Trump's legal team argues Senate can't convict him, his speech protected by 1st Amendment

  1. 1st Amendment or not, you're still not allowed to shout "Fire!" in a crowded theatre. The legal team will have to show that Trump at no point instructed the crowd to do what they did. They will be successful because at no point did he directly instruct the violence that followed. But given the Senate has a Democratic majority, he'll lose anyway.
