Maharal's criticism of dayanim who only hear one side

כשאויבינו פלילים כו'. דקרא (ר' דברים לב, כט) הכי קאמר "לו חכמו יבינו לאחריתם" שלא מידם היתה זאת מה שהם מושלים בנו, אלא מה' היתה זאת, כי ה' מכרם וה' הסגירם (שם שם ל), שהרי האומות מודים ש"לא כצורנו צורם" (שם שם לא), שאינו שוה צורם לצורינו, ואפילו הכי "אויבינו פלילים" (שם), ולמה היה זה, אלא כי צורם מכרם. ומזה תשמע אם היה צורם שוה חס ושלום לצורינו, ראוי שיהיו אויבינו פלילים, כי בדין כך הוא, אחר שצורם שוה לצורינו, ראוי שיהיו אויבינו פלילים. ואם כן המביא דין בערכאות שלהם מייקר שם עבודה זרה, לומר חס ושלום כי צורם וכו'. וטעם זה ידוע, כי המשפט הוא לאלהים, כדכתיב (דברים א, יז) "כי המשפט לאלהים הוא". ועוד כתיב (ר' מ"ב יז, פו) "ולא ידעו משפט אלהי הארץ", הרי כי המשפט תולה באלהות. ועוד, כי עובדי עבודה זרה אומרים כי המשפטים הוא לאלהות שלהם, כי כל אלהות יש לו משפט, ולעולם הולכין אחר בית דין יפה וחשוב יותר (סנהדרין לב:), נמצא ההולך לפני דין שלהם מייקר שם עבודה זרה להחשיב משפט אלהיהם.
ובקצת ארצות ובקצת קהילות שמים ללענה משפט ראשונה, הקימו להם מציבות למנות להם מקצת ראשים בורים, לא ידעו לשון משפט ומהו הדין, ודרשו המקרא לגנאי לפני הדיוטות דווקא, שלא די שמנו ראשים בורים מכל, אלא נטלו המשפט מיודעי דבר המשפט ונתנו אותו לבורים, עד שהיודעים ותלמידים - בעיניהם רואים עוות משפט ודין גזל ועושק על מקצת ראשים בורים, ואין לאל ידיהם להושיע אף ליתום ולאלמנה. והנה עוברים כל שעה על "לא תטע לך אשירה אצל מזבח ה' אלהיך" (ר' דברים טז, כא), כמו שאמרו חז"ל (סנהדרין ז:) הממנה דיין שאינו הגון כאילו נוטע אשרה אצל מזבח ה'. ואולי רמז עליו בתורה "לא תטע לך אשרה אשר שנא ה' אלהיך" (ר' דברים טז, כא), כי אותיות "אשרה" 'הראש', "אשר שנא ה'" קאי על האשרה, הוא הראש ששנא ה' אלהיך, ואלהיך שונא אותו גם כן. וחכמי הדור אין להם להתאונן על כבוד התורה, כי דיו לעבד שיהיה כמו רבו (ברכות נח:), הרי הם מחללים שם שמים ומייקרים שם עבודה זרה, עבירה גוררת עבירה (אבות פ"ד מ"ב), דורשים 'לפני הדיוטות' דוקא, עד שבאו לדרוש 'לפני ערכאות' דוקא, עד שאין פונים עוד למשפטי התורה. ואין לך דבר אהוב לפני השם יתברך כמו משפט אמת, וכמו שאמרו ז"ל (שבת י.) היושב ודן דין אמת לאמתו נעשה שותף להקב"ה במעשה בראשית. והם משליכים אמת ארצה, עד כי אין משפטי אמת. ונמשך עוד כמעט חס ושלום שאין תורה ודת, כי אין ביד החכמים לגדור פרצות הדור, כי יאמר הראש וחביריו, והדומה לו, אין אתה אב בית דין לנו שאנחנו חייבים לשמוע לך. ויותר קשה לסבול עולם מעול מלכות, שמפני שאין הכבוד נאה לו, והוא אינו נאה לכבוד, [ו] כאשר יחשוב שאין אחד נוהג כבוד בו, ולא ירצה להיות כפוף תחתיו - מכניע אותו ומציר לו ורודף אותו בכל הרדפה, וכן לשפלותו הוא מגרה באנשים חשובים ותלמידי חכמים, שיסבור כי אין החשובים והתלמידי חכמים רוצים להיות נכנעים תחתיו, ולכן הוא דורך על במתי החשובים והנכבדים ביותר להשפיל אותם. אוי ואבוי להם מאותה חרפה ומאותה בושה ומאותה כלימה. אך נתקררה רוחי ונכבה אש יקוד לבי הבוערת, כי דבר בם ראיתי כי אין יוצא מאתם לא נין ולא נכד, עד שהעניות שולטת, [ואין להם] זרע שיהיה לו שם בחכמים ושאר בתלמידים.

