Remaining silent - when it is required to speak - causes the same spiritual damage as lashon harah

The Klausenberger Rebbe explained the reason behind the Chofetz Chaim's great dread of speaking lashon harah as that one needs to view it spewing a nerve gas into the environment. Chofetz Chaim  clearly feels that it is better to err in not speaking rather than causing the great destruction if you mistakenly speak lashon harah. Fear of lashon harah combined with fear of mistakenly saying lashon harah effectively produces a very strong bias towards silence.

I just found this Shem M'Shmuel who has a different view. He asserts that remaining silent when one needs to speak up e.g., child abuse, fraud, or poor shidduch  - produces the same spiritual damage that saying lashon harah does. Consequently you are not safter remaining silent and being machmire when ever there is a doubt. He thus is claiming that there is no safety in silence and one must speak - even if you risk speaking lashon harah - when there is a to'eles to speak.




שם משמואל - פרשת וישב - שנת תרע"ז

      The purpose of bringing this excerpt from the Shem M'shmuel is to show that the Avnei Nezer who was a major widely accepted Posek ruled this way and one who follows this is following a ruling if a major Posek and has whom to rely upon. If you wish to be a Man D'omar, don't let me stop you.

Amongst talmidei chachomim and especially poskim - you do not see them taking the approach of the Chofetz Chaim - but rather that of the Shem M'Shmuel. It seems that the Chofetz Chaim is for the masses.

    8. The Chofetz Chaim is very makpid that even when there is a benefit - there are 7 conditions that must be fulfilled. Teshuvas from Rav Ovadiya Yosef, Tzitz Eliezar, Rav Sternbuch etc etc. Do not mention these 7 conditions but simply say that if it for To'eles then say it.

  4. ayin shem mishmuel on chanukah where he explains that the mitzvos ner and hallel and k'neged the two things that the yavanim had an achiza in, heyos that yefes looked away from Noach and did not speak (meaning, not like Cham). So the two mitzvos, to light ner chanukah is to be m'saken the ko'ach a r'iyah and saying hallel (not remaining silent from saying dibburim assurim,) is m'saken the koach hadibbur.


    Garnel, ich veis nisht what you are asking. The shem mishmuel was not written for bar mitzvah boys and alter bubbes. Why should your average Yid own one?

    Is your whole gripe against the C”C because he requires the fulfillment of these five (I didn’t find seven – only five) conditions, & it isn’t enough to just be מכוון לתועלת?

    I don’t know your מקורות in “Teshuvas from Rav Ovadiya Yosef, Tzitz Eliezar, Rav Sternbuch”. I’ll take a wild guess that they may disagree solely on condition #5. Is that true? I think all the others are COMMON SENSE.

    Even according to C”C, Yosef erred, as mentioned in כלל ג' במ"ח י"א, כלל י' במ"ח ז' הל' לשה"ר, because Yosef was required to speak to his brothers BEFORE telling his father.

    In the “hot topic” here of divorce – I think it’s reasonable to say that if the Rabonim backing women who leave marriages WOULD listen to the C”C & would be מקיים these five conditions before believing the women – it would go a long way to save lots of marriages!

    1. You are looking at hilchos rechilus where he is a bit more lenient. Look at the parallel discussion in hilchos lashon harah where you will find the seven conditions. 10:1 He makes no exception for lashon harah

      Chofetz Chaim says that if you are saying the lashon harah because you are angry at the person - even if it is also for to'eles - you can't say it. For example if someone was raped and was furious at the assailant - according to the straight reading of the Chofetz Chaim the victim could not tell anyone.

      1) Not quite. See רכילות כלל ט' במ"ח ג'':

      ג) רק לתועלת. ה...ואין כוונתנו בפרט זה, דאם איננו מכוין לתועלת הוא פטור ממילא מלספר מחמת חשש איסור רכילות, דהלא לא תעמוד על דם רעך כתיב, ואף בענין ממון .... אך כונתנו שיכריח את עצמו בעת הסיפור לכוון לתועלת, ולא מצד שנאה, כי על ידי זה יגנדר על עצמו ממילא איסור רכילות.

      There is no reason why L"H should be different - if there is indeed a Toeles & he's not just blowing off steam.

      Also, you surely know the C"C about להפיג צערו - that's what all frum therapists rely on....

      I stand corrected on the 7 vs. 5 - The extra two in H' L"H are 1) seeing yourself - because a חשש isn't enough by לשה"ר but is enough for רכילות. 3) To first be מוכיח, which by רכילות, כלל ט' במ"ח י"ד the C"C is כמסתפק, but ultimately in the C"C itself he does require תוכחה by רכילות under normal circumstances.

      Also common sense.

