Incredible! Judge sentences 3 children to juvenile detention center for refusing to talk to their estranged father

July 10  - A Michigan judge released three Israeli siblings from juvenile detention on Friday two weeks after she sent them there for defying her order that they have lunch with their father when he was visiting from Israel, ABC affiliate WXYZ reported.

At an emergency hearing, Judge Lisa Gorcyca said the children - whose parents have been involved in a custody battle for more than four years - could leave detention and attend a camp for the rest of the summer.

"The court agrees with the children's guardian's recommendation as to the best interests of the children," Gorcyca said this afternoon, reported the Detroit Free Press. "The court finds that is in the children's best interests to grant the father's and the guardian ad litem's motion to allow the children to attend summer camp. Children's Village is to facilitate the transportation."[///]

Three children are in an Oakland County detention center after refusing a court-ordered lunch with their father. 

Protests formed outside the Oakland County courthouse Wednesday after Bloomfield Hills students, parents and teachers learned the Tsimhoni children were sentenced to Children's Village until their 18th birthdays for not wanting to spend time with their dad.

On Tuesday FOX 2 first showed court transcripts which describe exactly how family court Judge Lisa Gorcyca handled a hearing which was suppose to deal with supervised parenting time.

She berated the children, comparing them to Charles Manson and his cult. And claimed they were brainwashed. The judge made threats saying if they didn't apologize and go to lunch with dad they would live in separate cells where they would have to go to the bathroom in front of others.

When they refused to spend time with their father - Judge Lisa Gorcyca found the kids in civil contempt and had the kids locked up.

Larry Dubin, an attorney who has been a law professor at the University of Detroit Mercy for the last 40 years, was also stunned by Gorcyca's decision.

"To treat this like a case of contempt where she sends them away until they're willing to comply with court order seems harsh with respect to young children," Dubin said. "It certainly can raise all kinds of Constitutional issues."

    2. Plenty of cases of mothers who'd rather have their children in such institutions or foster homes than have the father have visitation / custody. Unfortunately, happens all the time.

  2. Too much government in everyone's life. The judge regardless of what he orders cannot make the children have a relationship with a parent. But perhaps his orders can cause more hate to grow.

  3. If the mother is alienating the children against the father, as the judge in this case determined, the judge should award full custody to the father and order all visitation by the mother can only take place while supervised.

    May I talk of my personal business
    in 3 courts in NYS? As I wait to see how my motions for leave to appeal
    progress in the Appellate Division Second Department 2015—04424 and in the NYS
    Court of Appeals Motion # 2015-741, I see that Judge Prus in Kings County
    Supreme Court Index # 2012—54688 finds me in civil contempt.

    Do I have to worry? I wrote to Judge Prus in a motion for leave
    to make a motion July 9, 2015: “Clearly, we have a situation of urgent need for
    Judge Prus to prepare such an order.
    Susan will not yield on her demand for 100% of the house and 55% of my
    TIAA pension. Only Judge Prus could
    break the stalemate. I am in need of
    poor person relief as I'm approaching 70, being out of work 7 years and no
    income other than USA and Israel social security and 45% of my TIAA
    pension. I live in Israel, happily
    remarried to Yemima May 9, 1993 and
    blessed with 3 daughters. I have no idea of Susan's machinations in NYS
    courts with her lawyer Myla Serlin. I
    choose to defend my property long distance from Israel without a lawyer. I trust this is not a problem for Judge Prus. Susan never answers my points.”

    Whew, how fortunate I’m here in Israel.

    transcript. This is a case for daf
    hayomi, on Nedarim. The 3 kids saw their
    father hit their mother and swore never to speak to their father.

    “If a man makes a vow to the Lord
    or takes an oath imposing an obligation on himself, he shall not break his
    pledge; he must carry out all that has crossed his lips.

    Those are the laws that the Lord
    enjoined upon Moses between a man and his wife, and as between a father and his
    daughter while in her father’s household by reason of her youth.” (Numbers 30:3
    and 17).

    Good luck on Judge Lisa Gorcyca getting the 3 kids to speak to their
    father. Rotten of the judge to use power
    to hold in contempt and then to throw in jail. I saw in the internet that my judge, Judge
    Eric I. Prus, supposedly dangles handcuffs before husbands before him. I agree
    another wicked American judge.

  7. Well David that works both ways, if a father (who has custody of children especially if obtained by dishonest means) and denies those children their mother, full custody should be awarded to the mother and all visitation by the father can only take place while supervised.

  9. Custody battles
    are so awful for all parties. I can imagine that these 3 kids made a solemn vow
    to God not to have any connection with their father because they saw him strike
    their mother. I can imagine these 3 kids
    grown, married and have children. I imagine the children are getting married. I
    can imagine everyone wants peace in the family especially at a wedding. We move
    on. Bygones are bygones. What to do
    about the vow not to have any connection? The Gamara deals with this problem.

    Nedarim 47a:

    “It happened to one in Beth Horon that
    his father was forbidden to benefit from him. Now he [the son] was giving his
    son in marriage [and desired his father's presence]; so he said to his neighbor,
    the courtyard and the banquet be a gift to you, but they are yours only that my
    father may come and feast with us at the banquet.”

