This is different from the dispute of Rav Elazar and the Sages, as it was not the same BD. Rav Elazar was presumably required to follow the majority because they sat together.
Note, one of the signatories above, brought someone as the head of the Rabbinic courts in Jerusalem - who was suspected of both fraud, and sexual abuse prior to the election

When a judge knows that a colleague is a robber or a wicked person,
ReplyDeleteit is forbidden for him to sit in judgment with him, as it is stated:
"Keep distant from words of falsehood."
