Rivky Stein and Yoel Weiss Divorce: An invitation to both sides to present the facts

updated 6/29/2014 Up until now I have not made a post regarding the Stein Weiss divorce case. Having spent a week trying to get a clarity of what is going on - I have still not gotten a clear picture. There clearly is a major media blitz by Rivky Stein and her advisors (I was told that Shira Dicker of Dodelson's pr battle is a major factor). I have seen the documents and heard the charges - but on a halachic level and as an outsider - I still am not sure what the issues are.

Since neither side has responded to my invitation I will simply post their statements that they have made on the Internet.

An Orthodox Jewish woman who has been unsuccessful in her attempts to secure a religious divorce from her husband has brought her case to social media, hoping to convince him to finally grant her a “get.”

With the help of family and friends, Rivky Stein, 24, created a Facebook page detailing her purportedly nightmarish relationship with hubby Yoel Weiss, 31, whom she married in a religious ceremony shortly after she turned 18 years old, in 2008.

“I want my get very badly,” she told the News. “But this is not just about me. It’s about fixing the problem so it doesn’t happen to anyone else.”

They had two children together, but Stein left Weiss after a series of alleged abuses, which she says included raping her and punching her in the stomach while she was pregnant. She says she never sought to have him criminally charged, but is now speaking to the Brooklyn District Attorney’s office.

My name is Yoeli Weiss. Unfortunately, I'm involved with a messy divorce and custody battle widely publicized by my wife Rivky Stein. On the advice of an adam gadol I stayed silent for the past two years, not responding to the many false ugly accusations she concocted against me and my family. Recently however, she caused an outrageous chillul Hashem. She launched a website exposing herself-- posting seductive pictures of herself, sharing false stories, with delusional graphical bedroom scenarios, inciting men and women in our frum community to be busy debating it. I was told, that her website was negatively circulating among the hottest topics in the mikva, beis hemedrish, at home, at work, and of course on the social media network. The website is nothing but a fabricated story caused by her desperate need for attention. Not satisfied with the massive feedback and the amount of money she raised through her website, she moved her chillel Hashem to the next level, when she shared her false website story together with some family photographs to the Daily News. I spoke to this adam gadol again yesterday, he voiced his great concern for klal yisroel. He is currently engaging other rabonem making them aware of this new chillul Hashem through social media, a dangerous tactic invented by Rivky Stein. This is a ''kosher porno website'' camouflaged under a ''free aguna site''. This adam gadol urged me to respond and obey the positive commandment of the torah ''V'huyesem Nemeyiem M'shem V'myisroel Amo''. Accordingly I am writing this letter.

Minus some minor discords that occur among most newlyweds, after being happily married for 4 years, out of the blue in the spring of 2012, being under the spell of some demon[s], she suddenly decided to destroy her family and did not return home. Without ever mentioning before a single word about demanding a divorce, she initiated an aggressive and hostile (secular) court proceedings against me and my entire (extended) family, which included obtaining an order of protection against me totally under false pretences. Thereafter, over the next few months she caused me to be arrested 5 times, again with false accusations, and each time after spending the night in jail, her allegations were dismissed by the court as meritless. Eventually, the court realized her viciousness, terminated all orders of protection. In her litigation, she concocted the most ludicrous horrifying illogical accusations, all with the hope of a single goal to secure full custody of our two children, while at the same time seeking a money judgment reward of nothing less than 480 million dollars. I hired an attorney who is representing me in this messy litigation process, and the courts are slowly chipping away from her story and realizing the truth. As well, members of my family have had to hire an attorney, at the cost of tens of thousands of dollars.