ואני אומר כי ירא אלהים יחוש לו ואל יעמוד לפניהם למשפט, והרי אמרו ז"ל (סנהדרין ז:) "לא תעשו אתי אלהי כסף ואלהי זהב" (ר' לעיל כ, כ), זה דיין הבא בשביל כסף וזהב. ולפיכך נאמר "לא תעשו אתי", כי הדיין הוא עם השם יתברך, כדכתיב (תהלים פב, א) "אלהים נצב בעדת אל", ומי שהוא עומד לדין לפני דיין הממונה בעבור עשרו, הרי עושה אלהי כסף ואלהי זהב עם השם יתברך, אשר "נצב בעדת אל בקרב אלהים ישפוט" (שם). ומצוה להקל בכבודם, כמו שכתב בחושן משפט. ובירושלמי בסוף ביכורים (פ"ג ה"ג) רבי מני מקיל לאילין דמתמנין בכסף. רבי אמי קרי עליהן "אלהי כסף". ובאלו שנתמנו בשביל עשרם יש בהם הכל ועל הכל, כי הידים ידי עשו סמכו אותם. אמנם נמצאו גם כן בקצת קהילות נאמני רוח, כונתם לשם שמים, לא להשתורר על הציבור בגאוה, על אלו נאמר העוסקים עם הצבור לשם שמים צדקתם עומדת לעד, ועל האחרים נאמר (ישעיה א, כה - כו) "ואשיבה ידי עליך ואצרוף כבור סיגיך ואסירה כל בדיליך ואשיבה שופטיך כבראשונה

As a follow up to the chilling Maharal you shared with your readers, I would also like to point out the following Peirush HaGR"A on Esther 1:7, in the "al derech remez" portion on the left. There, the Vilna Gaon writes regarding the famous Gemara in Sotah that in the days leading to Mashiach there will be an abundance of chutzpa, " בעקבות משיחא חוצפא יסגי," because the dayanim appointed will be corrupt and "einam mehuganim," therefore "nearim pney zekeynim yalbinu," the young will embarass and challenge the elders-- and the Vilna Gaon concludes that chutzpah will be so prevalent that it will exist even in the elders, "in all of them including the gedoley hador."

דבעקבות משיחא חוצפא יסגי, והענין של החוצפא ההיא כי מעמידין דיין ופרנס שאינו הגון, ואמרו (סנהדרין ז׳) כל המעמיד דיין שאינו הגון כאילו נוטע אשירה כו׳, ובירושלמי קראם אלהי כסף ואלהי זהב (ע״ש במהרש״א) ולכך נערים פני זקנים ילבינו, אבל זקנים יעמדו מפני נערים מי הכריחן לכך, אלא שגברה החוצפא והוא אף בזקנים ובכולם גם בגדולי הדור.״

  2. This is a very poignant criticism. It applies equally to all Dayanim, regardless of which group or institution they belong to/identify with. And it should also provide each of us a moral lesson on the importance of intellectual honesty and the dangers of bias.

    If the MAHARAL would be around today he would realize that he needn't have bothered with creating a Golem since there are thousands of them around today and many are in leadership positions as well, rachmona litzlan.

  6. The situation with Dinei Torah is terrible, as anyone who has had experience with the system could tell you. It's often worth forfeiting the money rather than being put through the ringer. Tovea Holech Achar Hanitva is today interpreted to mean that even when both parties live in the same locale, the Nitva is the boss of which Bais Din to go to. This translates itself into the fact that if there is a genuine claim against someone, the defendant can choose the most dishonest or inept Bais Din, to hear the case. Anyone can open up a Bais Din. You don't need any qualifications. And there is no accountability to the Dayanim.

