Kaminetksy-Greenblatt Heter: Rav Shmuel Kaminetsky explains why Clinton lost to Trump: "Those people who do not act with integrity and with telling the truth will not be successful"

Kikar haShabbat

Honesty comments on the above
The irony has no words. You see, we can review what the Rosh Yeshiva has said. What is the Rosh Yeshiva's definition of dishonesty?
Does it mean promising to listen to Rav Dovid Feinstein, but in reality making a joke out of that? http://daattorah.blogspot.com/...
http://daattorah.blogspot.com/...
Then:
I called Rabbi Shmuel Kamenetsky and asked him to confirm that he had told Tamar to separate from her second husband. He told me, "I never told anyone to separate." That is an exact quote.

Anyone can call him to verify it. http://daattorah.blogspot.com/...
Same the actual "heter" shopping trip.

3) Rabbi Greenblatt wrote that he completely relied on rabbi Kamenetzky for the details. (Can't find the link now.)
Wow. Hillary Clinton is bad because she surrounds herself with dishonest people. In fact, so bad that all precedent of Roshei Yeshiva not taking a public stand on presidential elections had to be broken, all because of Clinon surrounding herself with dishonesty.
On the other hand, as seen from the adultery fiasco, we are people of absolute honesty, um, yep, err, oops........

  2. Could somebody tell me what went wrong? We know that The Torah cleanses and purifies a person. RSK has been studying Torah all of his life. Why didn't it keep him straight?!

And what about the person at the center? Hillary is bad because SHE HERSELF is dishonest as she proved over and over and over again!!

  4. “Kaminetksy-Greenblatt Heter: Rav Shmuel Kaminetsky explains why Clinton lost to Trump: Those people who do not act with integrity and with telling the truth will not be successful”
Lack of integrity and truth telling? Rav Shmuel Kaminetsky is talking of himself with the Kaminetksy-Greenblatt Heter.

    Judge Freda’s words on Pacer:
“I do find that the criminal conduct for which Epstein was convicted was heinous, regardless whether the act was committed in a religious context. More importantly, Epstein engaged in kidnappings, for the purposes of forced gittin, years before he was arrested; this was hardly a one-time, aberrational act on Epstein’s part.”
The issue with Kaminetksy-Greenblatt Heter and with Mendel Epstein et al is heinous conduct disguised as righteous. A false/misleading pronouncement on Torah can lead to heinous adultery and to heinous Mendel Epstein et al conduct. What is such a false/misleading pronouncement on Torah ? Such as 11/2/2016 Pacer:
“Rabbi Ralbag testified on direct and cross-examination that: a man who refuses to grant a get to his wife is a scoundrel, JA1901; it is a mitzvah (a religious commandment) to free an agunah, JA1878;”

  5. I do have an answer. RSK was given a tremendous opportunity - an opportunity that our generation really needs.

The Gemara in Avoda Zara asks a similar question about Dovid Hamelech. King David was a righteous person who spent his life as a doveik b'Hashem. How did he fall through with Bas Sheva (despite the fact that things turned out differently because of her conditional get)? How was he not protected (Mahrsha)?

The Gemara asks the same question about the eigel. It was a generation that had just lived through the amazing miracles in Egypt; then the miraculous exodus; topped off with Krias Yam Suf - where the most simple of people had greater prophetic visions than the greatest prophets. They went on to all have Hashem give them the Torah on Har Sinai. Yet, just a short 40 days later they fell through in such a great sin - that we are still feeling the repercussions. How were they not protected?

The Gemara answers that Hashem rescinded their special protection in order to open the door for baalei teshuva. From then on, no matter how deep a person fell, they can always point to these greats, and pick themselves up and do teshuva.

In our generation, people have unfortunately fallen into all types of stuff. They may feel as if they're lost. (And I mean everybody, from those who have never learnt Torah, up until rabbis too I.e. BF, DW, LT...) If we would have a great Rosh Yeshiva and a great Rabbi get up and say that they made such a huge mistake, they would be a role model for so many. People would say if hope is not lost for them, then hope is not lost for me. If they can be great, then it is not too late for me either.
I so wish that they would utilize this opportunity.

  6. Scoop: RSK claims he never said it. It was R. Nota

  7. You are presenting a very powerful multi-layered complex enigma to which there cannot be a simple answer. The Talmud declares that the Torah will be "migna u'mitzlah", that is to say it will act both as a shield against injury and as a salvation from temptation to those who engage in its study. However we find many instances both in the distant past as well as in our time where well known "lomday Torah" had succumbed and committed outrageous sins. How can this be? Where is the promised aegis of our holy Torah?

