A prominent rabbi in the Satmar Jewish community of Kiryas Joel in Orange County plotted to kidnap and murder a man who was resisting a religious divorce from his wife, prosecutors said Wednesday.

Rabbi Aharon Goldberg of Israel, and Shimen Liebowitz, of Monroe, were arrested Tuesday on charges of conspiracy to commit kidnapping and conspiracy to commit murder for hire. In early July, Liebowitz and Goldberg contacted an individual to kidnap the husband and force him to give a get — a religious divorce — to his wife, the feds said.

The individual, who is cooperating with the feds, later learned that they didn’t just want to kidnap the husband — they planned to kill him as well, the feds said.[...]

“Over a period of months,” he said, they “met repeatedly to plan the kidnapping and to pay more than $55,000 to an individual they believed would carry it out.”[...]

  1. Was there a legitimate Beis Din that authorized a beating? If there was, wouldn't they also have been mentioned. If there wasn't, then the get would have been worthless. Delivering a sound beating may have made the vindictive in-laws feel good, but it would not have provided the woman with a get.
    Considering the fact that these chushiveh kanoooim were willing to encourage a woman to live in sin, the fact that they were charged with murder isn't a stretch.

    Robert Stahl had the right idea for Mendel Epstein’s, but Mendel Epstein, himself at the sentencing hearing, and in his appeal, kept up the tough guy image and kept up that he’s a champion on delivering the goods to his customers. Remorse, regret, admission that he erred --- maybe could’ve reduced the draconian sentencing. I know supporters of Mendel Epstein et al including Rabbi Schachter, Rabbi Ralbag, etc They bemoan only that Mendel Epstein got caught. They need to bemoan Mendel Epstein et al being so defiant to rabbis of Israel.     Since you mention it, let me repeat here what I heard years ago from R. Aharon Soloveichik. In order for a beis din (at least outside of EY) to function,it has to do so with at least the permission of the authorities of the country. This is based on a gemara in Sanhedrin. A beis din that violates the law of the land and has to sneak around to perform its duties is not a beis din. Period.

    This means that, even if a beis din is involved, if it ordered illegal coercion -- illegal meaning under the law of the land -- then it is no longer functioning as a beis din but as a rogue operation, and any get given as a result is a get meuseh. So if some beis din orders someone to be beaten, and that is illegal (which it is), then the whole get is invalid.

    (Presumably this would not include legal means of pressure -- such as a cherem or other forms of social pressure. There are many cases in the US that involve a religious group "shunning" someone, and that is perfectly legal. We had such a case where I live, and the pressure eventually caused the man to cave and give a get.)

    My suggestion for Goldberg-Liebowitz defense
    All their talk to the mafia man was puffery and exaggeration. True they gave him big $. That $ came from the rich wife and her malicious supporters. Either the wife and her supporters are rich like Tamar Epstein, or, they expect to profit from the husband, who will be beaten or dead, by getting the house and his pension. Goldberg-Liebowitz should express remorse, regret, and admit they erred. They should say they were just joking when they spoke to the mafia man. They never did anything of the sort in reality. They promise to make Aliya as soon as the USA will allow them. They promise never to get involved again in violent feminist divorce matters.

  16. This is quite interesting. What about a place like the former Soviet Union, where religious observance was outlawed - would a beis din never be able to function? Was it impossible to ever write a legitimate get, that was being done willingly by both parties? I guess that you could say that in such a case, the kiddushin itself wouldn't be valid, and they would have been living as committed partners, but not as a married couple. The real problem would be with those who married prior to the rise of the communist government, but were seeking to divorce after the anti-religious laws were put into affect.

  19. The resolve of the prosecutors in the U.S. is seemingly all that is keeping most Gittin Kosher here. That is, if men thought that the authorities would not enforce the law when it comes to "internal religious matters" and, thus, that not giving a Get on Demand might lead to imminent trauma and death for them, the husbands, then it raises the question if any of the Gittin are willingly given.