Notwithstanding her accusations, the pain and shame she brought onto me and my entire innocent family, neither ,I nor anyone in my family ever retaliated in any way shape or form against her, not even by saying one bad word against her. After all, she is the mother of my two children. While I have enough unpleasant information about her and her family, and specifically about the two acquaintances, responsible for wrecking my home, I decline sharing this or any other lashan harahs with the public, simply because this is not the derech haTorah, and then again she is the mother of my children and I wish to spare my children this pain. Sooner or later, my children will be able to understand it all, and it’s my hope and desire that when they grow up, they'll realize that their father sacrificed his own pride by not divulging and exposing their mother, all in order to secure their well being. Rivky, on the other hand, seems not to care about the children at all. Her stability has been on a seesaw, and is, unfortunately, on a constant decline. The judge presiding two years on the marital case finally got the gist of what's really going on, recently ordered a complete psychiatric evaluation on her. Her impulsive and outrageous behavior with her website and the media speaks for itself.

As a father of two adorable children, I'm sincerely concerned that she can Chas vesholem end up harming them either physically or emotionally or both. That's why I am now fighting for full custody before it’s, chas vesholem, too late. Once the custody issue is resolved, she will receive her get with pleasure, and she can go l’chaim ve-l’sholem wherever her heart desires. Rivky does have issues: she is desperately seeking attention. And yes, she is a great actress, very convincing, believes in her own lines and her own illusions, therefore she comes across sincere and honest. I perfectly understand how some of the public is being swipalloeded away by her website, becoming quickly judgmental without giving me the slightest benefit of the doubt that perhaps there is something wrong with her story. Wouldn't you ask yourself, if her story would remotely hold the truth, why would the judge dismiss her allegations along with the orders of protection, and award me equal custody rights? I am certain you all recall the name Susan Smith. She too put up an act that the public was so convinced, but not the professionals. She too cried in front of the cameras attempting to convince the world that a black man killed her children. However, despite all her acting talents, the truth in the end always prevails, however it was too late -- she already killed her two children.

Rivky's website and u tube comes across sincere and honest. I know it’s hard not to believe her. Were I be an outsider not knowing her, I would probably believe her too. After all, she has fooled me and my entire family for more than 4 years. The highlight of her acting talents was played out during the last few weeks when we lived together. Over that period she secretly made plans and arrangements for an order of protection and to move in with her foster parents, while at the same time being an actress, she played and showed a most peaceful beautiful atmosphere at our home, and a most wonderful romantic relationship between us. So, I am asking the innocent public who is clinging to her website, to please give me the benefit of the doubt. Check carefully with her friends and the court rebuttals. Please don't get caught up in accepting and believing and repeating this lashan harah. I am certain many of her 5 thousand followers (as she claims on her website she has) are voicing their opinions believing its purely l'shem shumayem. I beg you to be careful and patient till the outcome of the court proceeding-- the very proceedings she initiated, before you condemn and slander an innocent person. Ultimately the truth may leave you feeling guilty for jumping to conclusions prematurely.

What is the purpose of the PR campaign by Rivky Stein-Weiss?

One possibility may be that Yoel could just throw the towel in and obtain a "heter meah rabbonim" and just leave Rivky to rot on the vine so she is getting in a pre-emptive strike to tie his hands. But there is more, from the RICO complaint it is clear that like the Count of Monte Cristo who was wrongfully exiled to the chateau, she is out for one thing "revenge" at all costs and that is both a high-stakes gamble and a very dangerous thing because it could backfire in unexpected ways. "Hell hath no fury like a woman scorned" they say.

Another possibility may be that Rivky is both short of cash and is hungry for PR. Somehow or other she may have been connected with the Dodelsons or some others with cash to burn on behalf of Agunos and the Dodelsons or ORA-backers who give money for Agunas that are PERHAPS giving her cash and funding this PR campaign.

Every cause needs its martyrs and living examples and right now Rivky is the perfect "poster child" for the cause of "poor little agunos" fighting the "horrible ogre" mean husbands who do not want to give them a get.

So Rivky is perhaps being used by the Dodelsons or some other very rich supporters who help her connect with the Shira Dicker-type publicists and pay for web sites, web hosting and all the PR trimmings by getting her story in the papers and onto online social networking sites and beyond.

What it boils down to is an implied statement by the women fighting for a get, that they have just traded in one set of "fixers" for another.

Now that they do not have recourse to heavy-handed physical tactics they instead are now using PUBLICISTS and the media and the Internet to the same ends, to fight back (as they see it) and "beat up" on the "recalcitrant" husbands.

