Supreme Court upholds birthright citizenship. Daf Hayomi Chullin 60b-61a: The mishna states: The signs of the kosher bird were not explicitly stated in the Torah. The Gemara asks: And is it true that they were not stated in the Torah? But isn’t it taught in a baraita: “The nesher” (Leviticus 11:13) is a non-kosher bird.
ReplyDeleteJust as a nesher is unique in that it has no extra digit or crop, and its gizzard cannot be peeled, and it claws its prey and eats it, and it is non-kosher, so too, all like birds with these four signs are non-kosher. And just as doves and pigeons which have an extra digit and a crop, and whose gizzard can be peeled, and do not claw their food and eat it, are kosher, as they are fit for sacrifice on the altar (see Leviticus 1:14), so too, all like birds with these four signs are kosher.

The Torah names 24 species of non-kosher fowl, forbidden to eat, without specifying what is it in these 24 species that makes that that species forbidden to eat. Jungle people in ancient Africa, whatever, knew well these 24 species. The Gamara proves that there is no short way to establish if a fowl is forbidden to eat. Fine. Still better than Canada where citizenship is awarded on more lenient terms than the Right of Return in Israel.
