Rivky Stein & Yoel Weiss: Yoel is "heartbroken" when Rivky's "Beis Din" fails to show and he can not give his beloved wife a Get

Update: Added audio recordings of Yoel asking for verification that the 3 original judges that he requested are there - and being given a runaround.

 Today the drama that we have been looking forward to for weeks played out. It is 20 days since Yoel offered to give Rivky her get that she has been screaming to the world that she desperately wants and ran around to all the secular scandal sheets and created an incredible chilul haShem. The get that she has collected thousands of dollars from fellow Jews claiming she was raped, kidnapped, enslaved by her hsuband. A get she demanded in conjunction with a $480, 000,000 RICO claim against her husband.

Yoel all along has remained calm, denying all her claims and suffering the abuse from the newspaper article, the Facebook campaign, the television reports and of course the YouTube video that Rivky put out detailing in disgusting detail assertions related to intimate aspects of their marriage, claims that he and his family were criminals and that she has suffered inhuman abuse from him.

On her website, she provided "proof" in the form of her RICO claim. But perhaps most damaging to Yoel's reputation and what convinced most people that her story of horrific abuse was true - were the documents from her Mill Basin Beis Din declaring that they had issued 3 invitations for Yoel to show. The beis din documents claim that upon his failure to appear before them - they poskened that he was obligated to give his wife a get [this by the way is not in accord with accepted halacha] and that he was placed in cherem.

However as painstakingly detailed on this blog - there is no such beis din. Yoel in fact tried multiple times to contact the Mill Basin Beis Din at the telephone numbers listed on the documents. The psak of the beis din - after hearing only one side is as Rav Moshe Feinstein has stated - violates an explicit gemora and the ruling of the Shulchan Aruch.

Finally about 3 weeks ago, Yoel Weiss decided that it was time to tell his wife to put up or shut up. He made a simple but brilliant offer. He had originally wanted to wait for the RICO case to be resolved before giving the Get - which in fact is the accepted procedure according to Rav Moshe Feinstein and others. However convinced that the beis din was fake, he made an offer that Rivky had to accept. He would give Rivky the Get she demanded on the day after Tisha B'av (today) - but only if the Mill Basin Beis Din appeared and was competent to arrange the writing and giving of a Get. If the Beis Din was real he would give her the Get as promised but if it was fake - then she would be exposed to the whole world as a liar.

In fact Rivky showed up with a sofer to write the Get - but without the Beis Din. Yoel called the number of the supposed beis din and someone answered and  said not to worry that the dayanim are stuck in traffic. But he said that one dayan is sitting shiva and can't make it. When Yoel asked for the address of the dayan so he could be menachem avel - the person he was talking with suddenly ended the call.

All of this is recorded for those who want solid evidence. But as Abraham Lincoln said, You can fool some of the people all of the time and all of the people some of the time - but you can not fool all of the people all of the time.


SHAME ON YOU RIVKY FOR CREATING SUCH A DISGUSTING CHILUL HASHEM!

Hopefully the newspapers and other reporters who reported Rivky's charges against Yoel with such relish as proof of the "disgusting" behavior of Orthodox Jews - will hopefully now have the decency and professional ethics to report this development - which clearly raises questions regarding the rest of Rivky's story..

Yoel had clearly stated that the absolute condition for giving the get was to have all three rabbis who signed on the cherem and seruv showed up  and were competent to arrange a get. The above recordings demonstrates that he called to determine that the 3 dayanim specified had come and was informed that they hadn't but that there were 3 rabbis. The condition therefore was not met.

It would be helpful to publish the recordings made today demonstrating that the original three so-called dayanim did not show up to put to lie Rivky Stein's claims today that the three did come to the address.

  3. I have a few questions for Yoel...

    How does he explain the pictures that were posted on Rifky's Facebook page this morning showing people waiting for him? The pictures appear to be of both addresses in question.