Now as if to say "you may have stopped us in one way by blocking our access to the rabbis who used to beat you up and force you to sign, now instead we will use the PUBLICISTS and media and the Internet to shmeer you so badly you will wish you weren't born" it's a do or die battle to the death as it were.

After all if some women and their backers could afford to pay $50,000 to have their exes beaten up they can also easily find a willing PR hack who can do the same damage verbally to the reputations, careers, names and families of the get-refusers, because as they say "all's fair in love and war"!

No doubt here may be other reasons but for now this is some food for thought.

How are the battle-lines shaping up at this early stage?

Men: sympathize with the guy (Yoel) she is a liar and manipulative and craves attention. She's from a troubled background what can you expect from a crazy mixed up kid?

Women: what other options did Rivky have? she couldn't threaten to have him beaten up, Yoel's family threatened her, Yoel refused to give a get, he could get a heter meah rabbonim and leave her to rot, and Yoel was abusive to her and the kids and a just a nightmare.

So, people are just basically mindlessly lining up, in a male versus female thing. Women support Rivky while men have a kneejerk response for supporting Yoel.

Take your pick.

Whose is really to blame?

The real parties to blame were the cynical shadchanim who set them up: a guy who left his very chasidish family to be more "modern" (meaning dress and act outwardly "yeshivish" but inwardly he's confused) and matched him up with a beguilingly good looking yet equally troubled teen of 18 (Rivky) looking for a good life who was vulnerable and had been in foster care most of her life.

The problem is that there are currently many off the derech (OTD) or near off the derech kids being married off as a "cures" for their problems which actually only makes it worse because what happens is they then have a kid or two, revert back to their patterns of abusive behavior or manipulation, or passive aggression or what have you and then there is an explosion.

Normal people from normal families don't get it, they project their normal assumptions onto a scenario that is just crazy from the start.

There is no solution really, sad as it may be it's the truth, this is a "war of the sexes" and part of the ongoing "sexual revolution" that has not been tamed and has infiltrated even the best Jewish homes all over, added to the massive breakdown of society it's a high speed downward spiral that will just go on and get much worse until Mashiach comes.

Even in the Talmud there are situations of "teiku" where the great sages have no answers and leave it up to Eliyahu to come up with future solutions, and today there are tragically plenty of "teikus" that only Eliyahu Hanovi could solve for us.

  2. Did anyone ever hear of that Mill Basin "Beit Din" that the wife is using? It seems to be a for-hire rogue ad hoc "beit din" that does what it is paid for. They issued a so-called psak that the husband is halakhicly mandated by the beit din to give her a Get even thought they admit he never appeared (or accepted jurisdiction) of their so-called beit din. If he didn't accept them and never appeared in front of them, it is halachicly prohibited and impossible for them to order him to giver a Get or issue a ruling stating he is required to give one.

  4. This is a custody dispute. The Get is the last instrument issued in a divorce proceeding after the entire process has been (halachicly) resolved. This case is still open-ended and thus she can't expect a Get before all outstanding divorce issues and proceedings are resolved. (Especially if there's any issue of her violating his halachic rights insofar as custody is concerned.)

    are surreal and seem science-fiction like. Her claims against him of
    what he allegedly did to her are both unsubstantiated, were never
    reported to the police for over two years since they allegedly happened
    and only know when this dispute went public did she suddenly make them,
    and they do not have the ring of truth.

  7. As always you must follow the money. Are her multiple lawsuits being funded by caring friends or ORA? once you know that, the rest of the pieces will fall into place. There are known askonim in Boro Park that pay rent for any woman getting divorced regardless of circumstances. Finally, as always, a great rachmonis on the children.

A 23 yr old woman with 2 kids does not suddenly decide to take it to the media that her husband beat the shit out of her, raped, and enslaved her. You don't see her asking anywhere for 10 million dollars for all the pain and suffering like you would in any other similar case.

  11. Please tell me where in Shulchan Aruch it says the beis din is required to beat him up until he agrees? which beis din has heard both sides and produced the conclusion that you have pulled out of thin air? Where have the secular courts ruled that the facts are as she claimed?

