Arayos: Why prohibit marriage of relatives?

Ramban (Vayikra 18:6): Concerning all near of kin to him, he should not approach them to uncover their nakedness The reason for prohibition of sexual relations with certain relatives is not stated explicitly. The Rambam (Moreh Nevuchim 3:49) says it is to reduce sexual activity and to make it less attractive and that he should be satisfied with little. These types of women which are prohibited by the Torah are those that are more likely to be present and available to him. And this reason the Rambam applies to all of them. The Ibn Ezra writes something similar that since the lust of a man is like that of an animal therefore it is not reasonable to prohibit all women. What is prohibited were those women who are present all the time. However this is a very weak explanation to say that the Torah makes a person liable for kares simply because they are with him on occasion and at the same time permit a man to marry hundreds and thousands of women. Why should it be harmful if he just marries his daughter as is permitted to non-Jews (Sanhedrin 58 :) or two sisters like Yaakov did? In fact there is no more appropriate person to marry than his daughter to an older son and then they will keep the inheritance in the family and will have children in his house in order that the land not be waste and the lust will quieted. The fact is we don’t have a traditional explanation concerning this. However according to logic there must be a deep secret of creation regarding his soul and this is included in the secret of incarnation which has already been alluded to. You should know that sexual intercourse is something which is disgusting and despised in the Torah – except for the purpose of propagating the species. If the relation doesn’t lead to children it is prohibited. Similarly that which doesn’t preserve the species and isn’t successful is also prohibited by the Torah. This is the reason for the Torah views on intercourse with relatives... Thus later on in verse 17 it says that intercourse with relatives is wickedness. In other words it is not properly marriage because it won’t be successful but represents simply evil lustful thoughts. In fact sexual prohibitions are included as statutes which are things which the king decree. And the decrees are things which occur to the king who wise in the conduct of his kingdom and he knows what is needed. And that which is beneficial he commands and he doesn’t reveal to his people except for his wise men and advisors.

Rav S. R. Hirsch (Bereishis 2:24): This verse – according to our Sages – alludes to the halachos of arayos for Bnei Noach (Sanhedrin 57b). The verse says, “Therefore a man should leave his father and mother and cleave to his wife...” This can be understood to mean that a man should distance himself from his father and mother – in other words when chosing his wife he should not seek a wife amongst his closest blood relatives. Perhaps if we examine this verse in the context of what preceded it – as suggested by its opening with “and therefore” - we can have at least a partial clarification of the reasons for the apparently inexplicable laws of arayos. The role of the wife is to be the helper (ezer) to the husband and as a result she must be compatible with him (kenegdo) and that means that she needs to complement him and therefore she must have different characteristics than her husband. In fact if they are too similar that would mean they would not only have the same virtues and but also the same faults. Thus if they got married it would only serve to reinforce the characteristics of both – whether for the good or bad. But marriage would not lead to perfection since they do not complement each other. Thus the possiblity of perfection through being complementary is only if they are not too similar and in fact have distinctly different characteristics. It is only due to having different characteristics that their joining together has the potential to produce perfection. Thus not marrying blood relatives increases the likelihood for finding a complementary mate. However this explanation of arayos only is relevant for the arayos of Bnei Noach which are based entirely on blood relatives. In contrast the arayos for a Jew are also based on kinship through marriage. Such arayos requires a higher level of explanation.

Kli Yakar (Vayikra 18:6): The reason for the prohibition of arayos according to the Rambam is in order to reduce the amount of sexual intercourse. Since these prohibited women are relatives of his and thus they are always with him. The Ramban refutes this view by noting that the Torah in fact allows a person to have thousands of wives. Therefore the Ramban concludes that the reason is a secret. Perhaps that is why the verse concludes “I am G‑d.” In other words G‑d says that He is the only one who knows the reason for this matter while to humans it is a statute.

  1. Re. the explanation from R' Hirsch: The Maharal says something similar as to why homosexual relationships are forbidden: someone of the same gender is too much like us, and marriage is to broaden oneself by connecting with "the other".

    1. Don't know why you think it is Christian. The Rambam says the same thing. In fact Rav Chavel argues that the Igros Kodesh which is traditional attributed to the Ramban can't be the Ramban because the Ramban has negative things to say about sex such as the above quote.

      Bottom line show me the Jewish quotes which show that the above is not characteristically Jewish?

Rambam obviously wasn't writing in a Christian environment and it is absurd to think that the Ramban's hashkofa came from the Christians. So you are acknowledging that at least from the Rambam's time the 12th century - this was the Jewish view. And you are claiming that before that it was different. Would like to know on what basis you are making such a claim. Shir HaShirim is not describing marriage nor was it understood as a model for married life - it is descrbing the relationship to G-d.

