Rubashkin appeal rejected by Supreme Court

Forward  The Supreme Court rejected an appeal Monday by Sholom Rubashkin, the former chief executive of a kosher meat packing plant in Iowa who was sentenced to 27 years in prison on charges of financial fraud.

Without comment, the high court refused to consider whether Sholom Rubashkin’s sentence was excessive for a first-time, nonviolent offender and whether he was entitled to a new trial based on evidence of alleged judicial misconduct in the case.

The rejection could mark the last step in a four-year legal saga that began in May 2008 when federal authorities raided the Agriprocessors kosher meatpacking plant in Postville, Iowa.

    As much as I grieve for the unjust incarceration, I grieve for the entire United States. What we are observing is frank bullying by the Executive Branch of the Judicial Branch. This has occurred with the Legislative Branch, which enabled the stupid laws of Obamacare to be approved against all forms of saichel (not that we do not have a health care crisis). The recent Supreme Court decision was the first instance of such bullying, and it has happpened again. Aside from the recognition that has been proven once again that we must rely on HKB"H, not people, we are again shocked to see the deterioration of democracy that has become the form of government in United States. Sorry for the pessimism, but until we have open nissim, and we participate in the hishtadlus to vote these enemies of menchlichkeit out of office, we are apt to see more of this.