  12. It's in a gemara...don't remember which one. You give him lashes until he agrees. The Rabbeim were arguing in there if this was a problem with him voluntarily giving the get. In the end they ruled that it was ok.

Actually, it looks very suspicious when she just thought of it at the time she began her PR campaign! The fact that she filed six criminal complaints against her husband during this custody battle, and they were all dismissed, reveals her as a vicious drama-queen liar.

  16. Are you for real? A woman wants a divorce. She claims he beat her, that he molested the kids and that he snores. He categorically denies it. There is no evidence.

    You as a judge would automatically believe her?

    What if he claimed she was a prostitute, stole his money, and spits at his mother. But she denies it. Do we automatically believe him simply because he is making a claim?

    In the literature this is referred to as he says/ she says.

    there has to be some supportive evidence to believe one side over the other.

    Or put another way. I say that there is a pink elephant standing behind you that only I can see. Would you believe me? why not?

    First, make up your mind: Are we sick, or are you sick?


    Secondly, why does she want a get prior to the conclusion of her custody battle??? Does any healthy, responsible and sane parent begin dating prior to having completed custody arraignments and battles?


    There are plenty of people who have already stepped up to talk about his abuse. There is plenty of evidence.


    Who, what, when and where? I am waiting sources in a calm and intelligent way.


    How does any woman prove that she was raped years after she finally gets free of her insane husband?

  20. @reparim you have me at a disadvantage since you think you can make up halacha as you go along while I am stuck with the Shulchan Aruch and commentaries.

    The fact that she wants a get - does not automatically mean that he is required to give a get. Please see the many articles I posted about ma'os alei. If the beis din paskens that he must give her a get then it is true that he must give her a get. But no beis din has heard both sides so there is no halachic obligation for him to give a get at this time.

    The fact that a lot of people have stepped up - doesn't mean that the evidence has any validity. It might all come from her claims that have repeated by many people. a beis din needs to listen and rule on the evidence. Apparently some of her claims have been thrown out be the secular court. Do you still insist that they are all valid?!

    Please read a little about divorce. Lawyers adivse women to claim the husband sexually abused the kids. There was a case in Lakewood a few years ago in which the wife confessed - ten years after getting her divorce by destroying her husbands reputation with such lies - that she had lied at the suggestion of her lawyer. There are many such cases.

    So while you are correct that rape is difficult to prove - but that doesn't mean that therefore we should believe every claim of rape. What system of justice do you subscribe to that accepts such a rule?

It's a sorry state of affairs that if a woman does not have concrete proof that the abusive ex husband can get custody of the kids etc. My father put black and blue marks on my mother and countless other acts of violences.. not to mention violence on me and my siblings.. and in this crazy court system even eye witness can be discredited and then goes countless years of pain.. !! my father poisoned my siblings against my mother and claimed SHE was the abusive one.

    In a divorce ruling, it is enough to prove that marriage has become untenable. Or to wait out the separation period. That's not like criminal court where guilt has to be proven beyond reasonable doubt.

  25. I have learned plenty about divorce in my years. You are also very mistaken that there is no proof if his insansity. There are recordings of his voice saying some pretty inane things. Don't know how much more proof you need. And if you think that those recordings are fake, I have actually called him up and can verify that the voice is the same as in the recordings. During our conversation I could tell something was really wrong with this guy...Sure that isn't proof but you don't need to wait for a sociopath to kill someone to be sure he is out of his mind.


    There is a reason the torah instructed the judges to be clever. There are plenty of cases in sanhedrin where there was not 2 witnesses and the judges had to be clever to find the truth.


    Regardless of the bad apple in lakewood, you cannot presume to say that every woman is therefore a liar unless she can provide evidence. She wants a get - you're telling me he's doing the right thing by not giving it to her? Not sure what religion you practice but I don't ever recall the torah every promoting agunot.


    If she cannot prove anything then fine don't give her any money or whatever "extortion" you may think she is attempting. Hashem will pay her whatever she deserves in the end regardless. But to say that he does not need to giver her a get when she requested it is absurd.

