Rav Shlomo Fisher - authority is bottom up from acceptance of people

  2. There are a number of posts both on the source of Talmudic law, and its authority.

    Rambam also in his intro to the Yad makes the same point - that the Talmud is only valid because it was accepted by Klal Yisrael.

    So what if:

    a) We hadn't accepted it ? Certainly some tribes did not accept it.

    b) And what if at some stage , again Klal Yisrael decides to reject it?
    If we have the power to accept, we also have the power to reject.


    There is a view, which I have heard int he name of Rav Kook, that the Hamon or the people decide which way halacha goes. How this is formulated, I am not sure, but certain things, eg women's education was decided by the people, and when it reached the tipping point, gained halachic legitimacy. Same goes with forbidding smoking; same goes with Zionism or the concept of a Jewish state, an army, etc etc.

    This is in Rav Shlomo Fisher's sefer which he sells in Har Nof where he lives. Not sure if it is available in seform stories