    The only way this situation can be corrected is if a central Vaad would be formed to oversee and give the rules for Botei Dinim, to which all Botei Dinim will have to comply. Then there can be qualifications and rules and accountability. It will not be able to schlepp forever and a Psak which is not correct would not pass through the system. I see this, however, as very difficult and therefore unlike to happen, because it isn't easy to create a general Vaad that everyone follows. But I believe it can be done, if the right person, who has the drive and perseverance, will put himself into this project and not stop until it is achieved.

      Really now? How will we, as a huge community, be able to truly trust "an individual"? How long before he, and his vaad (which will need funding!) will begin to crumble???? The Taubers opened Mechon L' because they were so bothered by the behaviors of Botei Din. They were successful for a nice number of years. However, now they are old and others have taken the rains (5+ years ago). There are secretaries as well! There are many proper dayonim still there. However, there is no fool-proof way for us to make sure others will overcome THEIR human condition.

    Towards the end of the first piece (in the printed sefer) it says:

    כל קלקול בדין גורם שמדת הדין מתוחה נגד שונאיהן של ישראל

    Next time one of these “Gedolim” tell us why Kllal Yisroel is suffering from so much pain & adversity, we should politely point out that he might be missing something..

  10. To Illustrate this open corruption, The seruv against Meir Kin signed by 1. HERSCHEL SCHACHTER, AVROHOM UNION, NOCHUM SAUER, was done without him ever being called to that Bais Din, never was sent summonses to appear, and surely has never heard his side of the story. Additionally Herschel Schachter lives in Ny, the other 2 in LA and are not considered a Bais Din in LA. In his case after the RCC had removed their seruv,, 2 of the RCC dayanim Union and Sauer, decide to draft up a new Seruv with Schachter without putting a logo or name on the letterhead of the SERUV. I couldnt find a better case of open corruption in the system of modern day Bais Dins.

      Are you saying that you support corruption since Jerusalem is thriving? Or that we should ignore corruption? Or that corruption doesn't exist? Or ignore the warning of the navi?

    2. B'H Jerusalem is thriving - but we have to always be mindful of what Hashem told us through his Neviei haEmet. I am not sure what Religious Zionism says, is there a guarantee that our return is irreversible?
      Yirmiahu 32 says ...40 "and I will make an everlasting covenant with them, that I will not turn away from them, to do them good; and I will put My fear in their hearts, that they shall not depart from Me. "
      So once this has occurred, perhaps we have a guarantee, but we still await that wonderful day.

    3. The issue of Jerusalem may only be related to past destructions, but that is to completely miss the point. Someday there is always a price to pay for deviant behavior. I would love to avoid the consequence of violating God's rules.

    ״וכדאי הוא דבר זה בלבד להעמיד ירושלים בחורבתה וישראל בגלותם.״

  14. I am not sure that גדולי הדור in this context necessarily refers to גדולי תורה - it may mean the leader and rulers of the generation. See Rashi Breishis 21:8, where the Philistine king Avimelech is included in the list of גדולי הדור.

    See Shabbos קלט. and Rashi - clearly says תלמידי חכמים. Of course, you could say it means not "real" תלמידי חכמים, but there would be no way for the regular person to know.

    In בעשט על התורה often mentioned from Besht the בחינת ג' הגליות, והקשה שבכולם של הת"ח בין שידין יהודאין..

    On the פירצה of פסק דין ללא שמיעת ב' הצדדים - see ברכי יוסף חו"מ י"ז who brings "כל פירצה שאינה מן הגדולים אינה פירצה. Obviously he means ת"ח.

    The list is really very long.