It has been suggested that the protective umbrella of Torah study is provided only to those who engage in it "lishmoh", forsaking any reward or renown. For those who seek acclaim, prestige and celebrity, no such immunity is afforded.

Indeed, the Talmud presents the narrative Elisha ben Avuyah, better known as "Acher", the apostate. (Forgive me, but I cannot provide citations for my sources; I am not a "boki b'shas" who can cite "daf" and "shurah" without a moment's thought, but I'm sure there is someone out there who can help me out.) The tale goes as such: The bris milah of the infant Elisha ben Avuyah, was attended by both Gedolai Hatorah as well as by laity. Whilst the plain folk were conversing about mundane matters, the Chachomim were involved in a profound Torah discussion. To the astonishment of Avuyah, the father of the "rach ha'nimol", a pillar fire descended from on high and encircled the Torah sages, so that they might not be distracted from there sacred discourse.

Avuyah was so impressed by this display that he immediately declared that his infant son Elisha will be dedicated solely to the study of Torah, so that he too might merit such great distinction. One might think that this awesome spectacle was the epitome of "kidddush Hashem, but one would be wrong. The Talmud uses this event as an illustration of what can go wrong when one studies Torah :"she'lo lishmoh" , for utilitarian purposes. Elisha ben Avuyah dedication to Torah was prompted by his father enchantment with fame and glory and therefore, although Elisha grew to become a mighty Tanah , in his final years he threw off the yoke of Torah and embraced apostasy.

One is permitted to begin to study Torah even if it is inspired by ulterior motives because unless he has partaken of the sweetness of Torah, how shall he come to study it for its own sake? But beware: unless one strives to eradicate one's self serving motives, in the end such Torah will not avail him. If one studies Torah so that he might be a Rosh Yeshivah or that he night be seated prominently on the dais at Torah conventions, the Torah can become a "sam ha'muves" for him.

The original purpose of Chasidus was not as commonly thought, to provide inspiration to the unlearned masses; it was to teach great Torah scholars how to become totally humble, without a grain of self-promotion at all; only then would their Yetzer Horah be completely vanquished. (What Chasiduss has sadly devolved into today is clearly a "maasel sotton", but ought to be a subject to discuss at another time.

In light of the above it should come as no surprise that Rabbi Kaminetsky who was always regarded in the Yeshiva world, (with the exception of Philly and its offspring) as a light weight left leaning Rosh Yeshivah, should lack the humility necessary to admit error and fault. even in the face of compelling Torah-based arguments presented by the numerous scholars who stand head and shoulders above him.

The only mystery is why isn't ALL the Torah world up in arms against Rabbi Kaminetsky's violation of everything we have known Kedushas Yisroel to be.

I fear I must close with my bewilderment unresolved.

  8. most of the american yeshiva world still respets rav kaminetzky ttremendously they blame his son for the ccurrent situation

at this point you sound like a bitter and broken tape recorder .

the only one responsible for this heter is rav greenblat who stands by the heter 100% based on info he has thats not prevey to the public nor is it based on dr reports .

so stop carying on about this its all died down . the couple is being somech on rav grernblat who rav dovid said is a bar samcheh and he never retracted that or said anything contrary to tthat
so although thr overwhelming majority of poskim and rabbonim disagree personally with the heter including rav shmuel kaminetzky many agree the couple has the right to listen to rav greenblat

  9. Please tell me who the overwhelming majority of poskim who say that Tamar can rely on a psak which is based on a phony psychiatrist report and a misreading of Rav Moshe's teshuva?

It is nice that everybody blames Shlomo Kaminetskty - but that doesn't excuse his father from telling the couple to separate.

Furthermore where do you see that Rav Shmuel disagrees with the heter? All his son's letter said that that they agree to accept Rav Dovid's ruling but it doesn't say that they felt the heter was wrong!

  13. But that's precisely the problem. King David was forever regretting his sin, so we can learn from him 2 things: 1) No one, not even the greatest Tzadidik can be infallible, and 2) One can return to Hashem's grace no matter how gravely he has sinned. if he sincerely repents

Rabbi Kaminetsky, however, is clearly not a Baal Teshuvah. He is not expressing remorse; he isn't even admitting that he made a mistake. He is not moved by the tragic consequences of his misdeed. The lesson that he is teaching is that integrity is a wasted We are are being taught by his example that those who persevere in their perversity will ultimate prevail.

