Yes the First Amendment. But when legal peaceful protests and rallies go on for weeks at a time and become the cover for illegal behavior, the implicit social contract dictates that the peaceful pull back and let police sort things out before continuing the peaceful protests.
Instead, what we have is that the "peaceful" take the the attacks on the criminals, and cry that they, the peacefuls, are the targets!