    This FBI sting is realistic. In the Mendel Epstein et al FBI sting, we had a fake wife and a fake brother seeking Mendel Epstein’s services. Mendel Epstein stupidly got caught because he fell for their lies. In the Goldberg-Liebowitz it seems we have a real mafia man getting real money from Goldberg-Liebowitz. Goldberg-Liebowitz could say their talk was puffery and exaggeration. They cannot explain paying out the money to a mafia man. They got caught because of the lies of the real mafia man. Apparently they dealt with the real mafia man before and trusted him. Yikes! Didn’t Mendel Epstein boast of dealing with the real mafia, as an arbitrator?
    Time for Goldberg-Liebowitz to make a deal with the prosecutors, to get some convictions of other guilty parties in the conspiracy. I wonder if Agunah International started to advise their customers to go to Williamsburg, once the FBI shut down Mendel Epstein et al? I’m waiting to hear remorse, regret and admission of error from Greenblatt-Kamenistsky, Schachter-Ralbag, other Mendel Epstein et al supporters etc.

  23. There were two reasons that had come to mind. The first one is wrong, though.
    There is reason to say that a marriage that at time of kiddushin does not have any possibility for get, is not valid. There are times when there is a chiuv get, and they may not live together... Problem is, that even if true, they can move to a different country. Although the USSR did not allow it's citizens to emigrate, it was a law that was liable to change at any moment - as actually happened!

    Second reason is mekach taus. Would a man or woman enter a marriage that had no out, even if the spouse did such horrible things that would allow a divorce?

    Technically, you don't need a beis din to give a voluntary get, although in Shulchan Aruch it states that the universal custom is to do it before a beis din. You only need two kosher witnesses.

    But to FORCE a get, you need a beis din.

  29. Ahem. Whoever says the alleged perpetrators ONLY sinned is himself doing nothing but making a mistake. They did sin -- but apparently only by doing what they thought were Mitzvos.

    Can we not examine their actions in terms of the teaching that performing a Mitzvah leads to the performing of another Mitzvah, while the performance of a transgression leads to a transgression?

    The initial plan was to beat the husband to obtain a Get. The planners thought this was a Mitzvah. But as has been demonstrated on this blog in other posts and comments, the Halacha is that such beatings are an Aveirah.

    Once the planners were convinced it was permitted -- and possibly even obligatory -- to beat the husband, they were confronted by U.S. laws which made their plan illegal. But, they may have reasoned that if a government outlaws some, or all, of the Torah, is it not proper to keep the Torah despite it being outlawed? Thus, their "Mitzvah" to beat led to their "Mitzvah" to defy the civil law in order to do the "Mitzvah" beating.

    "But, wait", they may have thought, "won't the husband report to the authorities that he was beaten? For shame! He is a Moser!"

    So, the "Mitzvah" of being Moser Nefesh for the Torah by taking a substantial risk to beat a husband in violation of civil law led them perhaps to want to perform the Mitzvah of following the ruling of the Shulchan Aruch that one can extra-judicially kill to prevent someone from informing on Jews to the non-Jewish authorities. It all may have made perfect sense in their made-up Torah universe. (Furthermore, the conspirators may have been motivated by the teaching not to put a "stumbling block" in front of a man and not to assist in the performance of a transgression. By letting the husband live, they would be causing, or at least complicit in, the husband's "Aveirah" of filing a criminal complaint that could lead to the "innocent" conspirators being "falsely" arrested.)

    Thus, we conclude that the subjects of this post were led from one Mitzvah to the next, which in fact was going from one transgression to the next.

    Those arrested now have an opportunity to add one more Mitzvah/Aveirah.

    They can hire Rabbi Yitzchak Breitowitz to write legal briefs for them "demonstrating" how the defendants had Torah authorities of past generations to rely on.

    Shmiel Fried has a long history of his clients using ORA and all other dirty tactics. This supposed beis din was completely under Fried's control, which is/was common knowledge to all those with experience in that system and world.

    The guy under whose name that "beis din" is - Chaim Erenthal's father-in-law - has supposedly stopped his funny business and is trying not to do anymore dirty things. That's what some people are claiming; but there is no word on if or how he is trying to atone for his long history of funny business. And funny business is a huge understatement!

I will respond for those who may have not read it: Chaim Erenthal wrote a letter on the stationary of "'beis din' orchos mishpat" that anything may be done against Masri. He signed as the safra d'deina or secretary of the "beis din."

    Everything else is quite clear.

    Why do claim that anyone has a position in Satmer?

    Why do these women feel they can remarry? We live in a man’s world. Men could easily remarry if they’re not choosy---but women??? Once I got word that Susan accepted the get before witnesses in Ralbag’s Brooklyn court on 2/15/1993 I went to the Kotel and prayed that God send me, my bashert.