    Assuming that Yoel is correct al pi halacha, why would he want to be married, and be required to support, a woman who would make up a fake beis din and slander him and the Jewish people?

    Does Yoel think that continuing this, and perhaps proving himself right, is less of a Chillul Hashem than what has already taken place in the media?

    Where was all of the food and refreshments that Yoel promised a few weeks ago? Does Yoel think its a Chidush Hashem to tell a lie?

    Does Yoel ever think that perhaps, he is lending credibility and sympathy to those who want to controvert halacha by permitting divorce on demand?

  4. Yes - please provide the recording and the PROOF that the recording was not someone Yoel placed at the other end of the phone call. Also provide the proof that Yoel himself showed up like he said he would so he could in person verify that her BD was there. That seems to most logical and reasonable people a very safe way to assure if they were or were not there. Anything else lacks sufficient proof of anything. All that being said, this marriage is over and Yoel is a Get Refuser.

A different Dayan from the same Beit Din was there in his place."

Not once have I seen where it said the three original Rabbis were there, just that a beis din was awaiting. She has pictures showing from both addresses, but not the correct Rabbis....

  14. According to Jewish law and customs, the Get is the last instrument executed in the halachic divorce process. It hasn't reached that stage. And he would be nuts to give it earlier than regular halachic protocol considering all the damages his wife has caused him with false arrests and false public charges.

    1) How does he explain the pictures of both addresses that Rifky posted on her Facebook page today?

    2) Yoeli invited a large group of people on his DT post a few weeks ago. Surely someone took pictures of Yoeli waiting - with the crowd and with the food and refreshments that he promised. Could someone post them?

    3) If a wife slandered her husband in public and concocted a fake beis din to summon him, why would a man want to stay married to her - especially since halacha requires him to continue to support her?

    4) Where does Yoeli see this ending? Does he see himself back together with Rifky in a few years? If not, why wouldn't he want to close things out?

    5) Yoeli says that the media attention is a Chillul Hashem. Does he think that continuing the saga and, perhaps, proving himself "right" will lessen or increase the Chillul Hashem?

    6) Does Yoeli ever consider that not bringing this to an end likely increases support for the anti-halacha groups that advocate "get on demand"?

    7) If the Beis DIn is fake, why didn't Yoeli come with his own?

He'd be nuts to give her a Get before this abuse of him by her is not first stopped. A Get is the last instrument executed in a divorce process under standard halachic protocol.

What we know as a fact as he promised to show up and if it is the same beis din that issued his seiruv, he will give a get. Rivky posted pictures of herself showing up, he did not. At this point I have taking the side of Rivky, simply because the one fact which is known, is that he promised to show up, and he didn't. If he thinks these are other judges, let him show up and prove it, the fact that he did not, shows in my eyes that he lied and took this whole blog for a nice long ride. and it seems the blog owner was also fooled. He still as the gadget up saying Rivky did not respond to Yoel's offer for a get. Well, the truth is staring in his face, that she came and he didn't come.

  38. Moe - this was a PUBLIC affair that YOEL called to be public. That means, the onus was on him to show up and verifythe person who was there. The fact that Rivky knew it was so public and the fact that other people did show up makes me believe that she would in no way lie about who was there on her page, as that could very quickly be disputed. So it's time to realize who the real liar is here. Yoel did not show up as he stated he would and now he is digging a bigger hole to cover his lies.

    A get is not a means for personal leverage.


    It is not a bargaining chip.


    It is not a method of extracting custody or deferring lawsuits.


    It should be given when requested.


    This would have never happened if he just gave it the first time he was asked.

Yeold called the beis din and asked to be informed when the requested judges showed up. In fact they apparently did not. This doesn't make Yoel a liar. All the beis din had to do was reply that the judges were there and he would have shown up

  68. Yoels request makes no sense. If 3 dayanim excommunicated him, even if he needs those exact 3 to release him from excommunication,he would not have been released unless he gave the Get. He needs 3 to validate the Get .. then the original 3 can release him from excommunication. We all know that shiva is seven days. We all know that Yoel was the one who invited Rivky to show up. We all know he did so way more than 7 days ago. There is no way that one of the Rabbanim could prevent his shiva in Israel beforehand. So two showed up .. publicly and a third Rabbi to replace Taub. If Yoel would have shown up like he said he would, he could have very quickly and very easily verified these were the rabbanim there. Yoel is a coward and a bully.