  14. I thank you for responding. I know the discussion you are saying about lishma. But what I didn't know is what you wrote that Rabbi Kaminetsky was always regarded in the Yeshiva world, as a light weight left leaning Rosh Yeshivah. I see him being endorsed by big rabbonim calling him ה'מרא דאתרא' בארה"ב, being regarded as the daas Torah by many Roshei Yeshivos in the olam Hatorah and considered a gadol. Can you substantiate your assessment of him? I would appreciate that and it would helm to put me at ease about what I have asked, which bothers me very much.

    ReplyDelete
  15. I thank you for responding to me. But I'm not satisfied with your answer at all. These people have not repented and they are not to mentuioned in the same breath as David Hamelech. David repented right away when he was told mussar, because he was sincere and humble except that he a momentary weakness. He did extreme teshuva for many years with the greatest humility as the medrash says. He said vevhatosu negdi samid. But these people have brazenly ignored everyone who criticized them. At this point they can no longer regain my respect with a simple 'I made a mistake, Never mind.' They would have to humble themselves in the the extremest of humbling before it has any meaning. This will not happen. We have already seen what these people are all about. They have not shown any humility or remorse.

  16. I was in Philly a long time ago, and everyone knew he didn't get a lot of learning in; maybe 2-3 hours a day. He was busy with running the yeshiva and the Philadelphia community.
He didn't have much time to learn.
He never prepared shiur, which may have been the reason it was so awful.
So there's your answer: he hasn't learned that much Torah.
He's always only been a "feminist ", nice-guy 'Gadol', not a huge Talmid Chacham.

  17. The Yeshiva world is misinformed about RSK.

The entire Aishes Ish "heter" could not have happened without his endorsement, and encouragement, as evidenced by Shalom's letters to RNG stating that his father agreed to everything he wrote.

He lied about it then. He continues to lie about it today.

His Sheker is camouflaged by an aidelkeit that is insincere.

He was Mivayesh an innocent person Bi'rabim.

He, and his son created false facts to mislead RNG.

Then he blames it all on RNG claiming that he is a Bar Samcha. RNG wrote that he knows nothing of the case other than what the Kaminetsky's told him!

He and his son are responsible for ongoing Aishes Ish!!

He continues to lie about it to this very day.

This makes 11/16/2016 the deadline for Mendel Epstein to file a reply brief for us to read in Pacer. Jachter and Ralbag stated e.g. “Rabbi Ralbag testified on direct and cross-examination that: a man who refuses to grant a get to his wife is a scoundrel, JA1901; it is a mitzvah (a religious commandment) to free an agunah, JA1878;”
Rav Shmuel Kaminetsky is aiding adultery. I quote the Hertz Chumash on “If a man commits adultery with a married woman, committing adultery with another man’s wife, the adulterer and the adulteress shall be put to death.” (Leviticus 20:10):
“The repetition of the phrase and the substitution of “another man’s wife” for “a married woman” stress the heinousness of the offense. The consent of the husband is quite immaterial. Marriage is not merely a ‘contract’; it is a consecration, and adultery is far more than merely an offense against one of the parties to a contract. It is an offense against the Divine Command proclaimed at Sinai, and constitutes the annihilation of holiness in marriage.”

Heinous means hateful, odious, aggravated (sin, or crime, sinner). My wife and I saw a good movie last night, Through the Wall, the very opposite of Kamenistsky, Jachter, Ralbag, Mendel Epstein etc heinous conduct.

  20. The problem is the heter is 2 fold - coruption , in no court including secular courts would judgment be made based on a phony psyc report. Batei Din don't use ' annuling kiddushin ' as an instrument to solve get problems. Rav Shlomo Dichovsky told dayanim that there must always be a get , and a get me'useh is still much better than no get. He said He can handle a get me'useh because be'dieved and with Tziruf devarim it is OK. My conclusion - What comes out of this , is that the Heter in the view of R Dechovsky the RSK- Greenblatt heter is much worse than Mendel Epsteins Gittin and also don't forget the corruption - Things would have been a lot different and actually RSK's credibility enhanced if he would have had the courage to expose his vulnerability and admit the mistakes that have their root in good intentions.

  21. Others made excellent points at your attempt here. One more: So, you blame everything his son R. Shalom? Was R. Shalom dishonest in quoting his father in those letters? If so, how in the world does RSK still surround himself with his dishonest kid??? If loyalty can supersede dishonesty for himself, why can't loyalty supersede dishonesty for a potential president?
#Hypocrisy! What's good for the goose is good for the gander.

