The Rov replied, “A Beth Din that does things in defiance of
the Shulchan Aruch loses the status of Beth Din.” His exact words, as I
remember them, were that he removed from the Beth Din “the Chezkas Beth Din.”
The above comment came from the Posek HaDor HaGaon Rav Yosef Shalom Elyashev zt"l. It was later confirmed in a sefer Mishpitei Yisroel with letters from Gedolim in Israel such as Rav Shmuel HaLevi Wosner, Reb Chaim Kanievsky, and others.

ReplyDeleteThere is a book recently published called Mishpitei Yisroel. It contains dozens of major rabbonim signing this and that letter about these halochose. The book has a telephone number in the beginning in Monsey, 845-352-0532. I personally know some senior people in Israel involved in the project and publication, and the signed letters are put in the beginning of the book.
Well, we see that the FBI chose them above other Beth Dins. What other Beth Din could be relied upon to convict a husband who didn't exist? And what other Beth Din would have somebody come along and say that the only kosher Beth Din in America is the Beth Din of America?
ReplyDeletePeople who have sent years learning halacha at the feet of the greatest sages have an idea of what these rabbis meant. To put it into a small capsule and claim that it refers to "Torah" period, is a daunting challenge. However, when we have a pesak in Shulchan Arudh EZ 77 par 2 and 3 where the Shulchan Aruch of the Bais Yosef, the Ramo, the Gro, the Bais Shmuel and the Chelkak Mechokake all say that coercing a GET when a lady says MOUS OLEI is wrong, we would surely accept such a pesak. Unless of course the fake husband of the FBI sting in Trenton disagreed.