    There has been new videos posted onto youtube and its clear that Yoel did not kidnap or deprive Rivky from food or anything. Rivky is actually videoed herself having a good time in Canada. not by the force of her husband..

    Well in the video about Canada with the children she looks like a quite desperate woman who tries to make the best of a situation that does not really seem nice. She seems to spend a lot of time alone at home with the children, no toys are visible...

    Are you a psychiatrist? On what basis have you decided that there is something really wrong with this guy? You sound like a lynch mob - that just knows hanging is the solution.. Same logic - kill the guy to make sure he doesn't hurt someone- even though you have no real proof of guilt.

    You are the one who sounds like a danger to society.

    A beis din has not yet heard both sides - why are you being "clever" and deciding who is guilty? Halacha is clear that you can not judge without hearing both sides.

    Unfortunately you dont' understand halacha - but simply insist that whatever you think is right must be the halacha. There is no concept in Jewish law of get on demand. Nor was there in secular society until about 20 years ago. An aguna is not someone who has demanded a get because she thinks she can do better and the husband says no.

    Bottom line: Please become better educated about divorce halacha so you won't be so mistaken about the fundamentals.

  33. honestly you are living in a fantasy world. No I am not claiming that domestic violence doesn't exist. But are you saying that false charges don't happen? That is why there is a court system - to evaluate the charges. But there needs to be some evidence to decide.

    You might read of the cases where people are sent to jail or executed because someone made false claims. You need a system to evalatuate EVIDENCE

    Honestly I think that this is a case about which is best to keep quiet until all the facts are out.


    A Federal criminal complaint(if there is one) is no joke. Someone is going to go to jail at the end of it, either him or her. It is way to easy to make a major Chilul Hashem on this by simply thinking you can find all of the facts somewhere online.


    If she can bring evidence in Federal Court to back up her statements... well then... I will decide then.

  36. I am not living in a fantasy world. I have been living this abuse chaos for almost my whole life! Of course false charges happen.. not saying not.. but what you are espousing is that because there is no clear cut evidence then you can't say it happened.. what kind of evidence should there be to prove that in fact it was the husband that hit his wife before relations? or that he forced himself on her? how do you prove that he twisted her arm? or choked her? how do you prove these things if they happened in the four walls of their home'??

    Well, I think the testimony from the mediator is pretty good evidence. You might want to call the Rabbi cited in this report and ask him to confirm the claims made about him (that he knows Yoel Weiss from age 15 and that he saw a highly pregnant Rivky Weiss sweating at the Pizza oven, and that Yoel Weiss refused to assign her to a different place of work.)

    Rabbeinu Tam argued that a community can use social pressure and ostracization against a recalcitrant husband to pressure him into giving a get.


    Bottom line: if she wants a get - we are obligated to help her get one. Not bicker on whatever else she does or has not done. She wants a get you, and I, and everyone else - is required to help. Is it really so complicated?

  49. A wife is NOT entitled to receive a Get simply because she wants one and asks for it. Unless it is warranted, a husband has no obligation to divorce his wife if he doesn't want to. This is plain black and white halacha. (Similarly, a wife has the right to refuse to accept a Get from her husband if she wants to stay married to him.)

She says how much she loves her kids and makes videos of them ... someone took pictures of her husband and her on horses, which by the way did not show a smile on her husbands face and put it together deliberately within a heart graphic effect .... find me the video where she dotes on the husband.

    But she IS asking for a get, what grounds do you stand on by saying we are not obligated to help her get one?

    How do you also re-conciliate the recordings of him clearly being being cruel? How many recordings does he have of her saying she is happy with him or that she wants to use the children as pawns? Why don't you give the guy a call and ask him some questions. I can give you his number if you'd like.


    It says in the torah if you know someone is going out to kill you - you must ambush and kill them first.


    If neither of them are able to give you conclusive evidence of who is making up stories - how do you proceed with her getting a get? You simply look at the relevant facts, she wants a get and he refuses to give one - nothing else matters unless proven. Make sense or am I missing something here?