    4. what makes you think that i acknowledge any of that? i just asked for earlier sources. why is it so "absurd to think...." regarding the ramban? because of the need to justify shir hashirim's inclusion in ktuvim in spite of it's obviously being a beautiful love poem it became necessary to claim that it was to be understood as describing the love realationship between hashem and am yirael. talk about twisting yourself into a pretzel. how do you explain the ramban vayikra 18:19. isn't it possible that the ramban was wrong? regarding the rambam, aristotle believed that sexual pleasure intfered with thinking.

    5. we are not in the same religion. It is not a issue of whether the Ramban was wrong but rather what he meant. If you are concerned about his being wrong the best you can do is to show that other recognized authorities disagree with him. So far I haven't found any sources which claim that this view of the Ramban is not the Jewish view. (The Igros Kodesh which is attributed to him - seems to have a different understanding.) I don't see any differenc between Ramban and Rambam.

      well as i wrote in a different post, these views are not universal. secondly, even in the paper that you gave from RAL*, RA admits that the ramban and ramban diverge from hazal's view. he works to explain the change, but the change is there.

    7. wow. i'm not in the same religion because i don't see things your way? the fact is that shir hashirim is a beautiful love poem. those that are uncomfortable with that reality must come up with some other explanation for its inclusion in tanach. there is a saying in yiddish...."vee se kristelt zich yidilt zich" i'm not sure that the ramban was immune to being influenced (even indirectly) by christian attitudes. the rambam was certainly influenced by aristotlean attitudes. you still haven't explained the ramban on vayikra 18:19.

      Regarding the Ramban(18:6) - I suggested that he was referring to the fifth intent listed by the Ravad which I cited and discussed in comments further down the page.

    2. This is not going to be simple. For example Shulchan Aruch (E.H. 23:1) says not to marry a young girl because there is an issur of zera l'vatala.

      The language of the Ramban is not a mistake as it is found also in Rabbeinu Bachye. However it does not mean prohibited in the halachic sense because there clearly an obligation for sexual relations independent of having children.


      The Baalei Nefesh provides a better description. He explains there are in fact five different motivations - of which he says 4 are ok


      בעלי הנפש שער הקדושה

      ועתה יש עלינו לדעת ולהבין אי זה היא המחשבה הנכונה באותו המעשה, ואי זו היא המחשבה המקלקלת אותו והמאבדת את שכרו והמביאה עליו רעה תחת טובה. והנה חקרתי ודרשתי במעט שכלי ומצאתי תוכן המעשה הזה על ארבע כוונות לבד, ועל החמישית לא מצאתיו. ומארבע הכוונות מצאתי בהן שלש שהן עיקר קיבול השכר, והרביעית שכרה מועט מן השלש. והרי אני מפרש הדברים על אופניהם.

      הארבע כוונות אשר המעשה ההוא נכון עליהם.

      הראשונה לשם פריה ורביה והיא הנכונה שבכולם שהוא מקיים בה שתי מצות עשה, 7ומצות העונה שהוא בלא יגרע.

      והשנית לתקון הולד כמו שאמרו רבותינו ז"ל (נדה לא א) שלשה חדשים הראשונים קשה לאשה וקשה לולד, אמצעיים קשה לאשה ויפה לולד אחרונים יפה לזה ולזה שמתוך כך נמצא הולד מלובן ומזורז. וגם זו הכוונה נמשכת בכונת פריה ורביה.

    3. OK so the BN already brings in עונה which is not necessarily related to pregnancy. that is one. he also brings in the gemara about sex being good for the child (and for birth, as they say in the birthing classes). he also says that having relations with your wife because she desires it.

      all of these are far from the sentence "If the relation doesn’t lead to children it is prohibited."

      and it is also far from "except for shalom bayit".

In light of the Baalei Nefesh and other sources we can understand the Ramban and Rambam as well as the Baalei Nefesh himself to mean that if the activity of sexual intercourse in human beings did not produce children if would be prohibited. The oblligation to have a wife and therefore to provide her needs as well as to prevent the husband from sinning as the result of his yetzer harah is only because the need for children. In fact sexual lust itself was created solely to ensure children. Sexual activity for the sake of sexual activity - the fifth intent of the BN - is prohibited.

      In sum, the Rambam, Ramban etc apparently mean the fifth category when they say that sexual activity without children is forbidden.

      Because i know husbands who insist that their menopausal wife do have to have sex because he desires it, even if the wife does not want!

    5. regarding sexual activity between a man and his wife, there is a basic, almost unbridgeable argument between the mequbalim and the non-mequbalim . the latter, based on another gemara in nida and some rishonim (notably tosofot) hold that sex with your wife is permitted when you want, however you want. even the occasional "she'lo k'darcha" is allowed.

      the mequbalim will have nothing of the sort regarding this stuff. the less the better. i don't know who the BN is, but he sounds like a mequbal in this regard.

