Can ICE Legally Shoot a Fleeing Suspect? Here's What The Law Says

  2. Whst happened is not about a "suspect".

    The driver had been told by a law enforcement officer to exit the vehicle. Instead, the driver accelerates and either intentionally or out of negligence strikes someone. In self defense, the struck individual fires his gun at the driver.

    This is similar to the following case.

    A car is stopped at a red light. A pedestrian in a crosswalk is crossing immediately in front of the stopped car. The car suddenly accelerates and strikes the pedestrian, who, to save himself from serious injury or death, instinctively draws his weapon and strikes the driver.

    1. This was not self defense. He shot her in the back of the head. She was driving away from him. No officers were in front of her. It was murder. An execution.
