President Donald Trump is making Somali-American congresswoman Ilhan
Omar one of the bogeywomen of his campaign for re-election to the White
House in November - and by proxy her country of birth, Somalia.
In
his most recent attack, at a campaign rally in Tulsa, Oklahoma, he tore
into the 37-year-old alleging that she wanted to bring the "anarchy" of
Somalia to the US.
"She would like to make the government of our
country just like the country from where she came - Somalia. No
government, no safety, no police, no nothing, just anarchy. And now,
she's telling us how to run our country. No, thank-you."
Ms Omar,
who arrived in the US as a child refugee in 1995, is the congressional
representative for Minnesota, which includes the city of Minneapolis
where African-American George Floyd was killed by police in May,
reigniting Black Lives Matter protests.
But it was Ms Omar's Somali heritage the president chose to
focus on in Tulsa, perhaps to distract from all the turmoil and unrest
closer to home.
In response Ms Omar said his remarks were
"racist". She added that his anger came out of a recent poll that had
shown him trailing his rival, Democratic presidential candidate Joe
Biden, in her state, which is home to a large Somali-American community.
Wait, so Somalia wasn't in a state of anarchy for over a decade? it isn't ruled by a corrupt dictator now?

Both. I agree it's wrong to use her background against her but on the other hand, his description of where she comes from is spot on.

The term is "mishtakei" and brought in the gemara regarding sukkah. I'm not applying it to niuf.
ReplyDelete"Mishtagei" is in the gemara. Perhaps my translation is wrong. Since the Gemara cannot be wrong - then there are circumstances under which somebody is cleared from fulfilling an obligation.

Rav Yaakov Kaminetsky (Emes LeYaakov Parshas Yechi page 237): A practical example of zealousness which is not based on a correct reading of the halacha is found in the following question. A person has the choice of marrying a Jewish woman who doesn’t observe the laws of family purity or a non Jewish woman. Which is preferable? A student who has not properly served an apprenticeship with an experienced posek will say that it is obvious that the person should chose to marry the non Jewish woman. That is because sexual relations with a nidah is punished by kares while sexual relations with a non-Jew is only a violation of a negative commandment of the Torah which is not punished by kares. The truth is not this way. Rambam (Hilchos Issurei Bi’ah 12:7-8) states that even though sexual relations with a non-Jewish maidservant is only a rabbinic prohibition he rules that, “this sin even though it is not punished by capital punishment from the court should not be viewed lightly. That is because there is a loss associated with sexual relations with a non Jew which you don’t find in the violation of all the other prohibited sexual relations. That loss is that the son from the other prohibited sexual relations is still his son in every respect and is considered a Jew. That is true even if the child is a mamzer. In contrast the son from a non Jewish woman is not his son…. This sexual relationship with a non-Jewish woman will cause him to turn away from G-d and to attach himself to non-Jews. - from whom G-d has deliberately separated us so that we can be close to G-d... “ It is clear from this that the person should chose the relationship with the Jewish woman even though she doesn’t observe the laws of family purity.
correct but that wasn[t the claim under discussion - you are simply moving the goal posts rather than to admit you are wrong!

Rav Yaakov's case is the reverse of the one I bring.
If - and only if - the woman is adamant on marrying, regardless of mamzerus - then the lesser crime would be intermarriage - since Halacha determines the offspring to be Jewish but without the taint of mamzerus.
If what I said suggested it is OK l'chatchila to intermarry - that is wrong and assur d'oraita - and I 100% retract any claim that could lead to this misunderstanding.

I have accepted that what i wrote about intermarriage is wrong, see comments below. However, you agree with my more careful exposition of the idea - that at least from the child's perspective, the non mamzer is better off than the mamzer.
Also, reb yaakov's case only applies to a man that intermarries. It does not address the question of a woman who intermarries , and whose offspring have no sanction or disadvantage in halacha.
