Sexual harassers led the Reform movement’s rabbinical school for more than three decades, according to an explosive new report commissioned by the school.

Rabbi Alfred Gottschalk, the president and then chancellor of Hebrew Union College-Jewish Institute of Religion from 1971 to 1996, and his successor, Rabbi Sheldon Zimmerman, who served until 2000, both harassed and assaulted women at the seminary, according to the report. While the allegations that led to Zimmerman’s suspension in 2000 had broken into public view earlier this year, Gottschalk had never before been named in public allegations.

In addition to leading the institution and teaching students, the men were also responsible for ordaining generations of Reform rabbis.

Reb Shlomo Zalman was of this world and he served to guide it. While not a philosophic devotee in the narrow sense of the term — he was, generally, not much involved in philosophic thought — he had great respect for Rav Kook. And beyond that, while certainly not an ideological Zionist, he had an intuitive appreciation of the significance of the enterprise of shivat Zion and the building of Eretz Yisrael. Hence, he related positively to the whole gamut of the religious spectrum, and dati-leumi bnei Torah turned to him no less than others. And they found a ready ear and an open mind.

4.         Shmittah Today in the State of Israel: Heter Mechirah
As we have already written in the past, the majority of the inhabitants of Eretz Yisrael in contemporary times (starting from 120 years ago) rely on the heter mechirah as a bedievad solution as long as there is no other choice, halachically and practically-speaking.
We will now explain what the disadvantages of this solution are and discuss some recent suggestions regarding how to overcome some of these hurdles. We will also explain why, with great pain and a prayer to HaKadosh Baruch Hu, to restore the crown of Shmittah to its former glory, we are compelled to recommend to the public to purchase this agricultural produce. Later, with Hashem’s Help, we will explain why one should refrain from buying non-Jewish produce and instead support farmers who receive guidelines from rabbinical authorities on how to work their fields.
The difficult plight of the Jewish farmers in Eretz Yisrael at the time of the renewal of agricultural settlement in contemporary times became more severe when they were compelled to contend with the question of observing the mitzvah of Shmittah. Gedolei Yisrael tried to find a remedy to their distress. The possibility then arose to sell their land to non-Jews in order to avoid the prohibition of working the fields during the Shmittah year. This suggestion spurred a fundamental halachic controversy that split the rabbis into two groups. Even the Netziv, a great supporter of Zionism, was opposed to it. In the end, Torah leaders like Rav Yisrael Elchanan Spector from Kovno, Rav Yehoshua from Kutna, Rav Avraham Kook (and in his footsteps, all the chief rabbis), the chief rabbi of Yerushalayim, Rav Tzvi Pesach Frank, and Rav Shlomo Zalman Auerbach (with a demand for improvements which have already been implemented in the last few years) supported this approach.
The Heter Mechira is based on the following halachic principles:
·         Since Shmittah in our age is rabbinic according to the vast majority of halachic authorities, “A non-Jew’s acquisition can free the land from its obligation in the mitzvah of Shvi’it.” (cf. Talmud Gittin 47a, introduction to Rav Kook’s Shevet HaAretz, perek 11; Rav Shaul Yisraeli’s Chavat Binyamin, volume 3, siman 101, in his correspondence with Rav Shlomo Zalman Auerbach).
·         Eretz Yisrael’s sanctity and the obligation to settle the land are not dependent on the question of whether there exists an obligation to fulfill the agricultural mitzvot (introduction to Shevet HaAretz, perek 15).
·         No prohibition of Lo T’chanein exists (the Torah prohibition of strengthening the non-Jew’s holdings in Eretz Yisrael) in a temporary sale, whose purpose is the strengthening of the Jewish settling of Eretz Yisrael.
·         No prohibition of sefichin and the law of shamor ve’ne’evad exists by agricultural produce that was grown according to halachic dispensation (in accordance with Mahari Korkus, and even according to the Chazon Ish, Shvi’it, siman 10, sif katan 6, when the sale was done in the proper manner).
·         The four forms of work that are forbidden by the Torah shall not be executed, even with the heter, in a forbidden manner.
In the last few years, many halachic improvements were made in this matter. We will mention a few of them:
·         The Knesset has legislated a special law exempting land sold for purposes of Shmittah from the obligation to register in the Israeli Land Registry.
·         The sale is not done by means of an authorization and appointment of an emissary (this avoids  a substantial amount of the Chazon Ish’s claims against the heter).
·         The sale contract has undergone many improvements, including the avoidence of the possibility that a “Saudi prince” could pay for the land parcels and never return them.
·         Those who have been appointed by the Chief Rabbinate on this topic, Rav Avraham Yosef and Rav Zeev Whitman, have extensively researched the question of ownership of each seller, and sat with landowners who understood well the sale’s implications. Thus the claim of insufficient intent “gemirut da’at,” has fallen to the wayside.
 
