man, with no communal authority and no communal responsibility who simply liked to pile one chumra atop another."

    So if you omit many of the Rishonim, most of what the Beit Yosef writes, all of the Sephardi sages, many of the Ashkenazi ones, I guess you can come up with your Rov Poskim.

  8. I can't believe that statement about the Chazon Ish. The Chazon Ish was a Litvisheh "rebbe" and he was the power behind the farmers and the simple people who founded Bnei Braq. The Ponovicher Rov founded the Yeshiva there but accepted the Chazon Ish as his mentor. Many are the believed stories of his miracles, and he was even in Europe renowned as a major Gaon, certainly after the war. I can understand a major posek complaining about someone's chumrose, but to say that the Chazon Ish had no communal authority and responsibility is very strange. Just because he was not paid a salary doesn't damage him, as it did not damage the Vilna Gaon and the Chofetz Chaim. Such a statement, if uttered, should not be repeated, because sometimes in Torah arguments things get out of hand and we try to forget it.