  22. Kaminetksy-Greenblatt Heter. There is also the problem of the man defrauded/robbed with the aid and abet of Kamenistsky, Jachter, Ralbag, Mendel Epstein etc heinous conduct.
“The Lord spoke to Moses, saying: When a person sins and commits a trespass against the Lord by dealing deceitfully with his fellow in the matter of a deposit or a pledge, or through robbery, or by defrauding his fellow, or by finding something lost and lying about it; if he swears falsely regarding any one of the various things that one may do and sin thereby—when one has thus sinned and, realizing his guilt, would restore that which he got through robbery or fraud, or the deposit that was entrusted to him, or the lost thing that he found, or anything else about which he swore falsely, he shall repay the principal amount and add a fifth part to it. He shall pay it to its owner when he realizes his guilt.” (Leviticus 5:20-24).
    Baba Metziah 43b:
    R. Akiba said: As when the claim is made. Rab Judah said in Samuel's name: The halachah agrees with R. Akiba. Yet R. Akiba admits in a case where there are witnesses [Of the theft. Then he must pay its value at the time of the theft.]. Why? Because Scripture saith, “or anything else about which he swore falsely, he shall repay the principal amount and add a fifth part to it. He shall pay it to its owner when he realizes his guilt.” [ Lev. V, 24. This is interpreted: he shall give it (i.e., pay for it) . . . as on the day he incurs a trespass offering.] and since there are witnesses, he incurs a trespass offering at that very moment. R. Oshaia said to Rab Judah: Rabbi, you say so. But R. Jose said in R. Johanan's name thus: R. Akiba differed even in a case where there are witnesses. Why? Because Scripture saith, “or anything else about which he swore falsely, he shall repay the principal amount and add a fifth part to it. He shall pay it to its owner when he realizes his guilt.”[Interpreting as before.] and it is the court that declares him liable to a trespass offering.[ Hence he must pay its value at the time of the trial.]
The phony psychiatry report etc has monetary consequences in addition to creating mamzerim. The Torah says “when one has thus sinned and, realizing his guilt, would restore that which he got through robbery or fraud, or the deposit that was entrusted to him, or the lost thing that he found,” The rebellious wife defrauds/robs her husband. The Torah says that

Disclaimer: I had one interaction with him years ago, where he quoted to me the CC regarding a certain halacha in tfillah. I felt like photocopying the MB where he writes the exact opposite, highlighting the citation (with a yellow highlighter) and faxing / mailing it to him.

FYI, RNG said that whoever fed him those dr reports should tell the couple to depart!

And if so, why did RSK feed this dr. report to RNG to begin with?

*the couple is being somech on rav grernblat who rav dovid said is a bar samcheh and he never retracted that or said anything contrary to tthat*

RNG claimed that it was RSK's initiating this so called HETER on his fishing expedition to join this yes or (no) QUACKERY to sign AS IS, with no ifs or buts and no questions asked.

Are you for real? Haven't you read R' Duvid's Psak that this HETER is WORTHLESS?

*the heter including rav shmuel kaminetzky*

His responses are a toss up for odd's and even's, depending where the wind blows.

*many agree the couple has the right to listen to rav greenblat*

    1) RNG doesn't support his own Psak,

    2) RSK retreated,

    3) Rav Duvid's smicha for the Bar Samcha is nonexistent aka worthless.

Furthermore, RSK claims he informed the *Ball Dovor* as well, to depart.

  29. “Kaminetksy-Greenblatt Heter” This week’s parsha “Abraham journeyed from there to the region of the Negeb and settled between Kadesh and Shur. While he was sojourning in Gerar, Abraham said of Sarah his wife, She is my sister. So King Abimelech of Gerar had Sarah brought to him.” (Genesis 20:1-2).
Wow, King Abimelech of Gerar got a heter from Abraham for an אשת איש.
“What, then, Abimelech demanded of Abraham, was your purpose in doing this thing? I thought, said Abraham, surely there is no fear of God in this place, and they will kill me because of my wife.” (Genesis 20:10-11)
“there is no fear of God in this place” means, according to the Malbim, no belief in Divine Providence, השגחה פרטית. Abraham did teach the world belief in One God, with his fights with Terah and Nimrod, aka, Hammurabi etc.
King Abimelech of Gerar felt safe in seizing Sarah. Malbim explains that a king owns all the available ladies in his kingdom---no stealing here. Stealing is one of the 7 Noachite laws. That with the heter from Abraham --- his heart’s desire is Sarah, why not?

Get me'usah has definitely it's chisaron - as the poskim say "lav k'lum hu" - it is NOTHING. By know get, at least people know that there is no get, but by get me'usah, people think that there is one. Also, at least it indicates that the perpetrator knows the need for one!
