dr sprerberv applies heter of kaminetsy-greenblatt
arutz7
In a groundbreaking development for divorce rights in Israel, Tzviya Gorodetsky, who has sought a divorce from her husband for 23 years, has been freed from her marriage by a private, ad hoc Orthodox rabbinical court headed by respected Orthodox rabbi and talmudist Rabbi Daniel Sperber.
The ruling could pave the way for more such women to avail themselves of private rabbinical courts, if they believe that they have no chance of ever escaping their failed marriages. It follows other attempts to bypass established religious institutions in such realms as conversion, kashrut and marriage.
Why do you claim it is the heter of K-G?
ReplyDelete"The rabbis also argued that the husband has a personality disorder which
existed prior to the marriage but was not disclosed to her, rendering
the marriage “a mistaken agreement” that was never valid in the first
place."
The man would beat her and spill acid on her - that means he was nuts, and even according to Rav Moshe the marriage could be annulled.
I have another question -
why is Rav Moshe's psak valid? If the reason is that he was at the time the leading Poseq hador, then what happens if, hypothetically, we have a situation where K-G are the leading poskim, eg in America today or in 5 years time?
“Kaminetsky-Greenblatt heter gains - groundbreaking ruling in rabbinical court frees 23-year chained woman”
ReplyDelete“A man takes a wife and possesses her. She fails to please him because he finds something obnoxious about her, and he writes her a bill of divorcement, hands it to her, and sends her away from his house; she leaves his household and becomes the wife of another man” (Deuteronomy 24:1-2).
I read the jpost article. She wanted the divorce not to marry another man, but to escape her abuser. Courts and police and the public are sympathetic to women claiming violent physical abuse, bending over backwards. Today, Israel and America, the woman has the upper hand, forever, without the need to bring proofs: feminism. The burden of proof falls on the husband---to prove a negative, that he was not bad. Good luck.
In the song Hit the Road Jack, the woman tells the man to go away and never come back. The man says she’s the meanest old woman… I give the meanest woman booby prize to the wicked Delilah what she did to Samson: “After that, he fell in love with a woman in the Wadi Sorek, named Delilah. The lords of the Philistines went up to her and said, Coax him and find out what makes him so strong, and how we can overpower him, tie him up, and make him helpless; and we’ll each give you eleven hundred shekels of silver. … Finally, after she had nagged him and pressed him constantly, he was wearied to death and he confided everything to her. He said to her, No razor has ever touched my head, for I have been a nazirite to God since I was in my mother’s womb. If my hair were cut, my strength would leave me and I should become as weak as an ordinary man. (Judges 16:4-5, 16-17).
This sounds like Rackman/Krause style.
ReplyDeleterav mos he required proof condition existed prior to marriage but was concealed from his wife it is not clear this was true in either case
ReplyDeletetamar never claimed he was mentally ill see words of bbd
I am not arguing for the Tamar case, this is a different case entirely. Tamar never claimed she had acid attacks either.
ReplyDeleteWords of notebook.
ReplyDeleteNot BBD (maybe them too)