The Igros Kodesh which is attributed to the Ramban has been argued by Rav Chavel as not being the Ramban because it takes a more positive view of sex than is expressed here

      Nedarim (20b) R. Johanan said: The above is the view of R. Johanan b. Dahabai; but our Sages said: The halachah is not as R. Johanan b. Dahabai, but a man may do whatever he pleases with his wife [at intercourse]: A parable; Meat which comes from the abattoir, may be eaten salted, roasted, cooked or seethed; so with fish from the fishmonger.4 Amemar said: Who are the ‘Ministering Angels’? The Rabbis. For should you maintain it literally, why did R. Johanan say that the halachah is not as R. Johanan b. Dahabai, seeing that the angels know more about the formation of the fetus than we? And why are they designated ‘Ministering Angels’? — Because they are as distinguished as they.5 A woman once came before Rabbi and said, ‘Rabbi! I set a table before my husband, but he overturned it.’ Rabbi replied: ‘My daughter! the Torah hath permitted thee to him — what then can I do for thee?’ A woman once came before Rab and complained. ‘Rabbi! I set a table before my husband, but he overturned it.’ Rab replied; Wherein does it differ from a fish?6

      The Baalei Nefesh was written by R. Avraham ben David [Ra'avad], who was famed for his critical comments on Maimonides' Mishneh Torah, was born ca. 1120 in Narbonne, and died in Posquieres in 1198. A renowned scholar, his yeshiva in Posquieres drew students from far and near. His comments on the Mishneh Torah have been printed in almost every edition of this work since 1509. One of his better-known works is Ba'alei HaNefesh, on niddah and ritual immersion, with an additional section called Shaar HaKedusha. On Baalei HaNefesh have written acerbic glosses by R. Zerachya haLevi's Ba'al HaMaor [Razah], that were called Pitchei Niddah (they was part of his volume Sela haMachlokot, that includes in addition a commentary to tractate Kinim). Ba'alei haNefesh has a number of versions, each different from another, and the medieval rabbis had different version too. The book was first published in Venice 1602 according to one version. R. Joseph Kafeh published a new edition in Jerusalem, 1978, based upon different manuscripts and printings, and one can distinguish the different versions in this edition. Recently, R. Efraim Ariel Buckwald published a new, corrected edition (Bnei Brak, 1990) based upon manuscripts and the first printing, and it is according to the final version that Ra'avad penned. It contains references to the various editions that had been authored by Ra'avad himself. The Responsae Project contains the Sefer Ba'alei haNefesh according to R. Buckwald's revised edition (Bnei Brak, 1992). part (the first chapter in his version) that was found in manuscript, but it appears that this chapter was not authored by the Ra'avad. Ra'avad also wrote a series of glosses and critiques on Razah's haMaor on the Alfasi Code, and was called Katuv Sham ("It is written there", based upon the opening words of each critique). These have been entered in the data banks according to the new edition by C. Freiman (Bnei Brak, 2003) and is based upon manuscripts and the book Temim De'im.

    8. correct, the rambam is also in the "next to none would be best" camp, although he does include the different level of onah in the MT. likewise the ramban defines שאר כסות ועונה sexually, as if to say that is the basic obligation/definition of marriage.

      the rama paskens the gemara in nedarim as halacha, but does add that the line about "poresh min hamutar". i don't have an aruch hashulchan in front of me, but IIRC he also says that while "sex for fun" may be a low level, it is still something of a mitzvah.

      bottom line: these sources do not agree at all that with this idea of sex only for children, shalom bayit, or even quashing the yetzer. certainly the tosophot's permitting "sh'lo k'darcha" is in complete opposition to this idea.

    9. You are heading into an important question. are we dealing with opposing views or are we dealing with a dialetic or are we dealing with situational or person dependent halachos? Tosfos can be understood that a man sometimes needs activity to keep him from sin - which is not related to producing children. That is is a permitted only in the context of "if we don't permit it something worse will happen." The Maharal has an interesting discussion concerning the fact that such activity is prohibited for a goy but is permitted for a Jew.

  6. This is so interesting. Any anybody off the street today about why relatives shouldn't marry, and I'd think that most people will answer something along the lines of, "they obviously shouldn't because their children will likely have all sorts of genetic diseases!"

    I always thought the idea that offspring resulting from relations between close relatives are more likely to carry inborn biological defects predated the modern understanding of heredity (e.g., many genetic diseases being attributable to recessive genes, etc.). But, seeing that such ideas are totally absent from the excerpts you bring here, I'm not sure any more. R' E., your thoughts?

