A three-judge appeals court panel on Wednesday granted the Department of Justice’s (DOJ) request to continue its review of classified documents seized in an FBI search as part of an investigation of former President Trump’s potential mishandling of the information.
The judges, two of whom were appointed by Trump and one of whom was appointed by former President Obama, also indicated in their opinion that there appeared to be no evidence that Trump declassified the documents while he was still president and that his legal team “resisted” in providing any evidence that he did so using officials channels.
They also questioned why Trump would “have an individual interest in or need for any of the one-hundred documents with classification markings.”

The emergency intervention upends a trial judge's order over those documents that had blocked federal investigators' work on the documents, and is a strong rebuke of the Trump team's attempt to suggest without evidence that materials were somehow declassified. No matter your views on immigration policy, imagine being treated as political refuse that’s dumped to own the libs. Pulling a stunt like this required the heart of a reptile and the ambition of a Genghis Khan, although the comparison might be unfair to skinks and geckos, which feed primarily on insects, fruit and the occasional mouse. To acquire the bait for his stunt, DeSantis apparently deployed staff into Texas to mislead the targets. “The migrants said a woman they identified as ‘Perla’ approached them outside the shelter and lured them into boarding the plane, saying they would be flown to Boston where they could get expedited work papers,” reports NPR.
You would think this response would have humiliated DeSantis, whose imagination had no room for the possibility that anybody could act so humanely. Instead, conservative media simply responded as if rich liberals had acted in the way Desantis anticipated. The Federalist gleefully reported that liberals were “melting down” as if they were angry at having to accommodate immigrants, rather than at DeSantis’s abuse of immigrants. It became a “fact” in the conservative media that Martha’s Vineyard was responding to the immigrants with terror:
“What happened to our clients is akin to human trafficking, false imprisonment, or kidnapping,” said Oren Sellstrom, litigation director for Lawyers for Civil Rights, a Boston-based organization whose attorneys have spoken with many of the migrants. “Those are all the types of crimes that federal and state law-enforcement authorities must investigate.”
According to Sellstrom, the undocumented migrants consistently report they were induced to board the planes in San Antonio with false promises of work in Boston, educational opportunities, and help with immigration paperwork. They initially believed they were heading to Boston, he said, and were told only in midflight that their destination would be the Vineyard, an island that many of them had never heard of.
The migrants had been flown from Texas to Martha’s Vineyard on Wednesday in arrangements made by Florida Gov. Ron DeSantis – part of a series of moves by Republican governors to transport migrants to liberal enclaves to protest what they say are inadequate federal efforts on southern border security.

The Supreme Court divided 5–4 in a clash over religious liberty and LGBTQ equality on Wednesday, forcing Yeshiva University to stop discriminating against a gay rights group on campus. But the majority’s order had little to do with this culture war skirmish. It was, rather, a rebuke of Yeshiva—and specifically, its overeager lawyers—for racing to SCOTUS after losing in the lower courts because of their own errors. Chief Justice John Roberts and Brett Kavanaugh did not side with the three liberals against the university because they think gay students deserve equal treatment. They did so because Yeshiva brazenly abused the court’s shadow docket on the assumption that it would get special treatment. It was an understandable gamble. But it failed.

It follows from this that the compound is superior to its simple component elements to the extent that the combination diminishes and repels change. The New York affiliate of the ACLU, stoked outrage and debate this week after suggesting that funding for yeshiva schools is taking money away from students of color in public schools, based on an extensive New York Times report.
"For years, district leaders in East Ramapo have extracted resources from public schools, which are almost entirely attended by students of color, in order to lavishly fund yeshivas attended by white students," the NYCLU tweeted Monday, with a link to a New York Times report.
In an unsigned order, the Supreme Court noted that the New York state courts had yet to issue a final order in the case, and that Yeshiva could return to the Supreme Court after the New York courts have acted.
“The application is denied because it appears that applicants have at least two further avenues for expedited or interim state court relief,” the court said.
Justice Samuel Alito, joined by Justices Clarence Thomas, Neil Gorsuch and Amy Coney Barrett, dissented from the court’s order, noting that the lower courts could take “months to rule.”
“I see no reason why we should not grant a stay at this time,” he said.
Noting that the school objected to recognizing a group that would have implications that are not consistent with the Torah, Alito said, “The First Amendment guarantees the right to the free exercise of religion, and if that provision means anything, it prohibits a State from enforcing its own preferred interpretation of the Holy Scripture.”
Conservative Justices Samuel Alito, Clarence Thomas, Neil Gorsuch and Amy Coney Barrett dissented. Liberal Justice Sonia Sotomayor had temporarily blocked the judge's order last Friday while the justices considered the university's request. read more
