Daniel Penny found not guilty of criminally negligent homicide

Penny, a 26-year-old White man, was not immediately charged in the death of Neely, a 30-year-old Black man who had been struggling with drug addiction, mental illness and homelessness. Protesters and lawmakers called for his arrest after a video of him holding Neely in a minutes-long chokehold was widely disseminated. Penny turned himself in 11 days after Neely was killed.

The case sparked discussions on public safety, race relations and New York’s handling of homelessness and mental health problems. Penny’s defense centered on the claim that he acted to protect other subway passengers from Neely, leading him to become a conservative symbol for citizen crime fighting.

  1. Someone who struggles with drug addiction, mental illness and homelessness can also be a violent threat to others.
    If someone is going to play the race card, they have to prove that Penny would not have done the same thing if the man was White.
    As for vigilantism, what was the alternative? Just sit there and hope there was a cop handy at the next station and that nothing would happen until then?