    1. The Ramban wrote "If the relation doesn’t lead to children it is prohibited. Similarly that which doesn’t preserve the species and isn’t successful is also prohibited by the Torah. This is the reason for the Torah views on intercourse with relatives... Thus later on in verse 17 it says that intercourse with relatives is wickedness. In other words it is not properly marriage because it won’t be successful but represents simply evil lustful thoughts"

      That could be understood thatthe offspring of relations between two close relatives is not viable. Thus this would fit in with the genetic explanation.

    2. Perhpahs one could say, there seems to be a pattern in avodas Hashem. The common average man is required to follow halacha. Sex is permitted with his wife, as he desires but with any halachic limitations. The man who aspires to kedusha must develop control of his animal nature, beyond halacha, as befits Kedoshim Tiyu. For him he must adopt an approach of prishus. This fits in with other statements regarding the negitive aspects of sex. Finally, for the man who has mastered kedusha, sex can serve as a vehichle for Ahvas Hashem. This may be the Shir HaShirim element.

    3. Important point. However there is some indication that sexual relations - without the consideration of children is critical for avodas hashem i.e., Igros Hakodesh. Or the following in

      Berachos (62a): Rav Kahane once hid under the bed of Rav [when he was with his wife] and he heard them converse and jest and then Rav fulfilled his needs. Rav Kahane was so astonished by this that he said ,”The mouth of Rav is as one who has not tasted any food [he acted like he had a strong lust for intercourse – Rashi].” Rav then said to him, “Kahane get out – this is very disrespectful!” Rav Kahane replied that this is a matter of Torah and that he needed to learn about it.

But rather push them away with the weaker left hand while his stronger right brings them close so that he eats when he is hungry and drink when thirst. In short he should take care of those needs which are necessary but not fast to afflict himself. This is stated in Taanis (11a): That one who causes himself suffering by avoiding wine is called a sinner and surely one who denies himself from all other pleasure. Furthermore it says in the Yerushalmi (Kiddushin 4:12):”In the future a person will have to give a reckoning of all that he saw but didn’t eat. R’ Eleazar used to collect money so that he could purchase all types of fruit once a year.” Both these explanations are correct.

  9. What's interesting to me is that the Ramban first says:"The fact is we don’t have a traditional explanation concerning this. However according to logic there must be a deep secret of creation regarding his soul and this is included in the secret of incarnation which has already been alluded to."

    Then he says: "And that which is beneficial he [G-d] commands and he doesn’t reveal to his people except for his wise men and advisors."

    So is the Ramban saying that he knows a secret kabbalistic reason for forbidding arrayos or not? First he says flat out that there is no TRADITIONAL explanation for the halachos of arrayos, but according to LOGIC, it must be a based on a deep secret of creation. But then he turns around and says that the benefit of the halachos is revealed to special individuals.

    Maybe the Rabbeinu Bachya is a good place to check, as he sometimes fleshes out a kabbalistic idea that the Ramban merely alludes to in his commentary.

  10. A question that's consistently brought up when Ramban's (and other authorities') strong sex-negative statements are brought is - Why doesn't the Torah prohibit older women from marrying? In fact, many great rabbis have remarried in old age to post-menopausal women. This suggests that there are, in fact, reasons to people to marry (and have sexual intercourse) beyond merely the propagation of the species. I would appreciate any insights or sources regarding this.

      This happened very frequently throughout Jewish history. Both with great rabbonim and with common men.

      And it still happens today, especially with Gedolim.

  11. ramban was right: back then, they did not know why it was forbidden. today, we know that it is genetically not healthy for a population to engage in incest.

    It is quite astonishing that almost the whole world frowned upon incest, although the proliferation of recessive congenital diseases could not be too obvious at a time were child and infant mortality could reach 33%...

    I mean. those recessive diseases are nasty, but they are not THAT frequent, so I wonder how the negative effect of consanguinity could be detected when children died all the time anyway from infections, etc...

    By the way: i find those midrashim of the shvatim marrying their twin sisters quite appalling. As if the avot had not enough consanguinity already, just form marrying their nieces and cousins...

    The more hareidi, the more they propagate this midrsh about the twin sisters. What might that tell us?

  12. As regards marrying one's wife's sister: you might want to read "tia tula" by miguel de unamuno in this regard.

    I think it is a good idea to prohibit all family memberes of the spouse. It is good to prohibit the wife's daughter (how many stepfathers harass their stepdaughters), two sisters, mother-in-law, etc... And it is good to prohibit them even after divorce, or even after the wife died (except for Yebum)... Because it is important to protect the family life from sexual misconduct. Where are we going if a father can take his son's wife or vice-versa?

    3. If a man has sex with his wife's sister, it is a sin -- though not as big a sin as the first case -- and we force him to then divorce his wife.

    One thing I'd like to know is why only in the third case -- with the sister-in-law -- we force him to divorce his wife? Why does Halacha make such a unique issue regarding a S.I.L., as to force him to divorce his wife?
