 I don't blame President Trump for his angst and bitterness over his impeachment by the House of Representatives. In his mind, he has done "nothing wrong" and not acted outside the constitutional powers vested in him and so his impeachment should not have come to pass. He believes that the president can legally extract personal concessions from the recipients of foreign aid, and he also believes that he can legally order his subordinates to ignore congressional subpoenas.

Hence, his public denunciations of his Senate trial as a charade, a joke and a hoax. His trial is not a charade or a joke or a hoax. It is deadly serious business based on well-established constitutional norms.

In Trump's case, though the House chose delicately not to accuse the president of specific crimes, there is enough evidence here to do so. Federal election laws proscribe as criminal the mere solicitation of help for a political campaign from a foreign national or government. There is no dispute that Trump did this. In fact, the case for this is stronger now than it was when the House impeached him last year. Since then, more evidence, which Trump tried to suppress, has come to light.

Donald Trump Is the Mad-King President Our Founders Feared Most

 Trump is hardly the first president to make full use of the frighteningly expansive power of the presidency. That bipartisan tradition dates back decades. More recently, we saw it in the vast executive theory used by George W. Bush to justify torture and wage endless wars. We saw it Barack Obama’s expansion of the war on terror, use of a secret drone-strike kill list, and wielding of executive authority to put in place hundreds of new regulations. 

But Trump exists in a different realm. He thinks he is the law, an untouchable and all-knowing sovereign. Reality bends to his will. He stands in front of the American people and tells them to believe the opposite of what they see and hear, tells them that he alone can fix what’s broken in American politics.

This is the behavior of a president who believes he’s a king.

This morning we reported on today's international Israeli summit against antisemitism held in Jerusalem (see
"Never Again??" at: http://firstamendmentactivist.blogspot.com/2020/01/never-again.html ).

We've since received reports of the demonstration held there by concerned Orthodox Jews against the Israeli government, over their drafting of girls into the notoriously exploitive and immoral Army, and over the often brutal religious-persecution of religious objectors, particularly the girls currently languishing in Military Prisons Four and Six.

Well over a dozen protesters demonstrated at a location about a five-minute walk away from where world leaders were being hosted in Jerusalem, to address increasing antisemitism, on the 75th anniversary of the liberation of Auschwitz.  Demonstrators prepared multiple "provocative" signs, e.g. protesting antireligious Army racism against Jews of color, and imploring President Putin to seek the freedom of an incarcerated victim of IDF antireligious persecution (Lital bas Miriam). 

Nevertheless, B"H, the protest remained peaceful, because, in full view of international media, the police employed noteworthy restraint this time, allowing free expression of dissent without stealing signs, or targeting demonstrators for "disciplinary" beatings and incarceration. 

Protesters held signs protesting the decades-old Israeli policy of forcing girls into the promiscuous military environment from about 4pm to 7:30 or 8pm, and reported a vibrant media presence (including YNet). One poster identified the co-ed Army as "The Largest Open Human Trafficking Network in the Mideast."

It was a wonderful Kiddush HaShem to see that Jews truly care. It's tragic that the Israeli government requires concerned Jews to appeal to the broader international community in order to save our sisters from religious persecution - by other Jews.

I believe I wrote this to you in the past: According to her own version of the story, Tamar Epstein discovered her husband's issue and decided that getting married was a mistake two weeks after the wedding.

הנידון הוא האשה תמר אפשטיין אשת אהרן פרידמן שבעלה זה רבות בשנים אינו מסכים לתת לה גט מחמת סכסוך ביניהם על אחזקת ילדתם. לפני כמה שבועות אחד הרבנים המובהקים והחשובים באמריקא התיר אותה להנשא לאיש אחר, ואף סידר את הקידושין ביניהם, מבלי שקיבלה גט פיטורין מבעלה. 