He then said he would verify these are the 3 rabbanim and if they are he will give a get. Aside from the fact that making such conditions for a Get is already sick and twisted. HE DID NOT SHOW UP to verify on his own if the three were there and if they were the right three. He is a LIAR BECAUSE he said he would show up period. Giving the Get would have been a separate matter.

I just remember a post a few weeks ago on this blog where he stated that he was coming to a certain address at a certain time and would give a get if 3 specific people were there. (Note the order of his statements and what was conditional on what, as I remember them.) For some reason, I cannot find his post now.

    My rebbes in yeshiva taught me that breaking my word is extremely seriously. Are you suggesting that it is OK to make promises and then not keep them?

    1) that he would be present at the date, time, place, he decided

    2) that he would give a get if Mrs. stein and the Beith Din was also there.

    3) that he would serve refreshments

    I suspect that he felt sure neither Mrs. Stein, nor the Beith Din would be present. Once he heard they would be present, his bluff was called.

    Therefore, he badly damaged his credibility by reneging on his promise.

    In this context, he twice showed his disrespect for rabbinical institutions. Once when he summoned the beith din, whereas the normal procedure is for the beith din to summon the parties... But batey din are so ready to dance around a recalcitrant husband, that they obliged and even sent him a convocation for the time and place he requested. The second time, Mr. Weiss showed his contempt for the beith din by not showing up.

    I am quite surprised that the blog author still keeps the counter since the fake get offer up.

    I am also surprised that the promise that the blog author himself made public and to some extent vouched for was broken, and it makes no dent in the steadfast support of the blog author for Mr. Weiss.

Yoeli had said that he would give the get if those three dayanim came. It appears that some are claiming that as far as we know, none of the dayanim were there, and she brought a few random Rabbis in their place. Others seem to be saying that two out of the three were there, and the third is sitting shiva in Eretz Yisrael. If the first is the truth, it is very understandable why Yoeli did not give the get. If it is the second, then I think all would agree that refusing to carry out his promise to give a get would be engaging in gross literalism as to the fulfillment of his condition. Please answer: 1: Were there in fact two out of three dayanim there, with the third being replaced, as he is sitting shiva? 2: If this was the case, do you think he would still be justified in not giving the get?

    Any normal person who was desparate for a get would have responded imediately to the offer of get. /Arrange proof of identity for the dayanim as well as their competence. Please show me the pictures of the original dayanim with Rifky and clear proof that validates their identity!

  154. It is important to point out that Yoel publicly gave Rivky the right to choose any date she wanted to receive the Get with her beit din. Rivky never responded to this offer or contacted him altogether. Instead, she is now admitting the three original "dayanim" were not available yesterday and, yet, instead of choosing another date as Yoel offered her, she instead tried to bamboozle Yoel into coming to a newfangled beit din that was not the original three -- even though she knew very very clearly long in advance of yesterday that the Get was strictly conditioned on it being the exact original three.


    Since she admits she knew in advance that was unavailable yesterday she should have rescheduled with Yoel as he offered right from the get-go. Instead she tried to pull a fast one on him.


    As far as the well-known sofer attending yesterday, anyone can hire a sofer as long as they pay him and he will come to write whatever document a sofer can write. His coming does not in any way, shape of form mean that he supports anyone or any thing or movement or cause. It only means he was hired to do a job so he came to do what he was paid for. He doesn't need to know all the background details or even if there is any background details. And there is nothing wrong with that. Obviously the non-Orthodox, non-frum woman, Shira Dicker hired a well-known sofer in order to give the false impression that he somehow supports this cause of hers.

