If anyone has the documents from the Israeli police and social services, as well as the documents from ACS - which Hersh claims exonerated him of abuse charges - I would be happy to post them.

45. As a result of her [Cohen's] telephone calls, and those of her agents, the K'far Zeitim school was required to report the allegations to the Israeli authorities, which opened two investigations: a criminal investigation and a social services/child protection investigation.
46. The criminal investigation was closed almost immediately because - among other things - the police discovered that all the allegations were obviously false and without any basis whatsoever.
47. The Hershes later learned that the final Israeli Police report mentioned the fact that there was a "secret network" aligned against Plaintiffs that was being controlled from outside Israel by defendant Cohen and that there was absolutely no truth to the allegations.
48. The social services investigation, which involved extremely disruptive and intrusive probing into Plaintiffs' family life and the lives of their other six children, was not constrained by the absence of credible evidence as was the criminal investigation and, therefore, lasted for approximately six months.
49. During that six-month period, under Israeli law, S. the twin who was the subject of the investigation and allegations, was not permitted to return home.
50. At or about this time, Mrs. Hersh became very ill with lymphoma; even while the social services investigation had still not yet been officially concluded on or about August 2005 the Hershes returned to New York in order to obtain more advanced treatment for Mrs. Hersh's illness.
51. While Plaintiffs were in New York the Israeli department of social services case came to the same conclusion that the Israeli police did; namely, that there was no substance whatsoever to the allegations and the complaint by Defendants was disposed of as "unfounded".
52. The Israeli Social services also ruled that S should be reunited with his parents. [...]

In an unrelenting effort to further their self serving irrational agenda, upon information and belief, Aryeh Larry Wolbe and his agents or proxies, acting in concert with - and under the guidance of - defendant Cohen, also contacted New York City Administration for Children's Services ("ACS") several times and instructed ACS to view the websites that he had set up about Mr. Hersh.
56. As a result of the above mentioned telephone calls to ACS, ACS requested that Mr. Hersh grant to them permission to speak directly with Y at the Tranquility Bay, Jamaica School he was the attending. Mr. Hersh granted the request.
57. ACS, upon speaking with Y at Tranquility Bay, concluded that he was absolutely safe and was being adequately taken care of.
58. A supervisor at ACS then spoke with the Hershes to compliment them on having been so determined to help Y that they had not given up until they had located a facility that was appropriate for Y and appeared to be helping him with his disabilities. ACS then officially closed their investigation as "unfounded".

