גדולי ישראל במכתב חריף: האישה שקיבלה גט בצפת - לא מגורשת


מרנן ורבנן גדולי הדור מפרסמים מכתב חריף ביותר נגד פסק הדין של בית הדין בצפת שהתיר אישה עגונה שבעלה צמח וכותבים כי הפסק "מגובב בסברות בדויות ודחויות מהלכה" (ארץ(

פרשת הגט בצפת ממשיכה להסעיר את עולם התורה ואת פוסקי ההלכה: הבוקר (שלישי) מפרסמים מרנן ורבנן גדולי הדור גילוי דעת חריף כנגד הגט וקובעים כי האישה אינה מגורשת ונותרה "אשת איש". 
תחת הכותרת "מחאה נמרצת", כותבים מרן ראש הישיבה הגראי"ל שטיינמן, הגאב"ד הגר"נ קרליץ ועוד גדולי תורה: "נחרדנו לראות כי יצא "פסק דין" להתיר אשת איש גמורה לעלמא (אישה שבעלה "צמח" על ידי זיכוי גט)".

גדולי ישראל דוחים במכתבם בשאט נפש את פסק הדין שניתן וכותבים כי הוא "מגובב בסברות בדויות ודחויות מהלכה, ולדבריהן הרי הותרו עגונות רבות הנזכרות בש"ס ובפוסקים ואם כן כל חכמי ישראל מאז ומעולם עומדים כנגדם".

"על כן נתחייבנו למחות במחאה נמרצת על גילוי פנים בתורה שלא כהלכה והתרת אשת איש לעלמא", כותבים גדולי ישראל.

  2. This raises a couple of points, which apply to this and other controversial cases.



    1) Sometimes a posek will write or give an apparent psak or approval, and when an uproar takes place, they retract or clarify that they were nto giving halacha l' maaseh (HLM). How then, do we know if such a statement is or isn't actual HLM?


    2) Some people speak of "teleological" halacha , eg the importance of Jewish unity, or mipnei darkei shalom etc. I once spoke to R' Bleich and he said "there is no such thing as teleological halacha". BUt it seem to me that there is - it just depends on the telos of the posek.

    Yes or no? How did you address the substance of the letter from the serious poskim?? Ironic how while accusing others of an in-substantive response, you fail to add the substance yourself?

    As to your second point, where is the empathy for a sick spouse??? Is it right, fair or moral for a person to just dump their spouse if they become sick??? Do you remember the Terry Schiavo case?

  4. There are moments, where it would probably be wise not to make statements and just to accept or ignore other rabbis' decisions.

    There was a similar debate in Germany some 500 years ago, and it really only brings strife to klal israel and unhappiness to the woman who needs the get.

    By the way, I just read in Wikipaedia that a Mumar could not write a bill of divorce (Shulḥan 'Aruk, Eben ha-'Ezer, 123, 2).


    How does that play out on the validity of Gittin when a non-religious jew is involved?


    If you want to be stringent, you could consider that any Get given by any jew who does not believe and not keep all the mitzwot is invalid.


    Why not go with this solution?

    I honestly think that if you download the teshuva, which is 91 pages and 42,362 words long, and read through it, your questions will be answered.


    You will understand how puzzling the sentence you quoted is, given that, in fact, this is not the first time that get zikkui has been used.




    מול פסק דין של מעל 80 עמודים שדן בכל הצדדים ויצא מדיינים חשובים וברושם הרב אוריאל לביא שחיבר ספר יסודי מאוד (נדמה לי עטרת דבורה) בפסקי דינים, פשקוויל לא מספיק

    אישית ראיתי חלקים מפסק הדין וברור לגמרי שהוא חידוש גדול הדורש אומץ,אך לגבי הטענה שהיו בהיסטוריה הרבה עגונות שיכלו להיות מותרות ע"י זה, לצערי זה ראיה שלא ראו את הפסק דין ראשית היו מצבים שזיכו גט ועוד לא היה בהיסטוריה מצב שיהיה זכות גמורה לבעל שיכתבו לו גט כמו היום שמחד מאריכים את חייו כאשר ברור שלא יתעורר ובעבר היה נפטר מזמן ומאידך התייתר הצורך באשרה בעקבות הטיפול הרפואי

    The length of their "teshuva" is irrelevant. It's the content that counts. No one is responsible to respond to "teshuva's" put out by conservative rabbis, or even Open Orthodox rabbis - especially when they cite all types of irrelevant sources, couple with very faulty logic.


    Again, according to these relatively unknown Tzfat rabbis, most aggunot in history would not have a problem. (Additionally, what type of gibberish is it to allow a woman to dump her husband just because he's sick????)

    It's about the quality of the content.

    RZNG found it compelling.

    After you've read that content, please grace us with a detailed analysis demonstrating how RZNG knows less about hetterim for agunot than you do.

    (Hint: It's not for nothing that, as of yet, amongst the Rabbonim who have actually written lengthy teshuvot to be mattir agunot, NOT ONE has published a detailed response showing how this hetter is different.)

    As for the wife's decision to "dump" her husband, whatever you might think of the morality of it, she is within her halachic rights.

    An unknown dayan or a psak written with a pseudo name is enough to undo halachos of eishes ish?!?!?!?!?!