כששאלתי את הרה”ג לטעם הדבר, אמר לי שביסס את הוראותו על כתב שהגישו לו מרופא פסיכיאטור מומחה הקובע שבעלה סובל מהפרעות אישיות פראנאידיות1  וכפיתתיות2 מאז שהתחתנה אתו, ושההפרעות האלה אינן ניתנות לרפואה. אשר על כן הקידושין בטלין ומבוטלין למפרע כדין מקח טעות.

על הכרעה זו יש לי כמה פקפוקים שאסדר אותם אחת לאחת.

מקודם על הטענה שלבעל היו לו הפרעות אישיות בשעת הקידושין.

א) ביררתי שהאשה דנה לפני הב"ד בבלטימאר מקדמת דנא לבקש גט מבעלה. הב"ד חקרו אותה למה רצתה להתגרש ומעולם לא טענה שהסיבה לבקשתה היתה מפני שבעלה סובל מהפרעות אישיות. אדרבה היא רק טענה בפני הב"ד (כפי שהעידו בפני שני חברי הב"ד —והשלישי איננו) שחסר לו בכושר חברתי (not socially adept) ולכן רוצה להתגרש ממנו, וגם בדיונים על אחזקת הילדה הסכימה שהילדה תימסר לבעלה לתקופות מסוימות, שמשמע מזה שלא חשבה שהוא בלתי נורמלי. וכן לפי הדו"ח הרשמי של בית המשפט בדיונים על אחזקת הילדים שהיו לאחר מכן לא טענה מעולם שלא היה נורמלי. כל זה מוכיח שלא היו לו בעיות נפשיות. ואפילו אם תימצי לומר שהיו לו, הרי סברה וקיבלה.

ב) שנית אמרו לי חברי הב"ד שהאשה סיפרה בפניהם שבתחילת נישואיה לקחה כדורים נגד היריון אבל לאחרי כשמונה חדשים החליטה שהיא רוצה ילד והפסיקה לקחת אותם ובאמת ילדה לתקופת הימים. כל זה מוכיח שאף אם היו לו הפרעות נפשיות סברה וקיבלה.

על טענה של סברה וקיבלה ענה לי הרה”ג הנ"ל: נכון, היא חשבה שיש תרופה למחלתו ולכן לא חזרה מיד מהקידושין אבל ברגע שהרופא אמר לה שאין לו רפואה (אחרי הרבה שנים) חוברר הדבר למפרע שהקידושין היו בטעות. עד כאן דברי הרב.

האמת שלפי כתב הרופא המומחה, הרופא האחר שטיפל באשה כבר הודיע לה שאין תרופה למחלתו בדצמבר 2007., ורק במרץ 2008, אחרי ארבעה חדשים החליטה לעזוב את בעלה סופית.3 הרי מוכח שהיתה כאן סברה וקיבלה גם אחרי שנודע לה שבעלה חולה שאין לו תרופה.

המומחה מנסה לפרש שלא היתה כאן סברה וקיבלה וכותב ש"הרושם שלו" ש"הפירוש הכי טוב" הוא במה ששלא עזבה אותו מיד הוא מחמת חוסר ביטחון עצמי, לחצים ואי-החלטיות. כמובן ה"רושם" שלו אינו מספיק להתיר אשת איש, כשרואים בפנינו שסברה וקיבלה.

לפענ"ד גם אם המציאות היתה שברגע שנודע לה שאי אפשר לרפאות אותו החליטה סופית לעזוב אותו (דבר שכנ"ל אני מפקפק בו מאד) יש לדון טובא בטענת הרה"ג שאין כאן סברה וקיבלה למפרע, דאע"פ שעל קנינים יש דין של מקח טעות, אבל סברה וקיבלה אי אפשר לעקור ע"י טענת טעות, שמשנודע ללוקח על החסרון שיש במקח והסכים אליו, אדעתא דהכי סבר וקיבל ואי אפשר לטעון שוב שלא ידעתי שלא אוכל לסבול את החסרון דאל"כ תמיד אין כאן סברה וקיבלה שיכול הלוקח לומרשלא ידעתי שאכל לסבול את החסרון, וכן מוכח ממשנה כתובות עז א'.4

