Schlesinger Twins: Beth is denied contact with sons - Father is breaching court order

Help Beth   Today is the second Tuesday that the father has denied me access to the children.

I saw them on Sunday (pick up at a temporary visiting centre) at the cost of 50 Euros. But they cannot do Tuesdays. Although the father is breaching the court order, it seems there is nothing I can do about it.

Judge Susanne Gottlicher has now given up the case and transferred it to the court in the father’s district where the children reside. Legally, the case should have transferred 2 years ago when the father was first awarded custody. I applied for the transfer then but Gottlicher refused to give up the case at that time.

The father has appealed Gotticher’s decision now, arguing that the case MUST stay with her because only she ‘knows the personalities of the parents.’ He is adamant that no other judge can take over the case.

The Appeal Court must now decide which court has jurisdiction. In the meantime the case is frozen – yet again. The father can flout the court orders and deny the children access to their mother with impunity because there is no judge to enforce the current visitation order or make new decisions.

The father is well aware of this and is exploiting the opportunity – yet again – to deny me even  the minimal contact  the court has awarded me.

I am left in limbo,having no idea when the Appeal Court will decide about the jurisdiction of the court and don’t know how long after that any visiting decisions will be made. If a new judge is appointed, hearings will probably be held, which all takes time and drags out the process further.

In addition, the father’s lawyer recently sent a letter to the Chabad kindergarten banning them from any contact with me and preventing the teachers from divulging any information about the children’s progress and welfare.

The children will turn 5 in May and still cannot speak full sentences or even communicate basic information. And yet the courts still maintain the ‘children’s interests’ take priority above all else!

  1. why has the judge given up the case? is this because she is clearly worried about the decision she has made?
    Not sure what the father is achieving by not allowing the boys to see their mother

    1. He probably hates the mother's guts for her media campaign but do most fathers behave like this? No. Because they don't give their partners cause to go to the media. These are the most dramatic cases and usually involve violence, drugs, alcohol, abuse and/or psychiatric disorders in the parent who goes bananas about the publicity. Here, we have a judge who, along with the appeal judges, failed to do her duty: the children and the father were ordered by the court to be psychologically tested, yet not a single court up to the Supreme Court in Vienna asked to see the results of the testing that, contrary to court orders, never took place. All of this indicates, rita rose, that the custody proceedings connected with Sammy and Benji were highly questionable and put Austria to shame. It looks like a "well-behaved" country on the surface and does not appear at the top of lists of the most corrupt, but .... scratch below the surface and you'll find shocking things happening at every level of society. At this very moment, Austria's leaders are struggling to solve the immense financial problems caused in a southern province by a maverick politician and bank founder beloved of the right-wing sector of society who failed to survive a car crash and was thus never able to be prosecuted.

  2. The father is obviously a child himself who had a lousy upbringing, has no idea how to raise children as he had no example. He is playing with his children like weapons against his xwife which is vile! In the end his children will hate him. Why is he punishing them?

    1. Hanna V, you suggest that the father must have had a bad upbringing. I'd tend to agree with you as this is the main reason why people become vile, inhumane adults. Another question I'd ask is whether there has ever been any evidence of the molesting of small children in the Vienna community, as is very common in others, eg Brooklyn, USA, and Melbourne and Sydney, Australia, as well as in many other cities with large Jewish (and especially Haredi) communities. Horrific stories like the one below are commonplace and makes you wonder if the personality disorders that are diagnosed in childish adults aren't also common in parents (predominantly men in the research) who were molested when they were young.

  4. The tide is turning!!! This case is a travesty of justice!! Beth will one day get her sons back and looks like not long until that happens! More and more people are involved and the worlds attention is looking in now.... The father should be very scared that his corrupt nature will soon be looked at closer than ever. He obviously has some power of persuasion either through blackmail or other means in order for him to have persuaded so many people in authority to stand with him. Looks like they are turning their backs now.... Should be interesting to see if he resides himself to back down and realises the distraction he is causing those around him.

    1. Looks like he's causing havoc in the children's lives, Yocheved. Why can't they speak properly when even 2 year olds can? They're nearly 5! If he's having them seen by professionals and talking to them constantly as a good parent does when he's with them, their speech should be pretty normal by now. If it's not, there are only a couple of possibilities: 1) trauma and/or 2) abuse. The latter is a comprehensive term. It can also refer to using people who are totally inappropriate as carers.

  5. Whatever the reason for their delayed speech I think Beth or the courts should be able to intervene?? The longer this case drags out the more detrimental to the children in regards to their developmental and emotional selves...,I am afraid this is exactly what the father wants knowing that one day Beth will get the boys back and his hold over everyone will stop but having achieved his main goal of messing up the children and handing them back! finally his job at revenge will be complete!

  6. Revenge!!??!! How could a good Jew possibly want revenge on his wife at the expense of his children? That would be about the cruelest way he could do it! I can't believe a man who leads prayers and is thus being honoured by his section of the community could want to harm his children like this. If this is his goal, his future as a doctor will not be rosy. A thought re the boys lack of speech; could they possibly be autistic?