    4) I believe no-one should mock a woman who says she was raped and deprived of liberty by her husband, unless proof of the contrary has been brought. As long as it is he says-she says, the potential/alleged victim should be treated with respect.


    5) I do not believe that Mr. Yoel Weiss is an upright person, as proven by himself when stating in court that he cheated on his income when he took out an insurance policy.


    6) The fact that he did not show up - contrary to his public promise - confirms this impression.


    7) Mr. Weiss' reaction when he heard that Rabbi Taub was sitting shiva (as displayed in the audio on this blog) also proved that he lacked one basic caracter trait every jew should have: rachamim.


    8) I believe that two dayanim of the original beith din were present - as stated by Mrs. Stein. I believe that the third dayan was sitting shiva. Those a circumstances I would classify as "force majeure". Therefore, Mr. Weiss should have gone to the location, as he promised, verified the identities of the two first dayanim and than found a constructive solution (either give the get right away or reschedule when the shiva is over).


    9) No-one forced Mr. Weiss to take this initiative, but overall, it damaged his reputation.


    10) Please stop making the false claim that Rivky did not respond for 21 days. She did respond, she was present at the meeting date, time and location Yoel Weiss set (a person was waiting at the 77 location, just in case, but Mr. Weiss did NOT show up there either).

    If you look at the oveall pciture- at her outrageous claims which have no evidence to suport them. The fake beis din that she used.     Because she cut them completely out of context to make it appear that he is intending to say something that he never intended to say. If you heard the conversation a few minutes before and a few minutes after the recordings, you would realize he was saying something else completely.

  175. I'm ignorant when it comes to Jewish divorce law. Did Yoeli need to have the three original judges there to lift the excommunication order or could there have been substitutes? Also, could substitutes judges have overseen the get procedure? For sure, she didn't meet his demands, which is very suspicious. If one of the judges couldn't make it, she could have easily rescheduled. It seems like her advisors have a personal vendetta against Orthodox Jewry. It's so disgusting!

    1) I do noy believe her claims of spousal rape, and he never admitted any such thing. Considering she has been proven in court to have lied many previous times, including when falsely getting him arrested and filing false protection orders against him, her word is as good as Pinocchio's.

    9) No-one forced Mr. Weiss to take this initiative, yet he did out of his own volition and, still, Rivky blew it.

    10) Rivky did not respond for 21 days. She did not resschedule yesterday even though she knew the dayan was supposedly unavailable yesterday.

If the Beis Din is indeed fictitious maybe a group of well known Rabbanim should sign a kol koreh stating as such? She should produce evidence that the third Rav was sitting shiva. There is a woman Miriam Orbach on the facebook page the claims Yoel told her via facebook message at 10:30AM that he would be there at 12 noon. Why did he lie to her?

It is my understanding that she has smeared his name by spreading claims made by this particular bais din and his point was to prove that there never was such a bais din (and clear his name from their accusations).

    If he went ahead and signed anyway, he never would have been able to prove that point. The past smear would have stood valid and she would have her get. Unfortunately, his no-show seems to be distracting everyone from the point he was making. That there never was such a bais din and that he never ignored their original call nor was he a candidate for cherem.

To pretend that Yoel is somehow justified in withholding Rivky's get simply because of one the 3 Rabbis did not show is not the thought process that comes from a rational mind.   190. When there is a dispute between two parties, one party cannot impose their own chosen beis din upon the other party unwillingly. Both parties must agree to the composition of the beis din. Since the husband never agreed to any beis din yesterday other than the three originals, she could not impose a new dayan without his consent, which he did not provide. He offered to appear before the precise original composition of the same three. Since they didn't all appear yesterday, she couldn't impose her own new composition with a new dayan. She would have had to obtain his consent for whatever new composition was desired. That didn't happen and thus he was under no mandate to accept the new dayan who showed up yesterday. She should reschedule it with him using the same exact original signers.