    Judge Lisa Gorcyca wisely
    says: “One day you’re going to realize what’s going on in this case and you’re
    going to apologize to your dad.” I feel, similarly my six children with Susan
    will one day realize what’s going on in Susan’s lawsuits against me in NYS
    court and will apologize to me.

  14. I'm sure they do but the judge can't impose it. You see the feminism closing in on itself here. Likely - although I don't know the details here - feminism has much to do with alienating the kids from the father. And feminism has this judge acting so recklessly to throw kids in detention.


    The USA no longer adheres to the 7th of the sheva mitzvos. The court system is sheer tyranny, particularly in family court.


    Thus, I tend to agree that calling the cops on any Jew is mesirah because the police and the courts are a joke. It's like Czarist Russia, and maybe worse.

  15. Where does a judge come into taking sides – a judge is there
    to judge, to hear and listen to both sides.
    These children aren't brainwashed. They saw their father
    hit their mother and for that reason they wanted nothing further to do with him.
    They sound old enough to know what
    they saw and make up their own minds. Perhaps
    he should have thought along those lines when he was so quick to raise his
    hands. Why aren’t the children being
    listened to? Lets not talk again about
    the ‘best interests of the children’. The
    father is in a custody battle with the mother – yet he is in Israel when his dear
    children have spent two weeks in detention... for no other reason than they wouldn’t
    be bullied and stuck to their guns and principles.

    This isn’t a case of ‘parental alienation’. The lunacy of ‘parental alienation’ occurs
    when one parent tries their hardest to turn children against the other parent for
    their own sick aims. All that happens is
    that they make a mess of the child. Listen to the children!!!

  16. @Daas Torah - The children should not be punished. I think the judge was wrong for putting them in detention. I think it would have been far better and more effective for her to order custody be entirely with the father and the mother required to be supervised when having visitation.

  17. The judge determined that the father did not hit the mother but that the mother talked it into the children into claiming he hit her (and maybe believing it too.)

  18. A child advocate should sue on behalf of these children and set aside a hefty reward for yhem when they become of age. A judge cannot hamd out detention Willy Nilly. This is more than just silly. The judge acted ciminALLY!

    lawyer Myla Serlin perjured themselves denying I gave Susan (on her initiative)
    a Get 2/17/1993. Susan and Myla
    submitted to Judge Eric I.Prus a forged-false sham 1995 Judge Rigler order of
    separation. These are not just silly, but criminal acts.

    I keep updating the NYS Commission on Judicial
    Conduct. No doubt they’re reading these
    words. In 2000 and 2001 I had silly
    stuff from then Judge Gerald Garson. I had a good lawyer then, Ian Anderson. I made complaint to the NYS Commission on
    Judicial Conduct. Result: Gerald Garson
    jailed for 4 years for bribery. Yet, no change in my case. I had silly stuff
    with Judge Ambrosio and now with Judge Prus.

    According to the articles I've read, Garson's conviction came about because of complaints made by a woman named Hanimov, and related to her case. She wore a wire to her meeting with the intermediary, he ratted out the lawyer who gave the bribes, who in turn ratted out Garson. Yet, you are saying that his conviction was the "result" of your complaints. Is that true?

    Judge Garson
    fined me $5,000. Here’s one example of Garson silly stuff:

    Judge Garson on
    November 14, 2001 allowed Susan to phone in and speak to Larry Rothbart in the
    court room and to excuse her non-attendance and to request a month's
    postponement. I paid Ian Anderson $250 for showing up 11/14/2001 Then
    in the hearing, deferred to December 12, 2001, Judge Garson threw Ian Anderson, my lawyer,
    out of the court room saying “Where's your power of attorney that you represent
    Gerald Aranoff? You don't have one then
    get out of here!” Yet, I wrote to Judge
    Garson August 30, 2001 that Ian Anderson is my lawyer:

    “Ms. Donna, from the Motions
    Department, tells me that she spoke with Larry Rothbart and that I should send
    you a copy of my June 4, 2001 motion that I want heard September 26, 2001.

    Please find a
    copy of this motion, the reply to it and my response to the reply. I'm also sending you a new Notice of Motion
    and new Affidavit of Service. I engaged
    Ian Anderson to represent me to make oral argument on September 26, 2001.”

  27. I'm not justifying the judge's actions nor am I condemning them. Neither you nor I know all the details and that was the point of this article. Everything I've read until now only examined the story from one perspective. This article open our eyes to another very important perspective. I'll bet there are additional perspectives that we still don't know. That's why I caution against jumping to confusions about these matters.

    side. The civil courts, in Susan’s view, are not perfect since the women “are
    subject to financial demands, pressured to drop charges of domestic violence

    rights to unfit fathers.” Susan’s partner over 30 years is Mendel Epstein.

  31. I hope they do. This judge needs to be removed immediately before she hurts other children. This is a judge who handles this kind of case all the time and to use this abusive language?. she Cannot be allowed to continue this work