    The problem is we're asked to have the אמונת צדיקים like בדורות הראשונים, but the ת"ח aren't required to their what Chazal expect from them - see הקדמת הרמבם על פירוש המשניות, where he first says that תלמידי הלל ושמאי where NOT to blame שלא שימשו כל צרכן because they tried their best, and shortly afterwards the Ramabm (when talking about the Seder המסכתות talsk about the purpose of פרקי אבות and he writes :

    שהוא רוצה לזכור במסכת זו מוסר כל חכם מן החכמים עליהם השלום, כדי שנלמד מהם המידות הטובות. ואין אדם צריך לזה הדבר כמו הדיינים; שעמי הארץ, כשלא יהיו בעלי מוסר, אין ההיזק לכל ההמון, אלא לבעליו בלבד. אבל השופט, כשלא יהיה בעל מוסר וצנוע, יזיק עצמו ויזיק לבני אדם. לפיכך היה תחילת דבריו במסכת אבות – מוסר הדיינין, כמו שאמר: "הוו מתונים בדין".
    וצריך שייווסר השופט בכל העניינים שיש במסכת אבות. כגון, שיהיה מתון בדין, ואל ימהר פסק דין, שאפשר שיהיה בדין ההוא עניין נסתר, כמו שאמרו עליהם השלום, דין מרומה. ואין לו להאריך בדין כמו כן, כשידע שאין בו דבר נסתר, שזה נקרא עינוי הדין.
    ויש לו להשתדל בחקירת העדים, ....

    וצריך לשופט שלא ירבה לרדוף אחר תענוגי העולם, ואהבת העושר והמעלה, כמו שאמר הכתוב (שמות יח): "שונאי בצע". ואמרו עליהם השלום: "מלך במשפט יעמיד ארץ ואיש תרומות יהרסנה"; אם דומה הדיין למלך, שאינו צריך לכלום, יעמיד ארץ; ואם דומה לכהן המחזר על הגרנות, יהרסנה (כתובות קה ב).

    iy's really not so simple.

    But ח"ו not to be מיקל בכבודם of true תלמידי חכמים - as the Gemara in סנהדרין says that אין לו חלק לעולם הבא.
    But see רבינו יונה בשע"ת שער ג' מאמר קמז-קמח and especially piece starting
    והמבזים לת"ח ויראתו מבטלים הידיעה הזאת ומראים ההפך בהנהגתם. וכאילו ואומרים אומר כי אין העבודה עיקר. וכי שרש דבר נמצא מבלתי עבודת הש"י. …. ואחרי אשר התברר שהכל ברא הש"י לכבודו. חייב האדם לשום לבו בכל עת לכבד את ה' ולקדשו בכל דבריו ולרוממו להודות לו ולברכו תמיד

    Its clear from him that the תכלית of כבוד ת"ח is to strengthen עבודת ה', and not a separate "entity" as of in itself.

    Also the חינוך על מצות זקן ממרא תצ"ו who writes:

    שאפילו יהיו הם טועים בדבר אחד מן הדברים אין ראוי לנו לחלק עליהם, אבל נעשה כטעותם, וטוב לסבל טעות אחת ויהיו הכל מסורים תחת דעתם הטוב [ה] תמיד, ולא שיעשה כל אחד ואחד כפי דעתו, שבזה יהיה חרבן הדת, וחלוק לב העם, והפסד האמה לגמרי.

    But he makes it clear that he's talking about
    ובכל דור ודור גם כן שנשמע אל החכמים הנמצאים שקבלו דבריהם, ושתו מים מספריהם, ויגעו כמה יגיעות בימים ובלילות להבין עמק מליהם ופליאות דעותיהם, ועם ההסכמה הזאת נכון אל דרך האמת בידיעת התורה

    The issue his is that (as mentioned before לענין הוה מתונים בדין) unfortunately today:
    1) due diligence is often clearly missing, 2) Impossible to get reasons for פסק תמוה, בניגוד ליוד רמ"ב, 3) They say דעות on things that clearly belong to the individual - see הקדמת החו"ה ומה שהבין על הפסוק בין דם לדם וכו'

    The issue is not ח"ו to be מזלזל בת"ח, but rather to be מקדש שם שמים by trying to somehow turn things around so that the מנהיגי הדור do what Chazal give as their "job description", because otherwise השופט, כשלא יהיה בעל מוסר וצנוע, יזיק עצמו ויזיק לבני אדם. וכלשון הרמבם הנ"ל