בענין הנאמנות של כתב הרופא:

א) ראיתי את הכתב שעליו סמך הרה”ג הנ"ל את הוראתו. הרופא המומחה מודה שמעולם לא פגש את הבעל ורק את האשה. הכתב שלו (כפי שכותב) מבוסס על עדותו של רופא אחר שטיפל באשה (ואולי גם בבעל—אין זה ברור) בעבר. הרופא הפסיכיאטור המומחה קבע את דעתו על פי עובדות ששמע מהאשה על התנהגותו של הבעל, כמו: כעסו, קמצנותו, פחדיו, דאגותיו, וכו' שכולם מוכיחים שיש לו המחלות הנ"ל שהן, לדעת הרופא, בלתי הפיכות.

חוץ מזה יש לפקפק על נאמנותו של הרופא. הוא קיבל כסף ע"מ לכתוב חוות דעתו וידע שמטרתה היתה להשיג ביטול הקידושין לאשה למפרע מהרבנים. (כן אמר לי האיש שהשיג את הכתב מן הרופא.) וכן מוכח מהכתב עצמו כמבואר למעלה.

ב)עוד יתכן שהאשה קיבלה הוראות ממומחה אחר איך להציג את האישיות של בעלה והמציאה את כל הסיפורים שהרופא מצטט כדי לבטל את הקידושין.

ג)הרבה מהסיפורים שמהם מוכיח הרופא שהבעל אינו נורמלי עד כדי שאין לו רפואה קרו לאחרי הנישואין. מהיכי תיתי שהמחלה, אם היתה, לא התפתחה אחרי הקידושין, שאז כמובן אין כאן ביטול קידושין?

ועל עצם ההוראה יש לי לשאול:

א)הרופא המומחה כפי שנשמע אינו שומר תו"מ. הנאמנות שלו היא מצד אומן דלא מרע אומנתיה. האם חזקה זו מספיקה, ובפרט, ע"פ מה שהעיד זה שהשיג את הכתב כלעיל, שמטרתו היתה לשחרר אותה מנישואיה, לבטל את חזקת אשת איש?

ב)האם לא היה ראוי שהרה"ג הנ"ל יבקש חוות דעת של עוד רופא מומחה שיפגוש את הבעל עצמו ויקבע אם הוא סובל מהמחלות האלה? הלא מאד יתכן שרופא שני לא יגיע לאותה המסקנא של הרופא הראשון, כמו שקורה כידוע הרבה פעמים בדיונים לפני ב"ד ולהבדיל לפני בתי משפט?

מחמת כל זה נלענ"ד שאין לסמוך בכלל על היתרו של הרה”ג הנ"ל ושהאשה בחזקת אשת איש גמורה ואסורה לכל אדם עד שיתבררו הדברים בבית דין כדת וכדין, ובינתיים היא צריכה לפרוש מ"בעלה" השני ואם תתעבר בניה יהיו בחזקת ממזרים עדי שיתירום ב"ד כדת וכדין לאחר בירור הדברים. ואם יש מישהו שחולק עלי, עליו להביא את טענותיו לפני ב"ד כזה שידונו בדבריו.

והנה נפשי בשאלתי ועמי בבקשתי לבקש מכת"ר שישתתפו אתי במחאתי אם נראים דברי להם. כי בנפשי הדבר למחות כדי שלא אתפס בעוון אשת איש ובעצמי לבד בלי ציבור של ת"ח אתי לא תתקבל מחאתי. אבל גם עמי בבקשתי, כי ע"י הוראה זו יפתח פתח לכל עמי הארץ שבארצנו לפסוק על ביטול קידושין מטעמים כאלה מפוקפקים ותהרס ח"ו קדושת ישראל. עד עכשיו היו כמה נסיונות ע"י רבנים שלא קרו ולא שנו ולא שמשו ת"ח לעשות כן אבל המחאות של רבני הציבור השתיקו אותם. עכשיו ע"י היתר זה היוצא מבית מדרשו של רה”ג חשוב ומובהק נתפרדה החבילה אם לא נמחה.