If someone files a federal complaint .. such as kidnapping .. across state lines and internationally ... you would think that maybe that person did it because they have evidence. In the court documents it is very detailed and includes car rides across an international border. There exists proof at that border, on the date in question whether that occurred or not and who was in the car. If she was in the car with his brother and one kid and there is proof .. her story is already corroborated. I don't know about you but when I move to another country with my husband and kids, I do not do so with only one of my children in a car with my brother in law. So no worries ... either the proof exists or it does not. Time will tell.

  68. Umm I'll answer that when you look up psychology of abuse victims who
    are abused by people with insecurities who need affirmation all the time
    to feel respected. What I see in the video is a woman who is looking OUTSIDE of her life .. she says over and over again I love you to her baby and her pitch changes at the end to one final "I love You" ... Seems to me she is being protective of her kids. We can go on and on with this .... but nothing you have posted shows a loving relationship with a non abusive husband. Abuse victims are very good at apologizing for their abusers and leaving and coming back and living a cycle of moments where it all seems ok. None of these videos prove she was not abused anymore than they prove she was. The videos don't tell anything related to her accusations. The only things that will corroborate her stories are the documentation of dates and time and witnesses who saw certain things etc .... she may or may not have it. But I am right now inclined to believe that someone who makes a detailed indictment against a man has something to bring to the table. Time will tell.

    GK - u still don't get it. What happens one time has no bearing with what happens another time when it comes to domestic abuse. One day he lets her go to a grocery store and gives her money ...the next day he does not and takes her wallet and phone. One day he may tell her he loves her and he is sorry for all the trouble .. and the next day he might slap her and rape her. That being said ... you dont truly know where they were going together in that video and why and you dont know if she really wanted to go and he threatened if she did not he would take the kids and keep them there. You know nothing .. If a wife insists on forcing him to give a GET she has the burden of proof to demonstrate that halacha entitles her to force him to give her a Get against his wishes. Normally halacha doesn't require a husband to give a GET against his will even if his wife wants one. So if you or she believes she is entitled to a GET, you must prove 1) what halachic basis she is entitled to a GET on and 2) PROOF that those requirements were met. In fact the proof requirements are so strong that Shulchan Aruch specifically says that if she demands a GET on the basis of abuse, then beis din must place a witness in the home to see if he abuses her. That's how strong halacha demands evidence in this case. Secondly, according to halacha there is no such concept of "raping" your own wife.

A year later she confessed (after he gave her the get, got a bad reputation and lost custody) and said her lawyer told her to say all of it.     In a civil case where the court system is over burdened and they have other, and better things to be doing then chasing down every shady divorce lawyer. Yes it does happen and the lawyers get away with it.

    However, this is NOT a civil court. This is a Federal Criminal Court... You don't perjure yourself to a Federal Criminal court and come away clean. Lawyers that have been barred to argue cases in Federal Courts aren't going to risk it.

    Like I said before, this isn't in he same ballpark, it isn't in the same league, and really it isn't even the same sport. It is a whole different level.

    If she has lied in her complaint then she will be a convicted felon. If her lawyer did coach her in lying then his career as a lawyer is over.

But the English term rape originates from the definition of abduction. US Law only recognized involuntary spousal relations starting in the 1970s. English common law does not recognize it as rape.

When someone is unhappy in a marriage, and the marriage is dysfunctional and not a harmonious, happy place for children to be raised, then there is a divorce. When there is a divorce there is a Get. a husband is not allowed to withhold a Get. She doesn't want to be married to him, period. What does it matter about he said she said. The marriage is over. Thus a Get is required. Since he is not giving her a Get, she has to go to whatever way to get the Get. Who cares if a PR firm, or a circus clown is used to try and get the Get. To claim she wants "attention" is absurd, only a Brooklyn person would say a ridiculous statement like that. If she had a Get, all this media would be unnecessary.

  141. I would go further , ELY. The "Psak Din" looks unlike any Psak Din I have seen before. it is not written in rabbinical language, but it Pigeon legalese. It looks like they have taken a secular legal contract template and then added a few Halachic terms, such as HIlchot Shabbes, Taharas Mishpacha etc. There is no reference to any halachic sources. How, exactly does this form a psak halacha? If anyone familiar with a piskei din can enlighten me , i would be most grateful!