ReplyDeleteAmazing that the lawsuit is about them losing their jobs, but they have no problem using their "complaint" for make their sons look so bad. These are sick people, and Dan, you should still be convinced, read the WHOLE complaint, and you will see that it is all about how terrible their kids are, when the evidence clearly shows that it is not the case at all.
ReplyDeleteand regarding ACS speaking to Y in jamaica, it fails to mention that the staff of the horror show was standing over Y's head during that phone call, and he was not able to speak freely, just one quick point in disproving the parents lies, and this is already documented in court with Y's affidavit.
I will chime in with congratulations that this side was posted. However, having access to "facts" here, I note that this position is full of complete lies, and several half-truths. If one just examines the track records of those involved, RAS and the Hershes, there should be major reason to be skeptical about anything that gives them support. I have no problem being open minded, and I have been wrong before. But the facts have been extremely clear, and these guys need to be thrilled that I will not be on the jury. A little honesty will go a long way. RAS and the Hershes lack this trait completely. And the azzus to go to secular court and seek revenge against those that rescued the child is beyond tolerance. I am glad this side got some air - we can see right through it.
ReplyDeleteThe sub-text of this testimony, and of other testimony from Hersh's relatives, clearly reveals that the entire Hersh story, from top to bottom, every aspect of it, is a dramatic baal teshuva (Hebrew, singular for returnee to Orthodox observance) drama.
ReplyDeleteALL the so-called "legal" issues held by Hersh, like the frivolous police complaints that Hersh has a bad habit of filing against his own family members and others who cross his path of easily stirred wrath (where did he learn to file police complaints when he's upset with someone?), are ultimately NOT the point and are NOT the main issues regarding Hersh at all!
But rather, the Hersh saga has all the factors that baalei teshuva (plural: newly religious Orthodox Jews) go through, from:
*How to adjust to their new identities as very religious "new-born" or "re-born" religious Jews after having led a thoroughly secular lifestyle;
*Relationships with non-Orthodox parents and relatives (it's mush easier to cut all contacts with former secular and and gentile friends) and especially how much time and access to allow to non-religious or less-religious and perhaps even possibly anti-religious family members especially grandparents and siblings who are entitled, sometimes even BY LAW, to have some visits with their grandchildren;
*Falling prey to a virtual induced amnesia about their past secular lives and imagining that the world at large has also wiped the slate clean and thinking that people can't see through them;
*How to raise children in a well-balanced religious Orthodox way when one's own childhood and life's experiences provide no examples to follow;
*Over-reliance and submissiveness to new religious and spiritual "near-Messianic" guides (yes, sometimes the whole scenario displays cult-like symptoms from every angle) who are not capable of understanding every last petty religious conflict or nuance of everyday life's-struggles for the newly religious and fail to see their limitations as experts in this field, while there are genuine experts in how to grow in new-found Orthodox life they are real KIRUV, Jewish outreach experts who, while not as learned as rosh yeshivas, yet they deal with these kind of baal teshuva issues daily and can fix them before they lead to catastrophes as in the Hersh case;
*Most seriously, the astute observer and truly caring guide and rabbi needs to have the ability to identify and deal with the real psycho-social and perhaps even other deeper personality, emotional, and characteralogical issues coming from profound inner-conflict, guilt, anger, self-destructiveness, self-centeredness, and many complex factors that must be resolved in the growth and making of a harmonious, well-balanced and peaceful baal teshuva, and to know when to guide baalei teshuva to get THE RIGHT KIND of rabbinical advice, or psychotherapy or counseling and not to have situations where there is abuse and manipulation of the rabbinical world, law enforcement, the legal profession, and the judicial system just to get one's way in fits of misdirected anger and spite that waste everyone's time, spin everyone's wheels and will accomplish absolutely nothing for the baal teshuva in question.
The lies and distortions here are incredible, and while verified documentation is still awaited from Israeli social service and police sources, as well as documentation from the ACS in New York, the so-called claims about Tranquility Bay are just nuts, simply because Tranquility Bay was SHUT DOWN in 2009 for the negative attention it got not just from Isaac Hersh being in it, the year after Isaac Hersh was forcibly incarcerated there. Check it out.
ReplyDeleteThe claims here also conveniently forget to mention that the Tranquility Bay institution was a part of a much larger "Evil Empire"-like network of WWASPS schools that pummel wild teens into shape that have been mired in law suits and proven allegations of all forms of fraud and abuse in many court cases across the USA as reported in quite a few news reports. Check it out, you'll find plenty of references to this on Google.
And who are they kidding that based on a mere "PHONE CALL" the ACS then made a serious professional determination about the welfare of a child there, a totally absurd claim. People are not that stupid to believe such hogwash. Had the ACS or anyone flown down to Jamaica and checked out the horrific conditions there, they would have recommended shutting it down on the spot because no such facility could ever exist in the USA proper and escape scrutiny, punitive legal cases and a terrible press, as has happened and why quite a few facilities like Tranquility Bay run by WWASPS have been forced to shut their doors or face the consequences.
They will have to do a lot better than this to convince anyone that Tranquility Bay was "great" while every last relative and rabbis Hersh bumped into must be condemned as Hersh unashamedly does.

ReplyDeleteThis lawsuit does this with flair and advanced vocabulary. It is not longer the bad judgment of the Hersh parents, but now it is being touted as responsible parenting and "daas Torah". The only positive thing about this is that it is another indication that Moshiach is coming soon.