נוסף לזה, בעיני הציבור הרה”ג הנ"ל נתמך ע"י אחד מזקני ראשי הישיבה של הדור ובנו שהוא גם ת"ח חשוב, ואם כי הם מכחישים זאת,  בודאי הרבה יסמכו על השמועות להתיר איסורי אשת איש ע"פ השיטה הזאת, שהרי לדעתם כבר הורה כן גדול בתורה.

ZIVA BAS MAZAL:

After Ziva bas Mazal M., a religious Jewish girl of Ashkelon, hailing from a religious Ethiopian family, submitted her religiosity certification "Tarzhir Dat," it was noted on the document that it was - ostensibly - received late (May 17, '18). (That's not a surprise given the tribulations that the family has been enduring.) A handwritten note on the bottom of document indicated that someone in the Draft Office recommended that Ziva was to be drafted without investigating altogether. It says "Suggested to the Segan to decide TO DRAFT WITHOUT INVESTIGATING" (emphasis in original note).

Why not even engage in investigation, probing what the reason may be? And remember, we're not talking about minor punitive measures. We are talking about destroying the life of a girl (a religious one, in this case), by forcing her into the notoriously exploitive and immoral Army for about two of the most important years of her life at this juncture, crucial in determining her future husband, family and life.

More to the point, her religiosity is not subject to doubt, as made clear by absence of any reference to a Rayon Dat there, and by virtue of the blatant absence of any substantial discussion of her religiosity in her later meeting with Segan-Maitav Avner Lotati. Thus, the issue at stake is strictly procedural. And, in the backdrop of circumstances specific to this case, any delay in paperwork would not be a major issue if the goal was not to draft her by any means possible. She clearly does not belong in the Army even according to their own legal standards. So why the zeal to draft

her? And, why the rush to do so without even providing a chance to explain?

One must also question, among other things:

a) How much of an anomaly was this brutal reaction?

b)  What role, antireligious, anti-Ethiopian and/or racist animus is playing a role here, in denial of her religious rights, in what ultimately has proven to be bona fide religious persecution of an Orthodox Jewish girl by Maitav (the Military Draft Offices) and the "Justice" System.

c) Why don't we hear about these injustices in the media, or from ostensibly religious and/or "rightwing" Knesset Members? The very silence of media and others enables their unrelenting repetition. Is THAT perhaps the reason we don't hear fron them? Is it because they're also part of the system of corruption, and don't feel comfortable rocking the boat, inasmuch as that itself would jeopardize their own standing in the System.

Last week we reported on the Monday incarceration of a 26 y/o bas Cohen, Lital Cohen. Since then, she's been held in Military Prison Four. She's complained about repeatedly being denied basic bodily needs (including the ability to relieve  herself), and was reportedly punished - twice - as of Monday this week - with solitary confinement (which is excruciatingly difficult, especially for girls, and especially for anyone unfamiliar with military experience), for her complaints over that abusive, even subhuman mistreatment.

The military prison staff, in both prison Four and Six, are, based on unrelenting reports of inmates, adept and intent at really breaking these girls psychologically, and thereby sometimes threatening to push family members over the edge as well.

We previously mentioned a  credible report of an actual suicide attempt over a month ago in that same prison four, by Shir N. Do we insinuate that the prison authorities want suicides? No. They simply are tormenting these innocent girls till the point that they, in some cases, may feel compelled to make the attempt. Now just think about how much pain a girl needs to endure to get to that point. And it's all for refusal to sacrifice their religious and moral principles. And simultaneously, Israeli government co-perpetrators of this systemic injustice are busy grandstanding about antisemitism abroad, and attending Holocaust memorial photo-ops with world leaders -leaders of nations which would never perpetrate such overt anti-Jewish religious persecution against Jewish girls.