    3. Ploni you are repeating your mistake by citing what he says in hilchos rechilus and insisting that applies to lashon harah - when in fact he is very clear that it doesn't. To'eles is different for lashon harah - otherwise he would have simply said the same thing in both places - and he doesn't. He goes into detail in Be'er Mayim Chaim discussing the machlokes of the Sma and the Taz regarding whether motivation overrules to'eles and concludes not only does it - but that both the Sma and the Taz would agree that motivation is more critical in lashon harah even though they disagree about hitting an assailant.

      Please read Rav Yisroel Veinman article about how the Chofetz Chaim deals with a person with motivation for to'eles and also hatred at the same time. It would help also if you read Dr. Benny Brown's analysis of the Chofetz Chaim.

      The teshuvos deal with the issue of a driver without a license or who drives in an unsave manner. They both quote from the Pischei Teshuva 156 which says that while lashon harah is terrible - not saying negative things when it helps people is even worse. No mention of the 7 conditions. Rav Sternbuch's teshuva deals with a principle that won't listen to lashon harah about a teacher who is an alleged pedophile. Again know mention of 7 conditions - simply whether it is to'eles.

      If I understand you correctly, you’re claiming that the C”C I quoted from רכילות כלל ט' במ"ח סק"ג, that says that one should not stand by the side, but rather force himself to be מכוון לתועלת and overcome his feeling of שנאה – is talking only by רכילות. By לשון הרע, you claim that according to the C”C the Halacha would be different, as you quote from רכילות כלל ט' במ"ח כ"ח בהגה"ה.

      I’m sorry, DT – but לפענ"ד the differentiation makes no sense.

      The proof you’re bringing, from רכילות כלל ט' במ"ח כ"ח בהגה"ה is ALSO talking about רכילות and NOT by לשון הרע. So you’re putting yourself in the tough position of making a סתירה in the C”C’s own words… Not good!

      I believe that what’s really going on here is as follows: Everybody agrees on two points insofar as protesting/acting against an עוולה, whether abuse, fake claims of abuse, fraud or other unfairness:

      A) There has to be proof of a transgression that we are protesting/acting against.

      B) There has to be some benefit attained from our protest/action. Once these first two conditions are in place, the מחלוקת ט"ז וסמ"ע concerns a THIRD point…

      C) Our motivation to want to correct the עוולה: The Taz holds that when someone obviously did something wrong – such as when one Jew hits another for no permissible reason, we should help the victim REGARDLESS of our emotion of hatred towards the abuser. The Semah holds that in cases where the bystander’s motivation is CLEARLY not altruistic, as he writes "דכמה פעמים רואה שמכה אחד לחבירו ואינו חושש.. דוודאי מכח שנאה בא להכותו ולא בא להפרישו", he shouldn’t act.

      This explains the different things the C”C says:

      In במ"ח סק"ג he is stating that the Mitzvoh of לא תעמוד requires us to do what would be called “self-distancing” (see research of Ayduk, Bremner - if you want I can send you citations) and be מכוון לתועלת, not out of hatred. He’s not worried of what the Semah says in ס' תכ"א, possibly because: a) the Semah only talks in cases where the intervenor’s motivation of hatred is obvious because he doesn’t usually care about people fighting, not so in regular cases where motivation is unknown, and b) in the Semah’s case the intervention is undertaken כי יחם לבבו, before the intervenor has time to cool his emotions, no so in regular circumstances where there IS time to cool emotions – so we are required to do so, BECAUSE THERE IS A MITZVOH NOT TO STAND BY IDLY.

      The 5/7 conditions of the C”C pertain to something ENTIRELY different: They are necessary to ascertain point “A” & “B” mentioned above; that an עוולה did indeed occur, that our intervention will bring benefit. An appreciation of inherent bias in decision making is common sense.

      Elsewhere I’ve posted how A) Sefrei Haskofo assume human cognitive biases as a given. B) Lehavdil, Greek philosophers like Socrates & Aristotle also did. C) Cognitive therapy is built around this theme. C) Behavioral economists and those that study logic & decision making like Tversky, Kahaneman, and Arieli etc. also do. Who in their right mind DOESN’T??????

      The fact that Poskim DON’T mention the C”C condition’s mean nothing. They are working from the assumption that an עוולה – or at least a well-reasoned ספק עוולה - did indeed occur, & that our intervention will bring benefit.

      Which of the C”C’s conditions would you remove?
      1) No need to be מתבונן if the action was בעצם רע? 2) Its okay to exaggerate the רע? 3) No need to try to be מכוון לתועלת? (That would לכאורה be okay according to the Taz). 4) No need to try to find a way to reach the benefit without having to tell others? 5) Its okay if the punishment doesn’t match the transgression (this might be true if we go that דינא דמלכות allows for a greater punishment).

    7. Ploni I assume that you agree with me that the CC regardinging Lashon harah does not say what you are saying in order to reconcile the apparent contradiction to rechilus?

