Meir Dascalowitz gets 5 years for assault in mikve

NY Daily News      A man who sexually assaulted a Brooklyn boy in a Jewish bath house was sentenced to five years in prison Wednesday after hearing his unforgiving victim blame him for ruining his life.

 Meir Dascalowitz, 29, had pleaded guilty to abusing the boy beginning when he was 12 and continuing for about a year. But before his sentencing, he got a chance to hear the impact of his repulsive acts.

"I will never forgive to you for the things you did to me," the now 17-year-old boy wrote in a letter read in Brooklyn Supreme Court. "You ruined my life."

"I have been hurt and this hurt will continue throughout my life," the victim continued, revealing that he had been kicked out of school and lost friends after reporting the abuse to authorities. [...]

  1. Just a question - Someone who is attempting homosexual assault may be killed mi'din rodef. And although the Halacha clearly states that if you can save the Nirdaf by injuring the Rodef you must do so, would this be the case when dealing with someone who is not a 1-time Rodef, but a sick individual who will continue assaulting boys and young men?
    The recidivism rate for pedophiles is very high - even more so when dealing with extra-familial pedophiles.

    1. Dangerous question for a blog. Look at C.M. 388 describing dealing with a moser which is presumed to be ready to do it again.

      The heter to kill a rodef - or a sofek roder - is only if there is no other way of stopping him. If there is a non-lethal way then killing him is murder. This would clearly apply to a case where there is a chazaka that he will commit the sin again.

      thus a pedophile has the status of rodef because he is presumed dangerous and is likely to attack again in the future. You connect the dots.