An additional advantage to this method is that it does not damage Jewish settlement of Eretz Yisrael. It allows for the continued supply of fruits and vegetables, including exported goods, throughout the entire year, at reasonable prices. This method is the only solution that takes into consideration the needs of the public and not just the individual’s desire to try to fastidiously keep the laws of Shmittah.
In spite of all this, allow us to again mention that this heter is bedievad. It is necessary to test each Shmittah year the need for its implementation. By using this heter, one is partially nullifying the laws of Shmittah. The land subsequently does not lie fallow, man does not cease his work, nor is there any social benefit from the Shmittah year that is observed in such a manner.
Therefore, let us repeat our previous statements that we must continue to pray that we will soon merit the observance of Shmittah from the Torah, with hidur and happiness. Amen!

The Halacha of Rodef and the Rabin Shooting by Rabbi Chaim Jachter

  The rules of Rodef, however, apply even in the absence of a Sanhedrin (Rambam Hilchot Rotze’ach 1:6-13 and Shulchan Aruch Choshen Mishpat 425).  In fact, the Rama applies the Halacha of Rodef to one who engages in forgeries.  Government authorities in the past imposed severe collective punishments (including executions) upon the Jewish communities in which a Jewish forger resided.  Thus, the forger endangers the community and is treated with the severity of a Rodef.

Rabin’s assassin had no Halachic basis to shoot Prime Minister Rabin.  Professor Schochetman notes that the shooting caused grave damage to the opposition to the Oslo process.  Moreover, it caused a profound Chillul Hashem whose impact we experience even nine years after the shooting.  Professor Schochetman (paraphrasing Teshuvot Chavot Yair 138) correctly describes the shooting of Yitzchak Rabin as "an foreign, evil, and bitter act." It is foreign to the Jewish people, it has no Halachic basis, it is morally reprehensible, and it has had bitter ramifications for Israeli society.

  Equally significantly, Rabbi Yehuda Henkin (Bnei Banim 3:33) and Prof. Eliav Schochetman (Techumin 19) have compellingly argued (after the Yitzhak Rabin assassination) that rodef cannot be applied to democratically elected government officials, even if one deems their policies to be misguided and dangerous.

Henkin vigorously opposed Zionism, but once the State of Israel was established he declared the need to support its continued existence, and denounced those who tried to undermine it. In 1959 he wrote:

This was stated as a psak din based on "Israel is restricted from rebelling against the nations." [...] Those essays I wrote before the advent of the state (many of which have been reprinted in my book Leiv Ivra) will testify to the fact that I am not a supporter of the government, and I objected to the entire idea of a state. (It is for this reason I am not a member of Agudah so that I not be judged incorrectly as one who agreed with their position in the founding of the state.) But now it is our obligation that we all support the state in the face of its external enemies and then go on to guide it in the ways of Torah.[8]

Rav Henkin openly challenged the anti-Zionist position of Neturei Karta and the Satmar Rebbe, Rav Yoel Teitelbaum, ztz”l. He wrote (1959 / 5719):


I was shocked to read in Chomoteinu of Cheshvan 5719 the slanderous notion that we are required to give our lives (limsor nefesh) to frustrate and resist the efforts of the State of Israel in its struggle against those who would rise up against them. This was stated as a p'sak din based on what we learn that Israel is restricted from rebelling against the nations (Ketubot 111a).


This opinion is clearly not in keeping with halacha [and which can result] in imminent dangers for millions of Jews. True, Chazal admonished subsequent generations about such a rebellion because it would entail danger to Jewish life, but once done, though the admonition was ignored, we are required to support them with our mesirat nefesh.


In fact this is precisely what occurred before the destruction of the second Beit haMikdash when Chazal warned the populace not to revolt against the Romans. Even the king (sic.) of Israel did not favor a rebellion. However, once the rebellion broke out and the war endured, the Sages of Israel assisted the rebels in their war. This is as the Midrash states that Yaakov and his sons did not want to go to war against Shechem. Once the deed was done (by Shimon and Levi) he reasoned: Shall I allow my sons to fall into the hands of the enemy? And so, he took sword into hand and went against them.


Now all the rabbis who were opposed to Zionism and the establishment of a state took up that position until the time that it was officially founded. Once the state was declared, anyone who plays into the hands of the nations of the world even where there is no imminent danger, is clearly a moseir and rodeif. All the more when there is danger to destruction of life in so doing... Surely, those who recently emigrated must be very weary of the state's efforts to strip them of their Torah way of life, but to proclaim that anyone who aids the state is a rodeif, well such talk is the severest form of redifa.


Such a sin derives from yet another transgression that they pre-judge all Zionists, Mizrachi and Agudah members and their rabbis, as heretics and apikorsim...


I call upon all the sagacious leaders who identify with this position to repudiate this stand immediately because the Arabs and their cohorts are using this material to strengthen their propaganda against Israel…
I have already written elsewhere that with vulgar protests we will not succeed with the powers that be. Such tactics make things worse. What has to be done is to get into the government and the Knesset to internally save what can be saved and to strengthen Torah and its adherents.


Those essays I wrote before the advent of the state (many of which have been reprinted in my book Leiv Ivra) will testify to the fact that I am not a chassid of the government, I objected to the entire idea of a state. (It is for this reason I am not a member of Agudah so that I not be judged incorrectly as one who agreed with their position in the founding of the state.)