      He does not say that the mitzva of not standing by is critical also for lashon harah - why not?

      The CC clearly is concerned not only that a sin took place but the motivation - see Minchas Asher on the posuk. It is clear that the motivation has be correct or you can't relate the information. The poskim clearly do not acknowledge such a concern.

      לא תעמוד is usually by רכילות, because רכילות deals with talking directly to the concerned party, as opposed to לשון הרע.

Yes, and he clearly states that one shouldn't refrain because of a חשש on motivation, but rather do self-distancing, as he says אין כוונתנו בפרט זה, דאם איננו מכוין לתועלת הוא פטור ממילא מלספר מחמת חשש איסור רכילות, דהלא לא תעמוד על דם רעך כתיב, ואף בענין ממון .... אך כונתנו שיכריח את עצמו בעת הסיפור לכוון לתועלת, ולא מצד שנאה.

      You are assuming something that if true he clearly would have stated - but he doesn't say it. He clearly insisted on having two sections of lashon harah and rechilus because he didn't view the halachos were identical.

      What he says for rechilus is a major leniency. That is no reason to assume it applies to lashon harah unless he explicity says so - and he doesn't.
      His discussion of the severe limitation of motivation that he adopts from the Sma clearly would appear to both. In sum, you are reading things into the Chofetz Chaim that he clearly would have stated if they were true - but he doesn't state them.

  6. The Shem M'Shmuel goes in the derech of Chassidus that one must also look at the intent of the Torah and not just the dry halacha. Just as an example, the reason some chassidim davened after zman teffila was because they felt the intent of tefilla was to have deviekus hashem and if one wasnt capable of reaching deviekus without a few hours of preparation then it was better to daven late with deviekus then without and early.

    As for Lohson Horah, the intent of the Torah is not degrade another yid who has a chelek elokai meemal. However, when someone wants to save someone agmas nefesh one may speak without worrying so much. Also, if someone has a good understanding why you are not allowed to say Loshon Horah then it will be easier to know when you are allowed to say.

    Looking into the intent of the Torah is the equivalent of thinking every time one does something "What is the ultimate ratzon hashem in this case?". Many Gittin would be avoided if everyone thought this way. When only looking at the dry halacha it is also conducive to looking for heterim because if you don't care what the ultimate ratzon hashem is then its very easy to find a source for whatever you want the halacha to be.

    1. You are correct in your understanding of the Chassidishe way about this. But one must be very careful with this. Let me explain. We have no Hassagah of Hashem or his Ratzon. We only know his Ratzon through the Torah. We are not capable of knowing the intent, unless it is clearly written somewhere in the Torah. So in your example we must first know that the Torah commands us to save people from agmas nefesh, which it does - Lo Saamod etc. So even without the Chassidus, but with pure Lomdus, one could prove what takes precedent over what, and come to the same conclusion. It's just that Chassidus puts the emphasis on this way of thinking more than without Chassidus. But if it can't be shown black on white or extrapolated and proven to be a dry fact somewhere in The torah, no Chassidus could alter that with claims of intent. That's why I say one must be very careful with this. When it seems that a psak is based on feeling, if the Posek is worthy, we should say that his feeling is based on Torah fact. RMF Z"L once said that he knows that all of his ideas are Torah based because he has never been exposed to any other Chochma or Mada besides Torah. That is by your definition a Chassidishe approach, and by mine too.

    2. Lashon Hara is only a matter of personal morality, and its halachos only apply in bein adam le-chaveiro cases. Whenever a situation involves politics or communal welfare of administration of justice, the halachos of L''H go out the window. This principle answers just about all the issues raised in this blog.

      I appreciate you expounding on my post with a very well thought out reply. I believe the Satmar Rov fought very hard against those who tried to go out of the boundary and only use intent without backing it up with something black and white.

      Korach & Zimri were al pi chassidus tzaddikim that made the mistake of using intent only.

      The halachah is binding on everyone regardless of the "intent." You cant daven shachris at 3PM. Period. Chazal teach us that Shlomo Hamelech's mistake was thinking that the laws didnt apply to him since the reasons didnt apply. This was wrong.

      There is no basis for davening shachris at 3PM or mincha at 11PM.

    5. I'm not a talmid chochom so I will not argue with you on Halachic terms. However, I will point out a theory. There are Halochos that overide other Halochos. For instance, pekuach nefesh overides almost all other Halochos. There are two seemingly conflicting halochos in regards to Tefila. One is that one must daven with clean intestines, with kavanah and then there is the requirement to daven by zman tefilla. Who said that zman tefilla is more important that the other halachos of kavanah & clean intestines? Seemingly, chassidisher poiskim held that kavanah & clean intestines override the halacho of zman tefila.