    Unhalachic pressure to be given a Get. This will render any future Get to be a Get Me'usa, an invalid Get, and she will remain an eishes ish even if she gets the Get Me'usa. This is the result of applying pressure on the husband to give a Get even though no Beis Din heard both sides and rendered a psak after hearing both parties that a Get is mandatory.

    Mesira. Reporting to non-Jewish authorities allegations against her husband even if true but especially if they are lies. Filing criminal complaints against her husband even though they are seperate and he no longer is doing, and can no longer do, anything she even alleges he had done in the past. Having him arrested five times. (Charges were dismissed and authorities threw out her complaints.)

    Arkayos. Using non-Jewish courts to adjudicate custody and other issues resulting from the separation. Attempting to invoke and utilize non-Jewish law rather than halacha in determining custody, etc

    Loshon hora/Rechilus/Motzi Shem Ra/Sheker/publicizing her dirty laundry in public.

    As someone who is very familiar and promotes staying within the confines of Halacha, provides counselling/therapy as a Psychologist in a Frum environment, can you please write a post that provides a "practical step by step guide" on how a Frum woman who is in a marriage where:

    a) the husband is abusive (physically or even just emotionally) or

    b) she has circumstantial evidence that her husband is having an affair (with another woman or even with a man)

    and wants out of the marriage, but wants to do so only by staying within the confines of Halacha, how she should go about doing so?

    In this guide, can you please address the issues of:

    1) Therapy/Counselling

    2) Going to the Mikvah and having sexual relations with the abusive or cheating husband (possibly putting her life at risk with STDs)

    3) Is she ever allowed to call 911 and have her husband arrested when he is abusive

    4) Obtaining Orders of Protection

    5) How to avoid being defined a Moredes or she doesn't have to care

    6) How and when she can Halachically separate herself from her husband before the Get

    7) Alimony and Child Support

    8) Beth Din

    9) Secular Court System

    10) Husband that refuses to go to Beth Din

    As you are an expert in this area, I am sure you are very familiar with many more issues that need to be addressed beyond the scope of those that are listed here and would appreciate if you would address those as well.

    I also hope you don't say "that every case is different" and therefore there is no way to write such a guide. I am sure there are overall guidelines and steps that every Frum woman who is unfortunately in the above situation, needs to take or avoid and would benefit from having access to this information.

    This is not the halakha. As Rav Eidensohn has said here many times, and brought many teshuvot for, there is a clear heter to report an abuser to the police. If he is engaged in other serious illegal activity there are various Poskim that have also ruled that there is, not only a heter but a mitzvah to report him to the police. The only problem halakhically will be if she lied. To know that we will have to wait the outcome of the Federal investigation.

If you have followed the discussion of other divorce cases such as the Dodelson -Weiss and Friedman Epstein - it is naive to take information provided by one side without verification.     The problem is: let's suppose what she writes is true, the courts confirm it, and he will be condemned for deprivation of liberty, kidnapping, rape, slavery plus fencing and money laundering...

    What will the halacha be? Will he still not be required to give a get?

    In any case, he will not be motivated to give a get, because he will be in jail, and nothing can make his situation worse, so he will not be amenable to any form of pressure.

    So no matter what he does, he cannot be obliged to give a get. And no matter what she does, he can always withhold it.

The Federal court system does not want to become the next fighting ground for frivolous suits, and so recently has not only prosecuted perjury but allowed RICO complaints to be filed in response to fraudulent complaints, charging both the lawyers and the plaintiffs as the co-conspirators.

    The big questions is whether or not this RICO complaint exists, and if it does why is not searchable in any of the databases? A RICO complaint is part of the public record and, according to law, should be searchable. The only thing that would change that is a judge ordered the complaint sealed for some reason. If so why is Rivky posting it up on her webby?