Israel arrests alleged sex abuser Gershon Kranczer 10 years after he fled there

An American rabbi who fled to Israel ten years ago after being accused of sexually abusing female relatives was arrested by Israeli police on Sunday, according to Israel’s Justice Ministry.

Jewish Community Watch, a watchdog organization that tries to combat child sexual abuse within the Orthodox Jewish community, identified that man as Rabbi Gershon Kranczer, a former principal of a Brooklyn yeshiva. An American law enforcement official who has direct knowledge of this case also independently confirmed Kranczer’s identity to the Forward.

We reported on a religious young woman, Lital bas Miriam Cohen of Tel Aviv, 26, incarcerated on Monday for her steadfast refusal to sacrifice her religious principles and her personal purity by enlisting in the Israeli Army.

She is now being persecuted in jail for her fidelity to Torah Law, denied even a sheet to sleep on, contact with an attorney entering the jail to speak to her and bring her items from home, and in other ways. They are clearly trying to break her. They're also apparently seeking to extend her incarceration without appropriate due process.

Administration officials on Thursday were quick to point out that GAO is an arm of Congress and the administration is not bound by any of its findings. A senior administration official on Thursday called GAO’s decision “a pretty clear overreach as they attempt to insert themselves into the media’s controversy of the day.”

“We disagree with GAO’s opinion,” OMB Spokesperson Rachel Semmel said in a statement to TIME. “OMB uses its apportionment authority to ensure taxpayer dollars are properly spent consistent with the President’s priorities and with the law.”

But recently released internal government emails, as well as transcripts of closed-door depositions and interviews with TIME, show that both Pentagon and OMB officials became increasingly concerned that what they were being asked to do could violate this very law. The Impoundment Control Act of 1974 requires the executive branch to spend money as appropriated by Congress.

Under that law, the President “has narrow, limited authority to withhold appropriations,” GAO General Counsel Thomas Armstrong said in a statement on Thursday.

The White House budget office told GAO that it withheld the funds to ensure that they were not spent “in a manner that could conflict with the President’s foreign policy.” The law does not permit OMB to withhold funds for policy reasons,” Armstrong concluded.

 The Government Accountability Office issued a legal opinion on Thursday saying that President Trump's administration broke the law by withholding defense aid to Ukraine -- the issue at the heart of the president's impeachment trial.

That money — $214 million which had been allocated to the Department of Defense for security assistance — was appropriated by Congress and therefore the administration did not have the right to hold the money just back because it disagreed with its allocation, the opinion from the nonpartisan government watchdog said.

"Faithful execution of the law does not permit the President to substitute his own policy priorities for those that Congress has enacted into law," the opinion said. "OMB withheld funds for a policy reason ... not a programmatic delay. Therefore, we conclude that the OMB violated the ICA [Impoundment Control Act]."

The OMB made clear Thursday, however, that it disagreed with the GAO report.

GOP congressional candidate Robert Hyde has denied being involved in surveillance of former U.S. Ambassador Marie Yovanovitch, saying he was "playing" in texts to Lev Parnas released by House Democrats on Tuesday.

The Connecticut Republican told Eric Bolling on Sinclair TV last night that messages he sent to Rudy Giuliani's indicted associate discussing surveillance of Yovanovitch were "just colorful," and said he was a "little landscaper from f****** Connecticut" when pressed on whether he had spied on the then-ambassador.

Hyde also denied being a "close associate" of Parnas, claiming he barely knew the businessman.

Documents released on Tuesday suggested the supporter of President Donald Trump texted Parnas with supposed notes on Yovanovitch, her whereabouts and what she was doing.

"She's talked to three people. Her phone is off. Computer is off," one message from March 2019 read. According to the documents, another pair of messages said: "Update she will not be moved special security unit upgraded force on the compound people are already aware of the situation my contacts are asking what is the next step because they cannot keep going to check people will start to ask questions.