A) There is strong reason to believe her allegations to the authorities are false 1) The authorities did not act on it and 2) She waited years, until she was in a custody dispute with him, to even allege them. B) In any event, she no longer lives with him and he is certainly now no longer engaged in any of the allegations, as even she is forced to admit. So there is certainly no ongoing issue that must be stopped.



    And, as said earlier, the Feds are highly unlikely to even look into the veracity of her RICO complaint. They have bigger fish to fry.

I can understand,even though I disagree with, withholding a get if one believes that the marriage can still be salvaged, but to use it for the purposes of getting a better settlement or to get more custody, an advantage that a woman does not have, then it is immoral behave this way.     If, and I am speaking generally, a woman is violating her husband's halachic rights, whether in custody arrangements or some other marital or post-marital issue, he has no obligation until she halachicly satisfactorily resolves and corrects what she is wronging him with. He does not have to give her her halachic needs while she is violating his halachic rights. He is not obligated to give her a Get until the other divorce related issue(s) are resolved. The Get is the last instrument issued in a divorce process, not the first.

  185. It is important to see if there is a honest complaint, or a whole fake set-up, as ELY is suggesting. If, as RAMATZ has indicated, there is no record of the RICO, then there are several fishy facts here:

    a) No RICO, possibly a fraud
    b) a Dubious BD. Perhaps it is a BD of laymen, or worse, a fictional BD.
    c) A Psak Din which has no halachic content, and obviously not written by a competent Dayan.
    d) The involvement of the media circus, and calls to make life difficult for the whole family of the Husband. Would even the Rambam allow for pressure on the family of a get refuser?

  187. You're wrong, Yeshivish. The courts should not be deciding custody and/or financial issues. That is the realm of Beis Din. Halacha prohibits Jews using non-Jewish courts.

    Once a real legitimate and mutually accepted BEIS DIN issues a judgement (based on Halacha not secular law), THEN all parties are required to follow all parts of it, regarding custody, financial separation and a Get.. And if one part of it is that he must give her a Get, then at that time he must give her a Get.

    She could play his game, agree to his demands, and then turn to the secular courts and say that the settlement is no longer in the best interest of his kids. Or they could end the marriage and just follow the court and or Beit Din in the first place.

  192. I agree that many peoples responses are moral rather than halachic. It's not like yeshivish women learn the laws of gittin in any detail, so how can women react halachically? They are reacting based on the strong belief - true or not - that the differences between men and women in HKBH's law are designed to protect women and not to disempower or oppress them. In my opinion, no frum woman should agree to a secular divorce until she has a get in hand. The few rights she has over her husband come from secular law, not from halacha. It is therefore not very smart to give up those rights before resolving the much more important issue of the get.

  194. Fathers have rights in the secular courts even if their parents are not married. Why is he afraid that he will lose access to his children? It might be that he is a better parent and she is mentally ill and she will lose access to them. Let them sign a legal custody agreement. News flash: she can agree not to use the secular court against him for real or imagined illegal behavior, get her get, and then do it anyway. She cannot lose her rights as a citizen and access to our legal system by signing a piece of paper. I still fail to see what the husband is getting out of this other than revenge.

    2) establish credibility of a Jewish Plaintiff based on a lawsuit filed by that Plaintiff against another Jew in a non-Jewish court,
    3) Require a Jewish defendant to deliver a GET when sued by their spouse in a non-Jewish court.

  198. Then if you support no get being given, then you must be in favor of this turmoil continuing between them. This can go,on for 10 years of "Oy she did this gevalt" and "Oy did you hear he did that" and "Oy did you hear what she did?!" And " Oy she actually did this when she should have done that after she actually really should never have done that!" Or, they can stew in their own juices until a Get is given and they go their separate ways. Anyone who supports him not giving her a Get since the marriage is over, should move them both into their own house.

  199. I'm confused... The Rabbi quoted here states that he was unable to find the RICO case:


    However, my problem is this. In 11 days of searching for a complaint that should be publicly searchable and part of the public record, by law, I have not been able to find it. The website claims that the complaint was filed on Dec 3, 2013. However, after a relatively fruitless search a friend told me to check Justia.com.
